This chapter may be known and cited as the "West Vincent Township
Off-Highway Vehicle Ordinance."
The term "off-highway vehicle," as used in this chapter, includes, by definition as set forth in §
347-7 hereof, similar vehicles such as minibikes, trail bikes, motorbikes, etc., all of which are given by way of illustration and not by way of limitation.
It shall be unlawful for any person to operate an off-highway
vehicle as herein defined on fields, sidewalks, foot paths, driveways,
roads, parks or any other property of the Township or any other municipal
corporation, or upon the property belonging to any other person other
than the operator of the vehicle or his family without obtaining the
express permission of the owner of the property.
The Police Department of the Township of West Vincent is hereby
directed and authorized to administer this chapter on behalf of the
Township.
No person shall operate an off-highway vehicle or similar vehicle
without an operative baffled muffler or in such manner or at such
time or times of day as to cause an unreasonable annoyance and disturbance
of the peace of the Township and citizens thereof.
Any person who violates any provision of this chapter shall
be subject to a fine, upon summary conviction of said violation, of
not more than $50 or to suffer imprisonment for a period not to exceed
five days for failure to pay said fine and costs.
As used in this chapter, the following terms shall have the
meanings indicated:
BAFFLED MUFFLER
That type of muffler containing silencing baffles which prevents
the exhaust gas from passing straight through the muffler or exhaust
pipe.
OFF-HIGHWAY VEHICLE
Every motor vehicle having a saddle for the use of rider(s),
designed to travel on not more than three wheels or tracks in contact
with the ground, bicycles with motor attached, including those vehicles
known as trailbikes, motorbikes, and minibikes. This definition excludes
such vehicles as may be included within the term "tractor" or "snowmobile,"
as defined in the Pennsylvania Vehicle Code.
