There is hereby established within the City a commission, to
be known as the "Band Commission."

The Band Commission shall consist of three (3) members who shall
be residents of the City.

The members of the Band Commission shall be appointed by the
Mayor annually for a term commencing from the first regular meeting
of the City Council in each year, following the City election in April.

The members of the Band Commission shall receive no compensation
for their services, nor shall the City be liable in any way for any
services performed by the Commission or the members thereof.

In case of a vacancy on the Band Commission, such vacancy shall
be filled for the unexpired term of appointment by the Mayor.

The Band Commission shall have a supervising control over all
matters connected with the municipal band. The Commission, subject
to the approval of the City Council, shall contract with the authorized
officials of a band or other municipal civic musical organizations
for its employment in the giving of free band concerts, or equivalent
musical services by the band or other municipal civic musical organizations
under the jurisdiction of the Band Commission upon such occasions
of public importance as may be agreed upon and stipulated in such
contract, and shall advise with the Council upon all matters pertaining
thereto; provided, that no contract or agreement made by the Commission
shall be binding upon the City until the same shall have been approved
by the City Council.
