In this Article, unless the context requires otherwise:
PERSON
Any person, firm, partnership, corporation or association.
UNDERGROUND STORAGE TANK
Any underground tank containing flammable liquid or combustible liquid.

A. 
Notwithstanding the other requirements of this Article, the Fire Chief may require a test of an underground storage tank and appurtenant equipment if:
1. 
Inventory control records are improperly kept so that it cannot be determined if a shortage of liquid exists.
2. 
Inventory control records indicate a shortage of liquid.
3. 
Leakage of liquid can be detected visually.
4. 
There is a persistent odor of liquid in the area surrounding the underground storage tank.
B. 
The Fire Chief may order the owner or operator of an underground storage tank to cease operations until any leakage in the underground storage tank and appurtenant equipment has been stopped.

A. 
Every person owning or operating an underground storage tank shall keep accurate inventory control records for the purpose of detecting any leakage in the storage tank and appurtenant equipment. In addition to other records he/she may keep, the person owning or operating the underground storage tank shall make and keep records of concurrent readings of meters on dispensing units and the level of liquid in the storage tank as measured by dipstick. Such inventory control records shall be open for inspection to the Fire Chief.
B. 
Any person owning or operating an underground storage tank shall make a report to the Fire Chief if such person has a suspicion of leakage because of loss of storage tank contents or because of an abnormal accumulation of water in the storage tank.

Any person detecting a leak or suspecting that an underground storage tank may be leaking shall report such leak or suspicion of leaking to the Fire Department immediately.

All underground storage tanks and their appurtenant equipment shall be tested within eight (8) months after the effective date of this Article. Such underground storage tanks and appurtenant equipment shall be retested for leakage every five (5) years.
B. 
Owners or operators of underground storage tanks who have had a test conducted on their underground storage tanks and appurtenant equipment during the calendar year prior to the effective date of this Article shall not be required to retest their underground storage tanks without cause for five (5) years from the date of passage of this Article, provided that the test results and testing procedure are approved by the Fire Chief.
C. 
Testing and repair of any underground storage tank and appurtenant equipment shall be the responsibility of the owner or operator of such underground storage tank.

A. 
Any person owning or operating an existing underground storage tank installation shall file a report with the Fire Chief on forms provided by the Fire Department within thirty (30) days after the effective date of this Article. Such report shall include the following information:
1. 
Name and address of owner or operator.
2. 
Location of underground storage tank.
3. 
Type of underground storage tank installation.
4. 
Capacity of underground storage tank.
5. 
Type of flammable or combustible liquid being stored.
6. 
Such other information as the Fire Chief may determine to be necessary in the administration of this Article.
B. 
Any person installing an underground storage tank after the effective date of this Article shall have ten (10) days in which to file a report with the Fire Chief as required in Subsection (A) of this Section.
C. 
Such underground storage tank shall be tested according to Section 203.510 of this Chapter. The Fire Chief may inspect such underground storage tank and appurtenant equipment while it is being tested to insure that there are no leaks and that the test is being properly conducted.

All pipelines for underground storage tanks shall be tested at the same time the tank is being tested by the same method.

The testing of underground storage tanks and pipelines shall be conducted using a tank, tester model 1000 of the Kent-Moore Service Tool Division or one of equal standard approved by the Fire Chief. The date of the test, the model and type of tester, the name of the operator of the equipment, the duration and results thereof shall be recorded and maintained until the date of the next test and shall be available for inspection by the building code engineer or his duly authorized representative upon request.

Any person who shall violate, fail, neglect or refuse to comply with any of the provisions, regulations or requirements of this Article shall upon conviction thereof be punished by a fine of not less than one hundred dollars ($100.00) and not more than five hundred dollars ($500.00) or by imprisonment in jail for not more than six (6) months or by both such fine and imprisonment.
