Any weeds or overgrown vegetation found growing in any lot or
tract of land in the City are hereby declared to be a danger to the
public health, safety or welfare, and a nuisance, and it shall be
unlawful to permit any such weeds to grow or remain in any such place.

A. It shall be unlawful for anyone to permit any weeds or
overgrown vegetation in excess of eight (8) inches in height, on any
lot or parcel of land within the City. Any such weeds or overgrown
vegetation exceeding such height are hereby declared to be a danger
to the public health, safety or welfare and a nuisance.
B. The provisions of this Section shall not be applicable
to: properties zoned A-1 Agricultural District; undeveloped parcels,
if such undeveloped parcel is one contiguous parcel, not intersected
by any public roadway, and is greater than ten (10) acres; or contiguous
undeveloped parcels not adjacent to any developed parcel. Provided,
however, on any such parcel no weeds or overgrown vegetation shall
be allowed in any area within twenty-five (25) feet from the curb
or edge of any public right-of-way, or within twenty-five (25) feet
of the property line of any property being used for residential or
commercial purposes.
C. As used herein, the term "overgrown vegetation" shall include,
but not be limited to, all grasses, trees, bushes, shrubs, flowers,
and ornamental or garden plants, cultivated or uncultivated, that
meet one (1) or more of the following conditions:
1.
Emit an unpleasant or noxious odor;
2.
Conceal debris of any kind, weed cuttings, cut,
fallen, or hazardous trees and shrubs, rubbish and trash, rocks or
bricks, tin, steel, parts of derelict cars or trucks, broken furniture,
or any material or condition which is unhealthy or unsafe and declared
to be a public nuisance;
3.
Are commonly known and recognized as weeds and
grasses;
4.
Cause a safety hazard by obstructing the line
of sight of a motor vehicle driver, bicyclist or pedestrian at a street
intersection;
5.
Could interfere with the passage of motor vehicles,
bicycles or pedestrians on any public right-of-way; or
6.
Are dead, broken, damaged, or rank vegetation
that has grown abundantly without being cut, pruned, trimmed, or otherwise
cultivated.
