The Fire Prevention Code for the Town of North Andover shall consist of this article and Chapter 50, Alarm Systems, and Article III, Fire Lanes, of this chapter, together with the regulations of the Massachusetts Board of Fire Prevention Regulations, set forth in 527 CMR, and Chapter 7, Fire Resistant Materials and Construction, and Chapter 9, Fire Protection Systems, of the Massachusetts Building Code, set forth at 780 CMR.[1]

A. 
Without intending to limit the generality of the foregoing, the Fire Prevention Code for the Town of North Andover and penalties therefor may be enforced by the noncriminal disposition method in accordance with MGL c. 40, § 21D. The penalties set forth herein shall apply to each separate offense or violation of the code. The Fire Chief or his/her designee shall be the enforcing person for the code.
B. 
The penalty for violation of the code under the noncriminal disposition method shall be as follows:
(1) 
First offense: $25.
(2) 
Second and subsequent offenses of the same violation: $50.
C. 
An enforcing person taking notice of a violation may give to the offender a written notice to appear before the Clerk of the Lawrence District Court within 21 days of the date of the notice in accordance with the provisions of MGL c. 40, § 21D. Any person so notified may so appear and confess the offense charged, in person, or by mailing payment to the Town Clerk in the amount of the penalty. If a person so notified desires to contest the violation, he/she may, within 21 days of the date of the notice, request a hearing before the District Court, in accordance with the procedures set forth in MGL c. 40, § 21D.
