The Mayor, members of Council, appointed officials and Borough
employees shall be required to take an oath of office, which oath
shall be subscribed by the person taking it and shall be filed and
preserved by the Borough Secretary in the Borough records.
A. The form of the oath to be administered shall be as follows, pursuant
to Act No. 463, approved December 22, 1951 (65 P.S. § 211
et seq.).

B. Administration. The foregoing oath shall be administered by any person
duly authorized by law to administer oaths. Any person failing or
refusing to execute this oath shall be discharged immediately by the
proper appointing authority.
Appointed officers and employees of the Borough shall receive
such compensation for their services as the Council shall prescribe,
and the Council may also establish the hours and days of work and
may restrict the outside employment of Borough employees or any class
or category thereof.
All officers and employees appointed by the Borough Council
shall, whenever directed, render their accounts to the Council for
settlement.
Any elected or appointed official or employee of the Borough
who has a substantial financial interest, direct or indirect, in any
contract with the Borough shall make known that interest to the Council
and shall refrain from voting on or recommending that contract. Anyone
who willfully violates this requirement shall be guilty of malfeasance
and shall forfeit his office or position. Violation of this section
with the express or implied knowledge of the party contracting with
the Borough shall render the contract voidable by the Council.
Any person convicted of a crime or offense involving moral turpitude
shall be ineligible to assume any Borough office, position or employment
and, upon conviction thereof while in office, shall forfeit his office.
If any person hereafter elected or appointed to any office or
position in the Borough shall, after lawful notice or process, willfully
refuse or fail to appear before any court, any legislative committee
or the Governor or, having appeared, shall refuse to testify or to
answer any question regarding the property, government of affairs
of the Borough which fall within the scope of his duties or the conduct
of his office or regarding his nomination, election, appointment or
official conduct or shall refuse to execute a waiver of immunity from
prosecution on account of any such matter in relation to which he
may be asked to testify, he may be removed from office by the Borough
Council in its discretion. Any person removed from office pursuant
to this section shall not thereafter be eligible for election or appointment
to any office or employment in the Borough.
Whenever any time established by this chapter for the taking
of any action expires on a Sunday or on a legal holiday, such time
shall not expire on said day but shall expire on the next weekday.
Subject to the applicable provisions of law, the Council shall
require any person having an improvement contract with the Borough
to give a sufficient bond, with corporate surety or other adequate
security, to guarantee the faithful performance of the contract and
the full payment for all labor and materials.
The Borough recognizes that, under modern conditions of metropolitan
growth, the boundary lines of governmental subdivisions rarely reflect
the boundary lines of governmental services and activities. Therefore,
all officers and employees of the Borough shall take all action desirable
and necessary to establish and carry out cooperative programs with
other governmental subdivisions in the area and vicinity of the Borough
to the end that greater efficiency and economy of operation and improved
quality of service will result.
