The elected officials of the Borough of Chalfont shall be the Mayor and seven members of the Borough Council, who shall be elected at large.
A. 
The terms of the Mayor and the Council members shall be four years commencing on the first Monday following the year in which they are elected, except that the Mayor or a Council member appointed to fill a vacancy shall serve only for the balance of the unexpired term.
B. 
The election of Council members shall be staggered. Three Council members shall be elected in the year 1975, four Council members shall be elected in the year 1977, and thereafter three or four Council members, as the case may be, shall be elected each odd-numbered year for a term of four years.
C. 
The Mayor shall be elected in the year 1977, and at four-year intervals thereafter.
The Mayor and Council members shall be qualified voters of the Borough and shall have been residents continuously in the Borough for at least one year immediately preceding their election and must remain continuous residents during their terms of office.
The Mayor and Council members, prior to assuming office, shall take and sign an oath of office as shall, from time to time, be prescribed by the laws of the Commonwealth of Pennsylvania. Such oath may be taken and signed before the Mayor and Judge, Magisterial District Judge or notary public of the Commonwealth of Pennsylvania, and no person shall be permitted to assume such office until the oath, in written form, is filed with the Borough.
Compensation in the form of salaries for the Mayor and Council members for attendance at meeting, in accordance with § C3-1 of this Charter, may be provided. The Mayor and Council members shall receive no other municipal compensation, direct or indirect, and they shall receive no pensions, insurance or other forms of fringe benefits. They shall, however, be allowed expenses actually incurred in the performance of their duties as defined in the Administrative Code (Chapter 1, Part 1).[1]

The office of Mayor or Council member shall become vacant upon death, resignation, termination of residency from the Borough, failure to take the required oath within 30 days of taking office, or removal/forfeiture of office by a court.

A. 
The Council shall, by appointment by a majority vote of the total number of Council remaining, fill any vacancy in the office of Mayor or Council member.
B. 
Should the Council fail, for any reason whatsoever, to fill any vacancy within 30 days after the vacancy occurs, the Court of Common Pleas shall, upon petition of the Mayor, the Council, or any five citizens of the Borough, fill by appointment any vacancy. Any person appointed to fill a vacancy shall possess all the qualifications required of members of Council as set forth in this Charter.
C. 
If any vacancy shall occur in the office of the Mayor or member of Council by death, resignation, termination of residency from the Borough, or by failure to take the required oath, provide the affidavit required under Section 801 of the Pennsylvania Borough Code,[1] or in any other manner whatsoever, the Borough Council shall fill the vacancy within 30 days by appointing, by resolution, a registered elector of the Borough to hold the office, if the term continues so long, until the first Monday in January after the first municipal election occurring more than 60 days after the vacancy occurs, at which election an eligible person shall be elected to the office for the remainder of the term. Except as provided in Pennsylvania Borough Code Section 801(b),[2] no person shall be appointed to fill a vacancy in an elected Borough office unless the person has resided within the Borough continuously for at least one year immediately prior to the person's appointment.

No elected Borough official, while in office, shall hold any other Borough office, Borough employment, or seat on the Borough Planning Commission or Historic Architectural Review Board. In addition, no member of Council may serve as a paid consultant with the Borough government for a period of at least one year after leaving office. This shall not disqualify a member of Council from serving in offices otherwise authorized by law.
