As used in this article, the following terms shall have the meanings indicated:
FOOD
Any raw, cooked or processed edible substance ready for consumption, ice, beverage, or ingredient used or intended for use or for sale in whole or in part for human consumption. Does not include food delivery services such as Schwans, etc.
FOOD STAND/FOOD TRUCK/FOOD TRAILER
A stand, vehicle, or vehicular-pulled trailer at one designated fixed temporary location utilized to provide food for sale to the public.
ICE CREAM TRUCK
A vehicle from which the operator sells only prepackaged frozen dairy or water-based food products and prepackaged beverages. For purposes of this article, a nonmotorized cart from which such products are sold shall be considered an ice cream truck.
SELF CONTAINED
A self-contained unit generates its own electricity as needed and shall contain or otherwise maintain and use a grease interceptor. A self-contained unit is required to report to an approved servicing location for such things as obtaining potable water and disposal of wastewater and other wastes generated by the unit.
A. 
Food stands and/or food trucks/trailers shall comply with all applicable State of Wyoming statutes and regulations.
B. 
Food stands and/or food trucks/trailers may only be operated on public or private property zoned C-1 or C-2, and then only with written permission, and may not be operated upon any public sidewalk, street, alley or right-of-way unless otherwise allowed. Written permission of the owner of the public or private property where operations are being maintained shall be in the possession of the operator at all times.
C. 
Ice cream trucks may be operated on public or private property zoned C-1 or C-2 with written permission. Written permission of the owner of the public or private property where operations are being maintained shall be in the possession of the operator at all times.
D. 
Ice cream trucks may operate for sales to the public from all public streets, alleys and rights-of-way except for Pine Street for no more than 15 minutes before relocating to another location not less than one block from the previous location. When operating from public streets, alleys and rights-of-way, an ice cream truck must obey all state and Town statutes and ordinances. Ice cream trucks may not operate on any other property owned by the Town unless otherwise allowed.
E. 
All persons conducting food sales from food stands and/or food trucks/trailers will be responsible for maintaining the sidewalk, street, or premises adjacent to such food stands and/or food trucks/trailers free from any rubbish, refuse and/or liquid waste resulting from use of the premises. Rubbish, refuse and/or liquid waste must be disposed of in a proper manner. Operations shall not impede traffic or parking.
F. 
Except as allowed in Subsection L below, food stands, food trucks/trailers shall not connect or utilize Town water and sewer systems except for retail dump and fill stations. Reference Chapter 460 for prohibited discharges to the sanitary sewer system.
G. 
Food stands, food trucks/trailers and/or ice cream trucks operating and authorized as part of Rendezvous, farmers' markets or other Town-permitted events may be operated and allowed under the event's conditions and restrictions as defined in Chapter 160. Applications shall be accompanied by current health inspection certificate and a fire inspection report from no longer than 12 months from the date of the application.
H. 
Operations of food stands and/or food trucks/trailers shall require a permit. Applications may be approved and issued by staff. Permit cost and length shall be set by resolution.
I. 
Food trucks shall not disrupt traffic, parking, pedestrians, or other businesses. If there is a problem or a complaint, a Town employee shall have the authority to ask the permittee to move to a more suitable location. Failure to move shall result in a violation of this article and the permit may be terminated at that time by the Mayor or a designated representative. Reinstatement of the permit shall be by the Town Council after a public hearing.
J. 
Location on Town property may be approved by the Mayor and/or the Town Council as a part of a temporary use permit for a fair, festival, or tournament.
K. 
Food stands and/or food trucks/trailers shall be allowed to operate in and occupy a location for no more than 14 days within any thirty-day period without vacating the location. Partial days shall constitute a full day of occupancy. Vacating the location shall mean leaving the location for 72 consecutive hours to another location not less than one block from the previous location.
L. 
Food stands and/or food trucks/trailers shall be completely self-contained as to water acquisition, sewer disposal and power acquisition. Where some or all of said services are available on site, access is allowed by the property owner and any such water acquisition, sewer disposal and power acquisition shall comply with all other Town ordinances and Wyoming State statutes, including but not limited to backflow prevention, grease interceptor installation and compliance with electrical code, such on-site services may be utilized by food stands and/or food trucks/trailers. The property owner must confirm that the services to be used by the food stands and/or food trucks/trailers comply with all other Town ordinances when the written permission required under Subsection C above is provided. Town staff may make an inspection of a property the first time it is used to provide on-site services to verify compliance.
M. 
Food may be prepared outside of a food stand and/or food truck/trailer and should be incorporated within the health inspection certificate and a fire inspection report.
N. 
This article shall not apply to lemonade-type stands operated by minors or food sales by tax exempt organizations.
A violation of this chapter is a misdemeanor and subject to the general penalty provisions of Chapter 1, Article IV, General Penalty.
