The following terms, as used in this ordinance, shall be defined
as follows:
AIR CONTAMINANTS
Smoke, dust, fumes, gas, odor, mist, vapor, pollen or any
combination thereof.
INCINERATOR
Any device, apparatus, equipment or structure used for destroying,
reducing or salvaging, by fire, any material or substance, including
refuse, rubbish, garbage, debris, scrap or animal remains.
INSIDE INCINERATOR
Any device or equipment designed for the destruction, by
burning, of refuse or other combustible waste material in connection
with commercial, industrial buildings or multiple dwellings.
PERSON
Any individual, public or private corporation for profit
or not for profit, association, partnership, firm, trust, estate,
department, board, bureau or agency of the Commonwealth, political
subdivision, municipality, district, authority or any other legal
entity whatsoever which is recognized by law as the subject of rights
and duties.
RINGELMANN SMOKE CHART
The Ringelmann scale for grading the density of smoke, published
by the United States Bureau of Mines, or any chart, recorder, indicator
or device for the measurement of smoke density which is approved by
the Borough Manager{10} as the equivalent of said Ringelmann scale.
SMOKE
Small gas-borne particles resulting from incomplete combustion,
consisting predominately of carbon and other combustible material,
and present in sufficient quantity to be observable.

a. It shall be unlawful for any person to cause, suffer or allow to be discharged into the open air any emission of air contaminants beyond the limits adopted and made a part of this Ordinance (§
9-104).
b. No commercial and/or industrial construction, installation or alteration
of equipment used for the emission into the open air of any air contaminants
shall be made which is not in accordance with plans and specifications
upon which the installation permit is issued. Violation of the installation
permit shall be sufficient cause for the Manager to stop all work.
Further work shall not proceed until the violation in question is
corrected and the work done in accordance with the installation permit.

a. This ordinance shall be administered by the Borough Manager.
b. The Manager shall have the authority, with the consent of Council,
to engage the services of specialists, chemists, engineers or other
experts in order to assist him in obtaining evidence and prosecuting
particular violations of the provisions of this ordinance.

a. No person shall emit into the open air contaminants from any structure,
process or vehicle which exceed quantities and concentrations that
cause injury, detriment, nuisance or annoyance to any number of persons
or to the health and safety of any such persons or the public or that
cause or have a tendency to cause injury or damage to business or
property.
b. No person shall discharge into the open air from any single source
of emission any smoke for a period or periods aggregating six minutes
in any 60 consecutive minutes which is, in shade, as dark as or darker
than that designated as No. 2 on the Ringelmann Chart, as published
by the United States Bureau of Mines.
c. Excepting as hereinafter provided, no person shall construct, install
or alter any equipment emitting any air contaminants into the open
air until an application, including plans and specifications, prepared
by a registered engineer, shall be filed in duplicate by the person
or his authorized agent in the office of, and has been approved by,
the Borough Manager, and an installation permit issued by said Manager
for such construction, installation or alteration.
d. No person shall operate any inside incinerator between the hours
of 3:00 p.m. and 10:00 a.m., local time, except in the case of a multiple-chamber
incinerator, where the final-stage chamber is equipped with an auxiliary
fuel after-burner, which is automatically controlled to maintain a
temperature in the final-stage chamber of not less than 1400°
F.
e. All incinerators must have the following features:
(1)
Primary combustion chamber;
(2)
Secondary combustion chamber;
(3)
Chimney that is not used for a refuse chute;
(4)
Provisions for burning auxiliary fuel in sufficient quantity
to assure the complete combustion of the charged material and the
bases issuing therefrom;
(5)
Automatic means of regulating the draft within the chimney or
other portions of the installation; and
(6)
Settling chamber large enough to reduce gas velocity sufficiently
to permit settling out of fly ash particles.
f. Burning of materials in an incinerator provided with auxiliary fuel
without the auxiliary fuel being used concurrently is prohibited.
g. Auxiliary fuel burners in incinerators must have ignition failure-protection
controls.{30}

Any person who shall violate any of the provisions of this ordinance
shall be subject, for each violation, to a fine of not less than $10
and not more than $50 for each violation. Violations on separate dates
shall be considered separate offenses.
