The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
APPROACH
That portion of a road extending 100 feet on each side of culvert or bridge.
BASE COURSE
The supporting part of the road or bottom.
DRAINAGE
To make gradually dry, by trenches, channels, etc.
GRADE
The rate of ascent of a road.
HIGHWAY
A road or way over which the general public has the right to pass.
ROAD BED
The whole material laid in place and ready for travel.
ROADWAY
The traveled portion of a road.

The purpose of this article is to promote the health, safety, morals, prosperity, aesthetics and general welfare of the Town of Whitewater, and it is the general intent of this article to regulate and restrict the construction and alteration of roads and highways prior to acceptance by the Town Board; to lessen congestion and to promote the safety and efficiency of the streets and highways; and to facilitate proper drainage, stabilize and protect property values and further appropriate use of land and conservation of natural resources and preserve and promote the beauty of the community.

It is not intended by this article to repeal, abrogate, annul, impair or interfere with any existing restrictions, rules, regulations or permits previously adopted or issued pursuant to law. However, wherever this article imposes greater restrictions, the provisions of this article shall govern.
Individual or corporate owners of land wishing to create or alter a highway shall make application in writing to the Board of Supervisors and submit to the Board of Supervisors a detailed drawing indicating the exact location and description of a proposed highway. Upon receipt of the application and drawing, the Town Board will proceed to examine all aspects of the proposed creation or alterations applied for. If approved by the Town Board, the individual or corporate landowner shall be given a permit and proceed under the supervision of the Town Board.

The following are standards set by the Board of Supervisors for the proposed construction or alteration of highways in compliance with good practice, general construction and safety:
A. 
Highway. The minimum width for any highway shall be not less than 66 feet wide, with a roadway of 30 feet and with a top surface of 20 feet.
B. 
Grade. The establishment of grade will be determined by the Board of Supervisors.
C. 
Ditching. Ditching of roadway must be complete and have proper elevation to provide for adequate removal of water. When it becomes necessary to make a lateral trench leading from the main ditch then the additional land necessary for the removal of accumulated water must be provided and deeded to the Town along with the necessary land for the highway. The additional land conveyed to the Town for drainage will be under the supervision of the Town Board at all times.
D. 
Base course. The base course must be of a quality and composition suitable for the location; and in the event of a low or swampy area, the base course must have a sandy composition to provide necessary drainage of the road bed. Any muck holes encountered before and during construction of the roadbed must be removed and filled with a sandy lift to provide a solid base.
E. 
Gravel roadway. Gravel roadways shall be no less than 30 feet wide and consist of at least eight inches of compacted gravel.
F. 
Top surface course. The top surface course must be a minimum of two-inch asphalt with a twenty-foot minimum width.
G. 
Culverts.
(1) 
Any culvert necessary for proper drainage shall be installed after elevation and location is obtained from the Town Board. The minimum length of any culvert installed in any roadbed shall be 26 feet in length; however, the diameter and length of the culvert will be subject to the approval of the Town Board after the amount of flowage is determined. Any secondary culverts installed in any lateral trenches will be of a size and length as determined by the Town Board.
(2) 
If at any time it is decided by the Town Board that the construction of a culvert or a bridge would be of a size and cost that it would create a hardship to the owner or owners of land required to build said culvert or bridge, the Town Board may proceed to accept the road complete as required by the above rules and regulations except that part extending 100 feet on each side of the culvert or bridge. The portion of road extending 100 feet on each side of culvert or bridge will be known as the approach. The approach will be accepted incomplete, with the reservation that the Town will allocate to the owner or owners a portion of the cost of construction of the bridge or culvert. The Town will then proceed to build the culvert or bridge and approach with the financial assistance of any federal or state bridge aid, if available. The balance of the cost of construction not covered by aid will be charged to the owner or owners of the abutting road. It is not the intent of this section to discriminate or favor any individual or individuals, but rather to aid in construction so as to reduce the cost of construction in areas where nature created extreme road building conditions.
H. 
Cul-de-sac. Any road which is not open to through traffic and dead-ends must have a cul-de-sac of a sixty-six-foot diameter.
Upon completion of a proposed highway, the Board of Supervisors will proceed to make final inspection, accepting or rejecting the road, as the case may be. If the road is rejected, corrections must be made as recommended by the Board of Supervisors before final inspection can be made again. If final acceptance is then made, the owner or owners will convey to the Town Board by deed all land necessary for the road as previously mentioned.

As a further condition of approval, the Board of Supervisors of the Town within which the construction or alteration of the highway lies may require that the applicant make and install any improvements reasonably necessary or that he/she execute a surety bond to insure that he/she will make these improvements within a reasonable length of time.
