Maintenance of stormwater drainage and erosion and sediment
control facilities located on private property shall be the responsibility
of the owner of that property. Before an appropriate permit is obtained
from the Village, the applicant shall execute a maintenance agreement
with the Village guaranteeing that the applicant and all future owners
of the property will maintain its stormwater drainage and erosion
and sediment control system. Such agreement shall be recorded with
the Recorder of Deeds of the county. The maintenance agreement shall
include a schedule for regular maintenance of each aspect of the property's
stormwater drainage and erosion and sediment control system and shall
provide for access to the system for inspection by authorized personnel
of the Village. The maintenance agreement shall also stipulate that
if the appropriate personnel of the Village notify the property owner
in writing of maintenance problems which require correction, the property
owner shall begin such corrections within 72 hours, and correction
shall not extend beyond 10 calendar days of such notification. If
the corrections are not made within this time period, the Village
may have the necessary work completed and assess the cost to the property
owner. The Village has the option of requiring a bond to be filed
by the property owner for maintenance of the stormwater drainage and
erosion and sediment control system.
Any drain or conveyance, whether on the surface or subsurface,
which allows a direct or indirect nonstormwater discharge to the storm
drain system to enter the storm drain system is forbidden in the Village.
Illicit discharge may include but is not limited to any conveyances
which allow any nonstormwater discharge including sewage, process
wastewater, and wash water to enter the storm drain system and any
connections to the storm drain system from indoor drains and sinks.
