This chapter shall be entitled "a local law pertaining to the
establishment of a Department of Public Works in the Town of Ellicott."
The Town Council of the Town of Ellicott has determined that
it is in the best interests of the Town of Ellicott to establish a
Department of Public Works and to assign certain administrative functions
and duties to the Director of Public Works.
This law is enacted by the Town Council of the Town of Ellicott
pursuant to its authority under § 10 of the Municipal Home
Rule Law and § 64, Subdivision 21-a, of New York State Town
Law.
The position of Director of Public Works is created to provide certain
efficiencies, reduce costs (including the costs of outside consultants
and legal counsel) and provide a better level of service to residents
of the Town. The Director of Public Works will coordinate long-range
planning and oversee maintenance of all water, sewer and electric
districts within the boundaries of the Town of Ellicott. The Director
of Public Works shall be a part-time position and serve at the pleasure
of the Town Council. The Director of Public Works shall be appointed
on an annual basis. The office shall be considered as unclassified
civil service. The Director of Public Works shall comply with the
Town of Ellicott personnel policy, and the position shall be in compliance
with civil service laws. The Director's salary shall be paid
in its entirety with revenues collected in special district accounts.
The Director of the Department of Public Works shall be responsible
for the general administration of the Department, including budget
preparation and oversight, purchasing, cost analyses, recommendation
of capital improvement programs and any other matters pertaining to
water, sewer and electric districts that may be assigned from time
to time by the Town Council. The Director shall also:
A. Establish and maintain liaison and cooperation with the Jamestown
Board of Public Utilities in regards to matters pertaining to certain
water, sewer and electric districts located within the Town of Ellicott.
B. Establish and maintain liaison and cooperation with the South and
Center Chautauqua Lake Sewer District in regards to matters pertaining
to certain sewer districts located within the Town of Ellicott.
C. Establish and maintain liaison and cooperation with National Grid
in regards to matters pertaining to certain electric districts located
within the Town of Ellicott.
D. Formulate programs for the various districts when necessary.
E. See that all special district facilities are adequately maintained.
F. Keep the Town Council apprised of necessary repairs and/or maintenance
within the districts.
G. Submit to the Town Supervisor on an annual basis, if directed, an
operating budget for each special district for the ensuing calendar
year.
H. Oversee expenditures in each water, sewer and electric district to
make sure they do not exceed budget allocations.
I. If necessary, establish and oversee a capital expenditures program
for each special district and submit it to the Town Supervisor.
J. Answer questions, investigate complaints and review suggestions related
to water, sewer and/or electric districts received from either the
general public or the Town Council.
K. Maintain manuals, records, maps and other documentation pertaining
to each special district to ensure continuity for future Directors.
The Director of Public Works shall report to the Town Council
and serve at the pleasure of the Town Council. The Town Council may
eliminate the position at any time. The Town Council shall establish
the salary for the Director of Public Works position on an annual
basis.
The salary for the Director of Public Works shall be paid from
funds allocated to special districts. No portion of the salary for
this position shall be paid from the Town's general fund.
This chapter shall take effect upon filing with the Secretary
of State and State Comptroller as required by § 27 of the
Municipal Home Rule Law.
