The purpose of this chapter is to regulate parking of trailers on public or private property only where such parking is otherwise permitted by existing rules, regulations, ordinances and/or statutes of the Township of Upper Darby or the Commonwealth of Pennsylvania. It shall be unlawful to park any backhoe, bulldozer or any other excavation equipment, bus, house coach, limousine, school bus, tractor-trailer, semitrailer or combination thereof, stinger-steered automobile transporter, mobile car crusher, solid waste collection vehicle, concrete mixer truck, chemical/gas truck, fuel or oil truck, boat, boat trailer, utility trailer, truck trailer, dump truck either by itself or in combination with a trailer, recreational vehicle or tow truck on any Township street between the hours of 7:00 p.m. to 6:00 a.m. This section shall not apply to vehicles and equipment used by public service utility companies when engaged in repairing or extending public utility service.
As used in this chapter, the following words and phrases have the meanings indicated below:
CONTRACTOR'S TRAILER
Every trailer designed and/or used primarily for office purposes in connection with the construction of a building and/or buildings.
OFFICE TRAILER
Every trailer designed and/or used primarily for office purposes.
OWNER
A person or persons holding the legal title of a trailer; or in the event a trailer is the subject of chattel mortgage or an agreement for the conditional sale or lease thereof or other like agreement, with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the mortgagor, conditional vendee or lessee, then such mortgagor, conditional vendee or lessee shall be deemed the owner for the purpose of this chapter.
PARKING
The standing of a trailer, whether or not occupied by persons or property, upon any real property in the Township of Upper Darby.
PERSON
Any natural person, copartnership, association or corporation.
TRAILER
Every vehicle which is not self-propelled and is designed to carry property or passengers or designed for living quarters wholly on its own structure.
TRUCK TRAILER
Any trailer designed and/or used primarily for transportation of goods, wares and/or merchandise.

No person who is the owner of an office trailer and/or a contractor's trailer shall permit the parking of his vehicle within the Township of Upper Darby for a period in excess of 30 days unless he shall first obtain a permit therefor as hereinafter set forth.

When otherwise permitted by the existing ordinances of the Township of Upper Darby or the statutes of the Commonwealth of Pennsylvania, permits may be obtained by the owners of trucks, contractor's and/or office trailers, permitting such a trailer to be parked upon real property in the Township of Upper Darby upon application and payment to the Township of Upper Darby of a fee as set from time to time by the Township Council.

All permits under § 497-4 shall be issued for a period of one year commencing the first day of September and ending the 31st day of August. Applications for permits for the period beginning September 1 of each year may be obtained in the office of the Building Inspector of Upper Darby Township on or after August 1 of that year. Permits under § 497-4 obtained on or after March 1 of each year shall require a fee of 50% of the amount charged for an entire year. On or after June 1 of each year, permits shall be charged for at the rate of 25% of the annual fee.
When a permit is issued under § 497-4 hereof, the Building Inspector of the Township of Upper Darby shall issue a gummed sticker to the owner, which shall then be affixed by the owner to the trailer in a prominent place.
The owner of any trailer for which a permit is issued under this chapter shall keep his trailer painted and in good repair and securely anchored.

This chapter shall be enforced by the filing of a civil complaint or by such other means as may be provided by the Pennsylvania Rules of Civil Procedure. Any person, firm or corporation who violates any building, housing, property maintenance, health, fire or public safety code shall, upon being found liable in a civil proceeding, be ordered to pay a penalty of not more than $1,000, plus the costs of prosecution, plus all Township attorneys' fees incurred in the prosecution of the civil case. Any person, firm or corporation who violates any other ordinance shall, upon being found liable in a civil proceeding, be ordered to pay a penalty of not more than $600, plus the costs of prosecution, plus all Township attorneys' fees incurred in the prosecution of the civil case. Each day that a violation continues shall constitute a separate violation of this chapter. Each subsection of this chapter that is violated shall constitute a separate violation of this chapter.
Any person who is the owner of any trailer or who is in possession of any real property upon which a trailer is parked may be exempt from the provisions of this chapter, provided such person is regularly engaged in the business of offering trailers for sale or is regularly engaged in the business of operating tractors and trailers as a common carrier and the said trailer is temporarily parked in connection with the operation of that business; provided, however, that no such person shall be exempt from the provisions of this chapter unless a certificate of occupancy shall have been issued to him permitting the use of a structure and/or real property in the Township of Upper Darby for the conduct of either the business of offering trailers for sale and/or operating tractors and trailers as a common carrier.
