When, in the opinion of the Borough Council or its employees, it is necessary to repave or repair any Borough streets, all motor vehicles located on such streets shall be removed in accordance with the terms of this article.
When it is determined as above that a street or streets be repaired or repaved or for any other reason in the opinion of Council, or its employees, engaged in street repairing or repaving, Council or its employees shall post notices on such streets to such effect and all vehicles shall be removed from such street or streets within 24 hours of the posting of such notice.
After such posting as above set forth, it shall be unlawful to operate any motor vehicle on such streets.
The owner of any vehicle who shall violate any provision of this article, upon conviction thereof by a Magisterial District Judge, shall be subject to a fine of $50 and costs of prosecution and in default of payment thereof, shall undergo imprisonment in the Cumberland County Jail for a period of no less than one day binding on the Borough and the property owner.
The Police Department of the Borough of Lemoyne shall have the authority to cause to be towed away any vehicle, the owner of which is in violation of the provisions hereinabove set forth and such owner shall pay the costs of towing and storing of such vehicle.
