Pursuant to the Borough Code of 1927, § 1145, and for the purpose of carrying said section into effect there is hereby created in the Borough of Lemoyne a Department of Planning which shall be in charge of a Borough Planning Commission, which shall be appointed and shall have all the powers and duties conferred upon it by the Borough Code of 1927, §§ 1145 to 1150 inclusive, and any other powers vested by law or proper Borough ordinance.
Editor's Note: Said section was previously reserved. See now the Municipalities Planning Code, 53 P.S. § 10101 et seq.
The Borough Planning Commission shall have access to the maps, files and other papers of the Borough, and if Council by motion, so decides, may keep on file all maps, plans and other pertinent material. Within the limitations prescribed and appropriations provided for the purpose, Council may, on motion, authorize changes and additions to be made to the maps and plans. The Commission may recommend such changes and additions as it may deem proper, but such recommendations shall not restrict the right of Council to initiate proceedings for the laying out and changing of highways and public places in the Borough. The Borough Planning Commission shall also serve as the Zoning Commission. It shall be known as the Lemoyne Borough Planning and Zoning Commission and it shall be considered as one commission and not as two separate commissions.
The Borough Planning and Zoning Commission shall further have all the powers and duties as conferred upon a Zoning Commission by the Pennsylvania Borough Code.
Editor's Note: See 8 Pa.C.S.A. § 101 et seq.
The Borough Planning and Zoning Commission shall consist of five citizens of the Borough of Lemoyne. The Borough Planning and Zoning Commission shall recommend to the Borough Council the boundaries of the various classifications of zoned areas within the Borough, and any changes thereto and any appropriate regulation to be referred therein; said Commission shall hold a public hearing on changes of boundaries of the various classifications and regulations to be referred therein and shall make reports and recommendations to the Borough Council.
