The Mayor of the Borough of Lemoyne or, in his absence or incapacitation,
the acting Mayor, shall, in event of riots, tumults, disorderly meetings
or congregations or insurrections or threat of imminence thereof,
shall at his discretion and in the interest of the public health,
safety and morals, declare a state of emergency.
In the event of the declaration of a state of emergency by the
Mayor or Acting Mayor, he may in his discretion and as appearing it
necessary for the public health, safety and morals of the citizens
or residents of the Borough of Lemoyne, declare a curfew during such
hours as he may deem fit.
If a curfew is declared by the Mayor or Acting Mayor, he shall
declare that no person of any age shall be on the public streets,
parks, highways, alleys, or other public places of the Borough of
Lemoyne between such hours of daylight or darkness as in the judgment
of the Mayor he shall determine.
In the event of declaration of curfew by the Mayor or Acting
Mayor, the parents or guardians or other persons having the legal
care and custody of a child under the age of 16 shall not permit such
child to go or be in public places as aforesaid during the hours of
curfew and permitting such child to go or be in public places shall
be a violation of this chapter, by the parent.
Any person who appears or goes or is on any of the public places
of the Borough as aforesaid described during the hours of a declared
curfew shall be in violation of this chapter.
If the Mayor or Acting Mayor declares a curfew, he may also
declare classes or types of individuals who may be excepted from the
provisions of the curfew such as, but not limited to, persons going
to and from their place of employment or person who must necessarily
be on the streets in the cause of their employment or whose activities
would make it expedient that they be permitted to appear in the various
public places of the Borough.
Policemen of the Borough of Lemoyne and any auxiliary or deputy
policemen that may be called in to assist the Lemoyne Borough Police
Department shall enforce this chapter.

Any person who shall violate any of the provisions of this chapter
shall, upon conviction before a Magisterial District Judge, be sentenced
to a fine not to exceed $300 and costs or to imprisonment for a term
not to exceed 30 days.
