The 2015 International Property Maintenance Code ("code"), as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Township regulating and governing the conditions and maintenance of all property, buildings and structures; providing the standards for supplied utilities and facilities and other physical conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and providing for the condemnation of buildings and structures unfit for human occupancy and/or use and the demolition of such structures. Each and all of the regulations, provisions, penalties, conditions and terms of the code are hereby adopted and made a part hereof, as fully set out in this chapter, with the additions and insertions changes prescribed in §
160-2 of this chapter.
The following sections of the code are hereby amended as follows:
A. Section 101.1, Title. Insert "Township of Nockamixon."
B. Section 103.5, Fees. Insert the following schedule: "Fees assessable
by the Township for the administration and enforcement undertaken
pursuant to this particular code shall be established by the Board
of Supervisors of the Township by resolution from time to time."
C. Section 106.4, Violation Penalties. Delete Section 106.4 in its entirety
and insert in its place the following: "106.4 Violation Penalties.
Any person who shall violate any provision of this code shall, upon
conviction thereof, be sentenced to pay a fine not to exceed $1,000
and costs, or in default of payment thereof, shall be subject to imprisonment
for a term not to exceed 30 days. Each day a violation of this code
continues shall constitute a separate offense. The application of
this penalty shall not be held to prevent the enforced removal of
prohibited conditions."
D. Section 112.4, Failure to Comply. Delete Section 112.4 in its entirety
and insert in its place the following: "Any person who shall continue
any work after having been served with a stop-work order, except such
work as that person is directed to perform to remove a violation or
unsafe condition, shall be liable to a fine of not less than $100
nor more than $1,000.
E. Section 302.4, Weeds. Insert the words "10 inches."
F. Section 304.14, Insert Screens. Insert the dates "June 1 to October
1."
G. Section 602.3, Heat Supply. Insert the dates "October 1 to June 1."
H. Section 602.4, Occupiable Work Spaces. Insert the dates "October
1 to June 1."
All other ordinances or provisions thereof inconsistent herewith
or in conflict with any of the terms hereof are, to the extent of
said inconsistencies or conflicts, hereby specifically repealed.
The provisions of this chapter are severable. If any section,
clause, sentence, part or provision thereof shall be held illegal,
invalid, or unconstitutional by a court of competent jurisdiction,
such decision of the court shall not affect or impair any of the remaining
sections, clauses, sentences, parts or provisions of this chapter.
It is hereby declared to be the intent of the Board of Supervisors
that this chapter would have been adopted if such illegal, invalid,
or unconstitutional section, clause, sentence or part of a provision
had not been included herein.
All provisions of this chapter shall be in full force and effect
five days after the approval and adoption.
