No person shall hold a yard sale (which includes a garage sale, tag sale, rummage sale, and similar events) or estate sale in the Town without first paying a fee and obtaining a permit. No person shall hold more than three yard sales or estate sales in one year in the Town. Merchandise and articles being sold must be placed either in an enclosed building or, if outside, then within the boundary lines of the property of the seller or other place where the yard sale or estate sale is occurring. No merchandise and articles being sold can be placed on the street, sidewalk, or any grass median between the sidewalk and street.
Every person or entity desiring a permit to hold a yard sale or estate sale shall file a written application with the Town and pay the required fee. The application shall provide the following information:
The name of the person or entity who will be conducting or sponsoring the yard sale or estate sale and who is legally responsible for the sale.
The location, date, and hours of the yard sale or estate sale.
A brief description of the merchandise and articles to be sold at the yard sale or estate sale.
The fee for a permit for a yard sale or estate sale shall be $10.
Upon receipt of a yard sale or estate sale application and the permit fee, the Mayor or the Town Manager, or his or her authorized representative, shall review the application as deemed necessary to ensure the protection of the public health, safety, and general welfare. The business license requirements set forth in § 177-5E shall apply to yard sale and estate sale permits. If the application is found satisfactory, then the yard sale or estate sale permit will be approved.
Holding a yard sale or estate sale without a permit shall be a municipal infraction with a $25 fine for the first violation and a fine of $50 for repeat violations in a one-year period.
