[Adopted as Ch. VII, Art. 5, of the 1990 Code of Ordinances]
As used in this article, the following terms shall have the meanings indicated:
GARBAGE
Any putrescible animal and vegetable wastes resulting from the handling, reparation, cooking and consumption of food.
LITTER
Any garbage, rubbish and refuse, as defined herein, and all other waste material which creates or tends to create danger to public health, safety, welfare and property, but such term shall not mean organic compost piles.
RUBBISH and REFUSE
All solid waste consisting of both combustible waste (including but not limited to paper, cardboard, wood, cloth and bedding material) and noncombustible waste (including household appliances, abandoned or wrecked motor vehicles and any building and construction wastes).
A. 
It shall be unlawful for any person, firm or corporation to place, accumulate, or permit the accumulation of any garbage, litter, or rubbish and refuse on any property owned or controlled by said person.
B. 
It shall be unlawful for any person, firm, or corporation to place, accumulate or permit to accumulate on the property owned or controlled by such person any wood, lumber, cans, pipes, or any other material unless the same is intended for use in prompt construction of said property and is stored on a substantial platform with at least 18 inches of clearance between the stored material and the ground.
C. 
Exceptions to the temporary storage of building materials may be granted by the Mayor and Council, after a determination that the special permission is not in violation of the Zoning Ordinance of the Maryland-Washington Regional District of the Maryland-National Capital Park and Planning Commission.
It shall be unlawful for any person or persons or corporation to allow garbage or trash to remain or stay in a wagon or truck or motor vehicle or any other place overnight in the Town of North Brentwood.
It shall be unlawful for any person to deposit any garbage in any receptacle out of doors other than in a metal can and covered with a metal top, in the Town of North Brentwood, Maryland.
It shall be unlawful for any person, firm or corporation to abandon, discard, store or keep in any place accessible to children, or to permit as the owner, lessee, or manager, to remain on the premises under his control, a refrigerator, icebox, freezer or any other similar container of any kind which has an airtight door, or lock which may not be released for opening from the inside of said refrigerator, icebox, freezer cabinet or other container and which is no longer used for refrigeration purposes, without the attached doors hinges, lids or latches being first removed.
Any person violating any of the provisions of this article, or any lawful order issued by the police in pursuance thereof, or committing any of the acts declared to be unlawful by this article, shall be guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine not to exceed $100, or may be confined to the county jail for a period not to exceed 30 days and where the offense is of a continuing nature each day's violation shall be deemed a separate offense.
