The short title of this article shall be the "Township of Nockamixon
Recycling Ordinance," and the same may be cited in that manner.
As used in this article, the following terms shall have the
meanings indicated:
ALUMINUM CANS
Empty all-aluminum beverage and food containers which do
not attract a magnet.
BI-METAL CONTAINERS
Empty food or beverage containers consisting of ferrous portions,
generally the sides and bottom, which attract a magnet and an aluminum
portion, generally the top, which does not attract a magnet.
DROP-OFF CENTER
A location established by the municipality or a private organization
for the receipt and temporary storage of recyclable materials.
GARBAGE (FOOD WASTE)
Animal and vegetable waste resulting from the handling, preparation,
cooking and serving of foods. It does not include wastes from industrial
processing or manufacturing of food products, bodies of dead animals
or animal or human excrement (except that contained in disposable
diapers).
GLASS CONTAINERS
Bottles and jars made of clear, green or brown glass. Expressly
excluded are noncontainer glass, plate glass, blue glass and porcelain
and ceramic products.
MAGAZINES AND PERIODICALS
Printed matter containing miscellaneous written pieces published
at fixed or varying intervals. Expressly excluded, however, are all
other paper products of any nature whatsoever.
NEWSPAPERS
Paper of the type commonly referred to as "newsprint" and
distributed at fixed intervals having printed thereon news and opinions,
containing advertisements and other matters of public interest. Expressly
excluded, however, are newspapers which have been soiled.
PERSON(S)
Owners, lessees and occupants of residences.
PLASTIC CONTAINERS
Empty plastic food and beverage containers. Due to the large
variety of types of plastic, the recycling regulations may stipulate
specific types of plastic which may be recycled.
RECYCLABLE MATERIALS
Those materials in solid waste specified by the municipality
to be recycled. This list of materials is specified in the recycling
regulations resulting from this article and may be revised from time
to time as deemed necessary by the municipality.
RECYCLING CENTER
A facility established to receive, process, store, handle
and ship recyclable materials.
RESIDENCE
An occupied single-family or multifamily dwelling having
up to four dwelling units per structure or each unit in a multifamily
structure if the dwelling units are individually owned with separate
entrances.
RUBBISH
Solid waste exclusive of garbage (e.g., nonrecyclable glass,
metal, paper or plastic and noncompostable plant material, wood or
nonputrescible solid waste).
SOLID WASTE
All refuse (garbage and rubbish) and other discarded solid
material normally collected by a private hauler.
TRASH
Ordinary residential household or commercial solid waste.
YARD WASTE
Prunings, twigs, branches, grass clippings, weeds, leaves
and other lawn and garden wastes.
There is hereby established a program for the voluntary separation
and collection of recyclable materials from all residences within
the Township of Nockamixon.
The Supervisors of Nockamixon Township are hereby authorized
and empowered to establish and promulgate regulations on the manner
of separation, bundling, handling, storage, location and placement
of certain recyclable materials; the manner, days and time of collections
of the recyclable materials; and the manner, routes and ultimate destination
for transport of the recyclable materials throughout the municipality.
All persons who are residents of Nockamixon Township may separate
all solid wastes to be recycled from other solid wastes produced at
their residence, in accordance with regulations hereinafter to be
established.
Recyclable materials may be placed at the curb separate from
solid waste for collection at such times and dates as may be hereinafter
established by regulation. Alternatively, recyclable materials may
be taken to a drop-off or other recycling center or site authorized
by the municipality for the receipt and temporary storage of recyclable
materials.
It shall be a violation of this article for any person(s) unauthorized
by the municipality to collect or pick up or cause to be collected
or picked up any such recyclable material. Each such collection in
violation hereof shall constitute a separate and distinct offense
punishable as hereinafter provided.
All recyclable materials separated by the residents and placed for collection pursuant to this article and regulations issued hereunder shall become the property of Nockamixon Township, if the Township institutes a municipal collection program for recyclables, or the private collector for a private collection program, except as otherwise provided by §
180-31 of this article.
The municipality is authorized and directed to enforce this
article. The same is hereby authorized and directed to establish and
promulgate reasonable regulations as to the manner, days and times
for the collection of recyclable materials in accordance with the
terms hereof and any other matters required to implement this article.
The municipality may change, modify, repeal or amend any portion of
said rules and regulations at any time.

Any person who violates or permits a violation of this article
shall, upon conviction in a summary proceeding brought before a District
Justice under the Pennsylvania Rules of Criminal Procedure, be guilty
of a summary offense and shall be punishable by a fine of not more
than $1,000, plus costs of prosecution. In default of payment thereof,
the defendant may be sentenced to imprisonment for a term not exceeding
30 days. Each day or portion thereof that such violation continues
or is permitted to continue shall constitute a separate offense, and
each section of this article that is violated shall also constitute
a separate offense.
The municipality may enter into agreements with public or private
agencies or firms to authorize them to collect all or part of the
recyclable materials from curbside and any drop-off or recycling centers
established or authorized by the municipality.
Any person may donate or sell recyclable materials to individuals
or organizations authorized by the municipality in its recycling regulations.
These materials must either be delivered to the individual's
or organization's site or drop-off center or they may be placed
at the curb for collection by said individual or organization on days
not indicated as recyclable material collection days by the municipality.
Said individuals or organizations may not collect recyclable materials
on or immediately preceding (within 24 hours) a regularly scheduled
curbside collection day.
