As used in this chapter, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGES
All beverages requiring licenses for sale, including, by way of example, beverages such as beer, wine, ale, liquors and liqueurs, in their original containers, and all mixtures of such beverages in other containers, such as in mixed drinks or highballs containing at least 5% alcohol content by volume.
OPEN CONTAINER
Includes all containers which, in the original form sold, contain less than one liter. It shall also include any larger container without a tightly affixed cap or cork capable of preventing leakage. It shall also include all glasses, cups or other types of containers made without cap or top or with a cap or top through which a straw may be inserted.
POSSESSION
Having the alcoholic beverage in hand, within arm's length or within the same vehicle.
It shall be unlawful for any person to possess in an open container any alcoholic beverage on a public street, highway, alley, sidewalk, dock, park or public parking lot within the City of Pocomoke City, Maryland, except where special permission may be granted by the Mayor and City Council.

Any violation of this chapter shall constitute a municipal infraction, and any person who violates this section shall, upon conviction thereof, be subject to a fine as set forth in the Fees, Charges and Rates Schedule, adopted by resolution of the City Council from time to time.[1]
