The following words, when used in this chapter, shall have the
meanings ascribed to them in this section, except in those instances
where the context clearly indicates otherwise:
ACT 90
The Pennsylvania Waste Transportation Safety Act of 2002,
as amended.
ACT 97
The Pennsylvania Solid Waste Management Act of 1980, as amended.
ACT 101
The Pennsylvania Municipal Waste Planning, Recycling and
Waste Reduction Act of 1988, as amended.
ASHES
The residue from the burning of wood, paper, coal, coke or
other combustible material.
AUTHORIZED COLLECTOR, NONRESIDENTIAL
A person licensed and authorized by the Pennsylvania Department
of Environmental Protection to collect and dispose of trash, recyclables,
bagged leaves, waste and bulk items from nonresidential properties
under the terms and conditions of this chapter.
AUTHORIZED COLLECTOR, RESIDENTIAL
A person licensed and authorized by the Pennsylvania Department
of Environmental Protection to collect and dispose of trash, recyclables,
bagged leaves, waste and bulk items from residential properties under
the terms and conditions of this chapter.

BULK ITEMS
Normal household items of extraordinary size, such as appliances,
furniture, bedding and rugs, as well as branches up to six inches
in diameter; does not include large machinery or vehicles, automotive
parts and equipment, such as batteries, hoods, truck caps or tires,
steel, tree stumps, building or demolition material, fences, stones,
earth, cement, bricks or branches in excess of six inches in diameter.
COLLECTOR (or WASTE HAULER)
Any person, firm, partnership, corporation or public agency
who is engaged in the collection and/or transportation of municipal
waste and/or source-separated recyclable materials.
COMMERCIAL ESTABLISHMENT
Any establishment engaged in a nonmanufacturing or nonprocessing
business, including, but not limited to, stores, markets, offices,
restaurants, shopping centers and theaters.
COUNTY
The County of Bucks, Pennsylvania.
DEPARTMENT
The Pennsylvania Department of Environmental Protection.
DISPOSAL
The deposition, injection, dumping, spilling, leaking or
placing of solid waste into or on the land or water in a manner that
the solid waste or a constituent of the solid waste enters the environment,
is emitted into the air or is discharged to the waters of this commonwealth.
Disposal facilities include, but are not limited to, municipal waste
landfills and construction/demolition waste landfills as defined by
Act 101, Act 97, and/or Department rules and regulations (25 Pa. Code
Chapter 271, Municipal Waste Management - General Provisions, and
25 Pa. Code Chapter 277, Construction/Demolition of Waste Landfills).

DUMPSTER
An oversized container for the collection of municipal waste,
trash, rubbish, refuse, garbage and other disposables, including construction
waste, which cannot be lifted, emptied or transported except by truck.
Different regulations may apply, as set forth in this chapter, to
dumpsters used in connection with temporary construction projects
and dumpsters used in connection with the collection of everyday municipal
waste.
GARBAGE
All animal and vegetable waste solids resulting from the
handling, preparation, cooking and consumption of foods.
GLASS
Bottles and jars made of clear, green or brown glass; does
not include noncontainer glass, plate glass, blue glass and porcelain
or ceramic products.
HAZARDOUS WASTE
Solid or liquid waste which is especially harmful or potentially
harmful to public health, including but not limited to explosives,
toxic materials and medical waste.
INDUSTRIAL ESTABLISHMENT
Any establishment engaged in manufacturing or production
activities, including, but not limited to, factories, foundries, mills,
processing plants, refineries, mines and slaughterhouses.
INFECTIOUS WASTE
Municipal waste which is or may be contaminated by disease-producing
microorganisms or material or which may harm or threaten human health.
INSTITUTIONAL ESTABLISHMENT
Any establishment or facility engaged in services, including,
but not limited to, hospitals, nursing homes, schools and universities.
LEAF WASTE
All leaves, garden residues, shrubbery and tree trimmings,
and similar materials, but not including grass clippings.
METAL CANS
Beverage and food containers consisting of aluminum, steel
or tin or a combination of said materials.
MUNICIPAL WASTE
Any garbage, refuse, industrial lunchroom or office waste
and other material, including solid, liquid, semisolid or contained
gaseous material, resulting from operation of residential, municipal,
commercial or institutional establishments and from community activities,
and any sludge not meeting the definition of residual or hazardous
waste under Act 97 from a municipal, commercial or institutional water
supply treatment plant, wastewater treatment plant, or air pollution
control facility. The term does not include any source-separated recyclable
materials.
MUNICIPALITY
Any of the 54 minor civil divisions in Bucks County, Pennsylvania.
NEWSPRINT
Publications made of newsprint and sold or distributed at
stated intervals, customarily containing and having as their primary
purpose newsworthy items, advertisements or other matters of public
interest; also includes magazines, periodicals and cardboard.
NONRESIDENTIAL PROPERTY
Properties used for industrial or commercial purposes in
which no persons reside; also includes multifamily residential buildings
and apartment houses containing more than four dwelling units.
PERSON
Any individual, partnership, corporation, association, institution,
cooperative enterprise, municipality, municipal authority, federal
government or agency, state institution or agency, or any other legal
entity recognized by law as the subject of rights and duties. In any
provisions of this chapter prescribing a fine, imprisonment or penalty,
or any combination of the foregoing, the term "person" shall include
the officers and directors of any corporation or other legal entity
having officers and directors.
PLASTICS
Soda, milk, juice, water or other liquid containers, including
plastics Nos. 1 and 2, with a recycling symbol ("PETE" or "HDPE")
on the underside, including all lids, tops, neck rings and labels.
PROCESSING
Any technology used for the purpose of reducing the volume
or bulk of municipal or residual waste or any technology used to convert
part or all of such materials for off-site reuse. Processing facilities
include, but are not limited to, transfer facilities, recycling facilities,
composting facilities, and resource recovery facilities.
RECYCLING
The collection, separation, recovery and sale or reuse of
metals, glass, paper, leaf waste, plastics and other materials which
would otherwise be disposed of or processed as municipal waste, or
the mechanized separation and treatment of municipal waste (other
than through combustion) and creation and recovery of reusable materials
other than as a fuel for the generation of energy.

RESIDENTIAL PROPERTY
Properties used for dwelling purposes, including single-family
residences as well as multifamily buildings and apartment houses containing
up to four dwelling units, in which case each unit shall be considered
a separate residential property for the purposes of this chapter.
REVISED COUNTY PLAN
The Bucks County Municipal Waste Management Plan Revision
of 2004, as approved by the Department on January 17, 2006.
RUBBISH
Nonrecyclable glass, metal, paper and plastic, as well as
wood and other nonputrescible solid waste.
SCAVENGING
The unauthorized and uncontrolled removal of any material
stored or placed at a point for subsequent collection or from a processing
or disposal facility.
SOURCE-SEPARATED RECYCLABLE MATERIALS
Any materials, including leaf waste, that are separated from
municipal waste at the point of origin or generation for the purpose
of recycling. The phrase includes, but is not limited to, all recyclables.
TRANSPORTATION
The off-site removal of any municipal waste at any time after
generation.
TRASH
All solid waste materials, including but not limited to ashes,
garbage, rubbish and grass clippings.
YARD WASTE
Garden residue; shrubbery and tree trimmings.
