A. 
Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this article for any person to park a vehicle or allow it to remain parked otherwise.
B. 
Parking for certain purposes prohibited. No person shall park a vehicle upon any street for the principal purpose of:

(1) 
Displaying such vehicle for sale.
(2) 
Greasing or repairing such vehicle except repairs necessitated by an emergency.
C. 
Parking prohibited in specific areas. No person shall park a vehicle or truck tractor, or permit it to stand, whether attended or unattended, upon a limited-access highway or in any of the following places:

(1) 
Within an intersection.
(2) 
On a crosswalk.
(3) 
Between a safety zone and the adjacent curb, or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless local officials shall indicate a different length signs or markings.
(4) 
Within 25 feet from the intersection of curblines, or, if none, then within 15 feet of the intersection of property lines at an intersection of streets.
(5) 
Within 30 feet upon the approach to any official flashing signal, stop sign or traffic signal located at the side of the street.
(6) 
Within 15 feet of the driveway entrance to any fire station.
(7) 
Within 15 feet of a fire hydrant.
(8) 
On a sidewalk.
(9) 
In front of private driveway, or alongside any street excavation or obstruction, not opposite the same, unless a clear and unobstructed width of not less than 20 feet upon the main traveled portion of the street shall be left free for passage of other vehicles thereon.
(10) 
On the street travel lane side of any vehicle stopped or parked at the curb or edge of the street.
(11) 
At any place specifically reserved for handicapped parking by signs or ground marking, unless the parked vehicle has lawfully displayed upon it registration or placarding for a handicapped person or severely disabled veteran, and is being used in the immediate service of a handicapped person or severely disabled veteran.
(12) 
Within 50 feet of the nearest rail or railway crossing.
(13) 
Except when necessary in obedience to traffic regulations or traffic signs or signals or where angle parking is permitted, the operator of a vehicle shall not stop, stand or park such vehicle on the street within a business and commercial zoning district or residential zoning district other than parallel with the edge of the street, headed in the direction of traffic, and with the curb side of the vehicle within six inches of the edge of the street or curb. Vehicles which, because of the type of construction cannot load or unload parallel to the curb, shall be exempt, while loading or unloading only, from the requirements of standing parallel to the curb.
(14) 
No person shall park a vehicle at any time in front of, opposite to, or in such a position as to block entrance to or exit by a vehicle from a garage.
(15) 
At any place where official signs have been erected prohibiting standing or parking.
D. 
Parking trucks and trailers. No trailer shall be parked upon any street without having attached thereto a means of mechanical traction so constructed or designed for the purpose of pulling or drawing such trailer.
E. 
Storage of vehicles on street. No vehicle shall be stored upon any street. As used herein, "stored" shall mean the parking of a vehicle in one place upon any street continuously for over 96 hours.
F. 
Parking with motor running unattended (75 Pa.C.S.A. § 3701).
G. 
Penalties.

(1) 
Any police officer shall be authorized to issue a citation to whoever violates § 336-32B, C, D, E and/or F above.
(2) 
Any person violating any of the provisions of § 336-32C, D and/or F shall, upon conviction thereof before a Magisterial District Judge, be sentenced to pay a fine of $50 for each offense, and costs of prosecution, including attorneys' fees, and in default of payment of any such fine shall be subject to imprisonment in accordance with the Pennsylvania Rules of Criminal Procedure.
(3) 
Any person violating any of the provisions of § 336-32B and/or E shall, upon conviction thereof before a Magisterial District Judge, be sentenced to pay a fine as follows, together with all costs of prosecution, including attorneys' fees, and in default of payment of any such fine shall be subject to imprisonment in accordance with the Pennsylvania Rules of Criminal Procedure.
(a) 
First offense: a fine of $150.
(b) 
Second offense: a fine of $300.
(c) 
Third offense: a fine of $600.
(d) 
Fourth and each subsequent offense: a fine of $1,000.
(4) 
Each day during which a violation of this article occurs shall be deemed a separate violation.
(5) 
The Township, by means of other appropriate legal proceeding, including a complaint in equity, may compel any person to comply with this article or any regulations and specifications adopted hereunder, or seek any such other relief as any court of competent jurisdiction is empowered to afford.
(6) 
In addition to the penalties provided in this § 336-32G, the Township may remove any vehicle that is in violation of the parking regulations established pursuant to this article based on the authority outlined in Section 3352 of the Vehicle Code,[1] with all costs of such removal to be paid by the vehicle's owner.

A. 
Stopping, standing, and parking on streets in residential zoning districts. It shall be unlawful for any person to stop, stand, or park an oversized vehicle on any street in a residential zoning district; provided, nevertheless, that this section shall not prohibit the stopping, standing, or parking of:
(1) 
Emergency or authorized vehicles as defined in 75 Pa.C.S.A., Vehicles, Part I, Preliminary Provisions, Chapter 1, General Provisions, § 102, Definitions;
(2) 
Vehicles momentarily stopped, standing or parking for the purpose of, and while actually engaged in, loading or unloading property or passengers;
(3) 
Vehicles of service companies, contractors, repairmen, delivery trucks or others actually engaged in working operations between the hours of 7:00 a.m. and 7:00 p.m. where the vehicle is stopped, standing, or parked adjacent to the property at which the operations are being conducted.
(4) 
Any licensed oversized vehicle during a governmentally declared state of emergency on a street that is not designated as a "snow emergency route."
B. 
Stopping, standing, and parking on streets in business and commercial zoning districts. It shall be unlawful for any person to stop, stand, or park an oversized vehicle on any street in a business and commercial zoning district for a continuous period of time longer than two hours; provided, nevertheless, that this section shall not prohibit the stopping, standing, or parking of the following vehicles in excess of such two-hour period:
(1) 
Emergency or authorized vehicles as defined in 75 Pa.C.S.A., Vehicles, Part I, Preliminary Provisions, Chapter 1, General Provisions, § 102, Definitions;
(2) 
Vehicles engaged for the purpose of, and while actually engaged in, loading or unloading property or passengers;
(3) 
Vehicles of service companies, contractors, repairmen, delivery trucks or others actually engaged in working operations between the hours of 7:00 a.m. and 7:00 p.m. where the vehicle is stopped, standing, or parked adjacent to the property at which the operations are being conducted.
(4) 
Any licensed oversized vehicle during a governmentally declared state of emergency on a street that is not designated as a "snow emergency route."
C. 
Stopping, standing, and parking on streets in industrial zoning districts. It shall be unlawful for any person to stop, stand, or park an oversized vehicle on any street in an industrial zoning district, except during a governmentally declared state of emergency on a street that is not designated as a "snow emergency route" or as provided otherwise in this § 336-35.
D. 
Stopping, standing and parking of motor vehicles opposite each other. It shall be unlawful for any person to stop, stand, or park a motor vehicle in any way such that if such vehicles are parked along one or both curb faces or edges of the street, two motor vehicles cannot move abreast of one another in the same or the opposite direction without one yielding to allow the other vehicle to pass.
E. 
Notice of stopping, standing, and parking restrictions. Where stopping, standing, or parking is restricted by the above § 336-35A through C, and no official traffic-control device is erected to indicate the restriction, notice of the restriction and the violation thereof shall be given to the owner or operator of the vehicle stopped, standing, or parked in violation of the restriction prior to the issuance of a citation in one or more of the following manners: certified letter, personal service, or by placing a notice on the windshield or other readily visible location on the vehicle. In the absence of the existence of an official traffic-control device, the above § 336-35A through C shall not be enforced by citation unless a notice of the restriction and the violation thereof has been issued to the owner or operator of the vehicle by any of the means set forth herein prior to the date and time enforcement by citation is initiated.
F. 
Temporary parking regulations for oversized vehicles. Notwithstanding the general prohibition provided by this § 336-35, oversized vehicles may stop, stand or park on streets for periods between 48 hours and 30 days, provided that the operator of such oversized vehicle first obtains a temporary oversized vehicle parking permit pursuant to this subsection. To be eligible for a temporary oversized vehicle parking permit, the oversized vehicle must be engaged in active commerce on either i) the property adjacent to the street upon which it is proposed to stop, stand or park or ii) within the street right-of-way upon which it is proposed to stop, stand or park. The application shall be accompanied by a permit fee, set pursuant to a resolution of the Board of Commissioners of South Whitehall. Each application shall contain the name and address of the owner of the oversized vehicle and the make, model and registration number of the oversized vehicle.
(1) 
When an oversized vehicle must stop, stand or park in a street while work is performed on an adjacent property, an application for a temporary oversized vehicle parking permit must be submitted to the Community Development Department along with the application for the work to be performed on an adjacent property.
(2) 
When an oversized vehicle must stop, stand or park in a street while work is performed within the street pursuant to Chapter 304, Article III, of the Code of the Township of South Whitehall, an application for a temporary oversized vehicle parking permit must be submitted to the Public Works Department along with the application for the work to be performed within the street.
(3) 
While an oversized vehicle is stopped, standing or parked within a street pursuant to a validly issued temporary oversized vehicle parking permit, the permit shall be displayed so as to be clearly visible through the windshield of the oversized vehicle. No person or entity other than the permit holder whose name appears on the permit shall use a temporary oversized vehicle parking permit or display it on an oversized vehicle. Any such use or display by a person or entity other than the permit holder shall constitute a violation of this section by the permit holder and by the person or entity who so used or displayed the temporary oversized vehicle parking permit.
(4) 
The permit holder shall promptly repair any damage to the street and other improvements within the right-of-way which are caused by, relate to, result from or arise out of the stopping, standing or parking of an oversized vehicle at the permit holder's sole cost and expense. Such repairs shall be in accordance with applicable Township specifications. The Township reserves the right to require that the applicant for a temporary oversized vehicle parking permit provide security, such as a cash escrow fund or an irrevocable letter of credit, for the benefit of the Township, to guarantee the applicant's compliance with the obligations provided for hereunder.
(5) 
A temporary oversized vehicle parking permit shall not authorize its holder to stop, stand or park an oversized vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than the general prohibition provided by this § 336-35.
(6) 
It shall constitute a violation of this subsection for any person to make false statements regarding the nature of work within an application in order to obtain a temporary oversized vehicle parking permit.
G. 
Exemption for Township oversized vehicles. All oversized vehicles owned or operated by the Township or any contractor of the Township shall be exempt from the prohibition provided by this § 336-35.

It shall be unlawful for any person to stop, stand or park a vehicle (other than a pedalcycle) on the roadway side of any vehicle stopped or parked at the edge or curb of any street, except that standing or parking for the purpose of loading or unloading persons or property shall be permitted on the following named streets on Monday through Saturday, between the hours of 9:00 a.m. and 11:30 a.m. and between the hours of 1:30 p.m. and 4:00 p.m., and for no longer than necessary for the loading or unloading.

A. 
Findings and purpose. The Township of South Whitehall finds that:
(1) 
Certain residential areas in the Township of South Whitehall are subjected to commuter vehicle parking, therefore, depriving the residents of those areas of spaces in which to park their own vehicles;
(2) 
Those residential streets are also subjected to a high degree of commuter traffic which substantially reduces the quality of the ambient air level; and,
(3) 
The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference during certain hours of the day and days of the week. Therefore, the Township of South Whitehall considers it to be in the interest of the people of the Township of South Whitehall to provide for the establishment of a residential permit parking program to insure primary access to available parking spaces by neighborhood residents and also to provide a cleaner ambient air level.
B. 
Definitions. For the purpose of this section, words and terms listed in this subsection, as follows, shall have the following meanings:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident of that residential area;
PROPRIETOR
A person who owns or leases real estate within a residential area of which he is not a resident, but who owns or manages a business enterprise or professional office maintained at that address; for the purpose of this section, a proprietor shall be entitled to one parking permit for that business or professional office address;
RESIDENT
A person who owns or leases real property within a residential area and who maintains either a voting residence, or bona fide occupancy, or both, at that address;
RESIDENTIAL AREA
A contiguous area containing public highways or parts of public highways primarily abutted by residential property or residential and non-business property (such as schools, parks, places of worship, hospitals and nursing homes).
C. 
Criteria. The residential areas designated in Subsection D of this section are those deemed impacted and hence eligible for residential parking on the basis of the following criteria:
(1) 
During any period between the hours of 7:00 a.m. and 6:30 p.m., Monday through Saturday, except legal holidays, the number of vehicles parked (or standing), legally or illegally, on the streets in the area is equal to 70% or more of the legal, on-street parking capacity of the area. For the purpose of this criterion, a legal parking space shall be 20 linear feet.
(2) 
During the same period as specified in Subsection C(1), directly above, 10% or more of the vehicles parked (or standing) on the streets in the area are not registered in the name of a person residing in the area. For the purpose of this criterion, the latest available information from the Bureau of Motor Vehicles and Licensing of the Pennsylvania Department of Transportation regarding registration of motor vehicles shall be used.
Provided: in determining that a specific area identified as impacted and eligible for residential permit parking is designated as a residential permit parking area, the following factors are taken into consideration:
(a) 
The local and metropolitan needs with respect to clean air and environment;
(b) 
The possibility of a reduction in total vehicle miles driven in the Township of South Whitehall;
(c) 
The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards;
(d) 
The proximity of public transportation to the residential area;
(e) 
The desire and need of the residents for residential permit parking and their willingness to bear the administrative costs in connection with it; and,
(f) 
The need for parking in excess of the residential permit parking program in proximity to establishments located in the residential permit parking area and used by the general public for religious, health or educational purposes.
D. 
Designation of residential permit parking areas. The following are designated as residential permit parking areas:

Signs shall be erected along the streets in each residential permit parking area, indicating the days, hours, locations and conditions under which parking shall be by permit only.
E. 
Application for permit. Application for a residential parking permit shall be made to the Chief of Police by the person desiring the permit, who shall be only the owner or the driver of a motor vehicle who resides on or is a proprietor of property immediately adjacent to a street or other location within a residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, set pursuant to a resolution of the Township of South Whitehall, which shall be for the use of the Township of South Whitehall, to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident or the proprietor, as the case may be; the make, model and registration number of the motor vehicle; and the driver number as taken from the applicant's current driver's license. At the discretion of the Chief of Police, the applicant shall be required, at the time of making application, to present his driver's license and the vehicle registration card.
F. 
Issuance of permit. Upon receipt of the application and the permit fee, and determination by him that the information upon the application shows that the applicant is entitled to a residential parking permit, the Chief of Police shall issue to the applicant a residential parking permit, which shall be valid for the remainder of the calendar year. The permit shall display the serial and registration numbers of the motor vehicles, the residential parking area number, and the expiration date. The permit shall be renewable annually before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any person to display other than the current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
G. 
Temporary and exemption parking permits. Temporary parking permits may be issued by the Chief of Police, upon payment of a fee established pursuant to a resolution, to bona fide visitors of residents of a designated residential permit parking area, and exemption parking permits may be issued, without payment of a fee, to handicapped persons.
H. 
Responsibility of permit holder.
(1) 
Notwithstanding any provision of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him in any designated residential parking area during those times when parking of motor vehicles is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
(2) 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than residential permit parking regulation or restriction.
(3) 
No person other than the permit holder whose name appears on the permit shall use a residential parking permit or display it on a vehicle operated; any such use or display by a person other than the permit holder shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
(4) 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in an application to the Chief of Police in order to obtain a residential parking permit.
(a) 
Revocation of permits. The Chief of Police shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this section. Upon written notification to him of the revocation, the permit holder shall surrender the permit to the Chief of Police. Failure to do so, when so requested, shall constitute a violation of this section. Provided: any person receiving such a notice may, within 10 days after the date of the notice, appeal to the Township of South Whitehall for a hearing on the revocation, and the decision of the Township of South Whitehall shall be final.

A. 
Regulations. It shall be unlawful to:
(1) 
Place any nonmotorized vehicle or other item on a public street or right-of-way for a period of more than 96 hours. As used in this section, a nonmotorized vehicle shall include (a) any trailer or other vehicular storage attachment which is unattached to an operable, licensed and registered motor vehicle which is capable of towing it while located within a public right-of-way; and (b) any unlicensed uninspected trailer, if the trailer in question is of a weight or dimension which requires licensing and inspection in the Commonwealth of Pennsylvania. As used in this section, there shall be a rebuttable presumption that a nonmotorized vehicle or other item has been "continuously parked or stored" or stored, parked or placed at a location for more than 96 consecutive hours if such vehicle or item is found to be in approximately the same physical location more than 96 hours after either is was first viewed by a police officer in that location, or more than 96 hours after notice has been placed thereon requesting that the vehicle or item be removed from the public street.
(2) 
Park or place upon any public street or right-of-way any mechanically inoperative vehicle for a period of more than 96 consecutive hours.
(3) 
Park or place any motor vehicle upon any public street or right-of-way which does not bear a current registration plate and a current inspection sticker affixed to it (if such inspection sticker is required by law for the motor vehicle in question).
(4) 
Abandon any vehicle within a public right-of-way. "Abandon" as used in this section shall have the meaning ascribed to it in the Pennsylvania Vehicle Code.
(5) 
Place any vehicle or other item in the public right-of-way which in any manner interferes with traffic or poses a hazard to persons or property.
B. 
Removal and impoundment. South Whitehall Township shall have the right, but not the duty, to remove and impound any vehicle or item whose location violates any of the regulations set forth in Subsection A above. If the owner of such vehicle or item is not readily discernible, the Township may dispose of same, at its sole discretion. To the extent applicable, disposal shall be in accordance with Chapter 73 of the Pennsylvania Motor Vehicle Code (75 Pa.C.S.A. § 7301 et seq.).
C. 
Penalties. Any person who violates any of the prohibitions of Subsection A of this section, or who owns or possesses any vehicle or item found to be in violation of Subsection A of this section shall, upon conviction thereof, pay a fine of $15 for each day that the vehicle or item remains in violation, together with costs of suit, and all costs associated with removing and impounding such vehicle or item, if the fine is paid within 72 hours of the date that the vehicle or item, or the owner of same, has been ticketed. If not paid within 72 hours, the fine shall be $30 for each day following the date the vehicle or item, or owner of same, has been ticketed, together with the costs of suit, and all costs associated with removing and impounding such vehicle or item. If all fines are not paid within 10 days of the date that a vehicle or item, or owner of same has been ticketed, the owner or other person in possession of the vehicle or item shall receive a citation, and upon conviction, shall be guilty of a summary offense, with fines imposed in accordance with the penalties set forth in 75 Pa.C.S.A. § 7312, together with the costs of the suit, and all costs associated with removing and impounding such vehicle or item.

Unless another penalty is expressly provided by the Pennsylvania Vehicle Code[1] or any section of this article, any person violating any of the provisions of this article shall, upon conviction thereof before a Magisterial District Judge, be sentenced to pay a fine of $50 for each offense, and costs of prosecution, including attorneys' fees, and in default of payment of any such fine shall be subject to imprisonment in accordance with the Pennsylvania Rules of Criminal Procedure.
