[HISTORY: Adopted by the Board of Trustees of the Village of Wild Rose. Amendments noted where applicable.]
The statutory provisions as set forth in Chapter 157 of the Wisconsin Statutes, describing and defining regulations with respect to the operation of public cemeteries, are hereby adopted by reference and made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this chapter.
A. 
Ownership. The Village of Wild Rose owns Oak Hill Cemetery. Its legal description is as follows:
Commencing at the Northwest corner of the Northwest Quarter 1/4 of the Northeast Quarter 1/4 of § 25, Township 20 North, Range 10 East, and running South along the West side of said described 40, rods; thence East, 24 rods; thence North, 40 rods to the North line of said 40; thence West along the North line of said 40 to the place of beginning. Being a part of the Northwest Quarter 1/4 of the Northeast Quarter 1/4 of Section 25, Township 20 North, Range 10 East. Said to contain six acres.
B. 
Operation. The Village of Wild Rose shall operate Oak Hill Cemetery as a public burial ground, the operation thereof being subject to rules and regulations set forth herein.
C. 
Mill Pond, Parks, and Cemetery Committee. There shall be appointed by the Village President, subject to the approval of the Village Board, a Mill Pond, Parks, and Cemetery Committee consisting of three members. It shall be the duty of the Mill Pond, Parks, and Cemetery Committee to supervise the care and maintenance of the Oak Hill Cemetery and to enforce all regulations relating to the operation of said cemetery.
D. 
Care of records. The Clerk-Treasurer shall keep all records and reports relating to Oak Hill Cemetery.
(1) 
The Clerk-Treasurer shall keep an accurate record of all receipts and disbursements, and shall serve as agent for the Village with authorization to sell burial lots to all persons at prices established by the Village Board, and to collect assessments for perpetual care of burial plots. He/she shall keep an accurate plat of all burial grounds showing thereon all lots available for sale.
(2) 
The Clerk-Treasurer will ensure that all reports required in Chapter 157, Wis. Stats., are prepared and submitted in a timely manner.
A. 
The sale of plots in municipal cemeteries shall be under the control of the Clerk-Treasurer subject to the rules and regulations and the general supervision of the Village Board. All individuals desirous of purchasing a burial plot from the Village shall apply to the Clerk-Treasurer and select from those plots that are available for sale. Upon final lot selection, and payment of the full purchase price of the plot(s), the Clerk-Treasurer shall issue a deed to the lot. The deed shall be signed by the Village President and Clerk-Treasurer, and sealed with the corporate seal and acknowledged so as to entitle it to be recorded. The purchaser may record this deed with the Waushara County Register of Deeds Office.

B. 
All plots sold in the cemetery may be transferred to a third party, and an owner may transfer such plot(s) (by devolution to heirs) with or without consideration.
C. 
Any income from the sale of cemetery plots shall be placed in an interest bearing Oak Hill Cemetery escrow account.
The Mill Pond, Parks and Cemetery Committee shall provide for the perpetual care of all burial lots and shall employ a caretaker to mow grass, collect all trash or rubbish, and to perform such other duties as the Mill Pond, Parks, and Cemetery Committee shall deem necessary for the general appearance, upkeep, and operation of the cemetery. Said caretaker shall be paid a salary to be determined by the Village Board.
A. 
To finance the cost of perpetual care of burial plots, the Village Board will establish a rate based on the size of all lots sold.
B. 
No plot shall be sold in the Oak Hill Cemetery after the effective date of this chapter, without the assessment for perpetual care in Subsection A above.
C. 
Definition of care. "Care," either perpetual or annual, shall include the cutting of grass upon the lot at reasonable intervals, the raking and cleaning of the lot, the pruning or trimming of trees or shrubs and such work as may be necessary to keep the graves in neat condition, and for the care and maintenance of the cemetery, but shall not include maintenance or repair of any monuments nor the planting of flowers or shrubs upon any lot.
D. 
All assessments paid for perpetual care shall be invested pursuant to the provisions of the Wisconsin Statutes and any amendments thereto.
A. 
The cemetery is open for regular burials from April 1 through November 15. Families wishing a burial during this time period must submit an application to the Clerk-Treasurer or the Mill Pond, Parks, and Cemetery Committee Chairperson to receive authorization. The grave accessibility costs for all labor involved will be at the hourly rate determined by the Village Board. In addition, the applicant shall make a deposit with the Village in such amount as is reasonably required by the Village to meet snowplowing costs, damage to any other monuments, and lawn restoration. Any deposit over and above the reasonable costs shall be returned to the applicant in a timely manner.
B. 
Required reporting of a death. Upon request of burial of either a human corpse or cremains, a report for Final Disposition of Human Corpse (Division of Public Health, Form DPH-5045) from a Wisconsin-licensed funeral director or person acting as such, which shall include information detailed in § 157.62(5), Wis. Stats., will be required before interment of remains. All requests include information and will follow statutes referenced in Chapter 69, Subsection I, of the Wis. Stats.
All grave markers placed in the Oak Hill Cemetery shall be placed on a concrete base, the surface of which shall be level with the ground. Such base shall be at least eight inches wider on all sides than the stone or marker placed thereon. No person shall plant any trees or shrubs on cemetery property. No retaining walls may be built on cemetery property.
No person shall destroy, mutilate or remove any monument, gravestone, building or other structure placed in the Oak Hill Cemetery, or destroy or injure any tree or shrub, or take any plant, flower or other decoration from any cemetery lot other than his/her own. Persons convicted of such destruction or theft, as defined in this section, are subject to forfeitures established in § 1-1-8 of the Code of Ordinances.
A. 
There shall be permitted burials of containers containing the cremated ashes of a deceased person in the Oak Hill Cemetery as follows:
(1) 
No more than two persons' ashes may be buried in each grave site;
(2) 
All containers shall be buried at the head of the grave site, and
(3) 
There shall be a marker placed at the head of the grave.
B. 
The cost of opening a grave site for burial of a container containing the ashes of a deceased person shall be 1/4 of the regular cost of opening a grave for burial as set in § 4-5-5.
The use of an outside burial container is required for burials. All outside burial containers (sometimes called "vaults") shall be constructed of concrete or steel or such other composition as may be subsequently approved by the Mill Pond, Parks and Cemetery Committee. Wooden boxes/liners are not permitted.
