The Village of Bath shall permit the sale of the following seasonal items by residents of the Village of Bath at their respective residential locations subject to the following:
A. 
Items classified as seasonal are limited to the following:
(1) 
Campfire wood sold in small bundles (for the dates of May 1 through October 31);
(2) 
Fruits, vegetables, and produce (for the dates of May 1 through October 31);
(3) 
Baked goods and nonalcoholic beverages (for the dates of May 1 through October 31); and
(4) 
Christmas trees and wreaths (for the dates of November 1 through December 25).
B. 
Residents of the Village of Bath may sell these items at their respective residential locations (or immediately adjoining property that they own) provided that they comply with the following:
(1) 
Sales may only take place between the hours of 9:00 a.m. and 7:00 p.m.;
(2) 
There must be adequate parking;
(3) 
No permanent signage shall be erected;
(4) 
All temporary signage must be limited to the residential location, and otherwise comply with existing code;
(5) 
No permit for the sale of such seasonal items are required; and
(6) 
All federal, state, and local laws must otherwise be complied with, except that where this sale of seasonal items section conflicts with other provisions of the Village of Bath Code that prohibit the sale of such items in the manner explained herein, this section shall control.
The Village Board reserves the right to review the operation of any person or claiming to comply with these provisions as a seasonal seller to determine whether the person is in fact a seasonal seller. If the person is not a seasonal seller and is in violation of the Village Code, he or she shall be subject to penalties relative to the violated Code section.
