A. 
It is the intent of this chapter that it shall be unlawful for any person, firm, corporation, partnership, or other legal entity to deposit sludge which originated or was collected outside the territorial limits of Cayuga County in any town or village (all municipalities outside the City of Auburn) located in the County of Cayuga, henceforth.
B. 
This chapter is designed specifically to address local public interest, concerns and environmental health measures, as well as to promote the safety, health and welfare of the citizens of Cayuga County.
"Sludge" shall be defined as any solid, semisolid or liquid waste generated from a municipal, commercial or industrial wastewater treatment plant, water supply treatment plant or air pollution control facility. "Sludge" does not include the treated effluent from a wastewater treatment plant.
Any violation of any provision of this chapter or of any law, ordinance, rule, regulation or order adopted pursuant there to shall be punishable by a fine not to exceed $10,000 and imprisonment for a period not to exceed one year in the Cayuga County Jail, for each and every violation. Each day during which a violation of this chapter continues shall be deemed a separate violation.
If any section, subdivision, paragraph or provision of this chapter shall be determined to be invalid, such determination shall apply only to that particular section, subdivision, paragraph or provision, and all other provisions of this chapter shall remain valid and in effect.
