A permit shall be required when there is construction or household debris which will require the utilization of an approved rubbish or trash collection facility commonly known as a "dumpster and/or bagster" or equivalent, sufficient to hold and remove all construction waste and rubbish during the construction activity or household debris removal. Said dumpster shall be emptied on a frequency necessary that the waste and debris shall not accumulate outside of said container or shall overflow from said container. Unless physically impracticable, said dumpster must be located on the property on which the construction activity actually occurs.
All dumpsters or other collection facilities pursuant to this article shall contain a cover or tarpaulin which must be placed over the dumpster or construction container at all times in which there is not construction activity being performed at said site.
A. 
Single-family residential zones. No construction dumpster shall be located within 10 feet of an abutting dwelling. No dumpster shall be placed so that it blocks any public sidewalk or street.
B. 
Multifamily, commercial and industrial zones. No construction dumpster shall be located within 10 feet of a property line. No construction dumpster shall be located on a public street or alley unless a permit is obtained from the Zoning Officer.
C. 
No dumpster shall be placed in a public area in a residential zone unless it is determined by the Zoning Officer that there is insufficient room to place the dumpster on the private property of the person utilizing the dumpster. Consent by the Zoning Officer shall be valid and remain in effect for a period of not more than 30 days but may be renewed by the Zoning Officer upon application without additional fee. No dumpster placed on private property, otherwise unregulated by this chapter, shall impede the flow of pedestrian or vehicular traffic or safety sight lines.
D. 
The dumpster shall be equipped with markers consisting of all-yellow reflective diamond-shaped panels measuring a minimum of 18 inches by 18 inches. These panels shall be mounted at the edge of the dumpster at both ends nearest the path of passing vehicles and facing the direction of oncoming traffic. The required markers shall have a minimum height of three feet from the bottom of the panels to the surface of the roadway. At the issuance of the approved zoning permit for said dumpster the necessary placards must be in place to ensure that all safety measures have been taken and that proper permits have been issued. No dumpsters are permitted to be in the street or Township right-of-way.
E. 
All dumpsters shall at all times be kept in good repair and shall be structurally sound and leakproof and shall be painted as to prevent the show of rust or deterioration and shall be constructed to stand firmly upright.
F. 
Upon removal of the dumpster, the area shall be swept clean of all loose debris and restored to its former condition in accordance with the standards of the Township Engineer.
G. 
The applicant shall be responsible for any damage to the roadway or other property caused by the placement of the container.[1]

If the dumpster is not removed at the expiration of the permit, the Zoning Officer shall notify the owner in writing via certified and regular mail that he has 10 days in which to have the dumpster removed from the premises. In the event the owner fails to comply, the dumpster shall be deemed to have been abandoned and the Zoning Officer may arrange for its removal and the disposal of its contents. The costs associated with the removal of the dumpster and the disposal of its contents shall be a municipal lien against the property. A detailed statement of the aforesaid costs shall be certified by the Zoning Officer and forwarded via certified and regular mail to the property owner. If in the event the property owner fails to remit payment for same, the Township Solicitor, who shall examine the certification and, if found correct, shall cause the same to be filed with the Tax Collector and a copy forwarded to the property owner, this amount shall be charged against the land and shall become a lien upon such lands. Said lien shall bear interest at the same rate as taxes and shall be collected and enforced by the Tax Collector.
Any person violating any section of this article shall be subject to a fine not exceeding $100 for each violation and/or any costs associated with the removal of the dumpster and disposal of its contents by the Township of Monroe. In addition to the penalties provided in this article, the Zoning Officer and/or his/her designee shall be empowered to take such other action as may be available to him/her under the New Jersey Uniform Construction Code or under any other such law or ordinance which may apply.
A. 
Any person violating any section of this article shall be served with written notice of the violation by the delivery of such to any person, or the agent or employee of any such person. If no such person is present, the notice shall be posted on the premises where the dumpster is located.
B. 
If, within 10 days from the date of the notice of violation, the violation has not been cured, as determined by the Zoning Officer and/or his/her designee, the person shall be subject to the penalties provided in § 104-29.1.
This chapter shall be enforced by the Zoning Officer and/or his/her designee of the Township of Monroe.
