The purpose of this article is to provide a real estate tax
exemption for residential homeowners making capital improvements to
their residential buildings pursuant to the local option set forth
in Real Property Tax Law § 421-f, and to encourage the reconstruction,
improvement and alteration of the existing housing in the Village
of Clinton.
The adoption of this article is made pursuant to § 10
of the Municipal Home Rule Law, and Real Property Tax Law § 421-f.

A copy of this article shall be filed with the Commissioner.
If any part or provision of this article or the application
thereof to any person or circumstance be adjudged invalid by any court
of competent jurisdiction, such judgment shall be confined in its
operation the part or provision or application directly involved in
the controversy in which such judgment shall have been rendered and
shall not affect or impair the validity of the remainder of this article
or the application thereof to other persons or circumstances, and
the Village Board of the Village of Clinton hereby declares that it
would have passed this article or the remainder thereof had such invalid
application or invalid provision been apparent.

This article shall be known and cited as "A Local Law of the
Village of Clinton Providing a Partial Exemption from Taxation to
Persons 65 years of Age or Older Pursuant to the Provisions of § 467
of the Real Property Tax Law of the State of New York."
The making of any willful false statement in the application
for an exemption under this article shall be a violation thereof,
and a conviction for any such violation shall be punishable by a fine
of not more than $100 and shall disqualify the applicant or applicants
from further exemption for a period of five years.
Should any section, paragraph, sentence, clause or phrase of
this article be declared unconstitutional or unjust for any reason
by a court of competent jurisdiction, the remainder of this article
shall not be affected thereby.
