No person, association, firm or corporation shall cause to be thrown or disposed of or littered upon public or private property in the area of Hamiltonban Township, Adams County, Pennsylvania, any type of waste, including but not limited to glass, cans, paper, plastics, garbage or any other type of waste thrown from any type of vehicle or disposed of by a person walking or littered any where in the area of said Township.
No person, association firm or corporation may permit to be used any piece of ground or lot within said Township for the disposal of the goods set forth in § 227-1 above or for littering in any type or manner. This chapter, however, does not prohibit the owner of a private residence from carefully disposing of refuse by burying it or disposing of it any other healthful manner.
Any person, association, firm or corporation who or which shall violate any of the provisions of this chapter shall, upon conviction thereof before a Magisterial District Judge, be sentenced to pay a fine of $100, and costs of prosecution, and, in default of payment of such fine and costs, be imprisoned for not more than 30 days in the Adams County jail. Each act of littering shall constitute a separate violation and a separate offense.
