Following the effective date of this article, it shall be unlawful
to park, or allow to be parked any motor vehicle or other vehicle
on any street or road which is part of the Township system after two
inches of a snowfall and until the snow has stopped falling and the
snow has been completely plowed for the full width of the cartway.
The Roadmaster or Chairman of the Board of Supervisors may declare
a snow and ice emergency. Information on the existence of a snow emergency
shall be given by the Township through radio, newspaper or other available
media, and information on the termination of the emergency may be
given by use of the same media.
The registered owner of any said vehicle found to be parked on a public street and in violation of this chapter shall be subject to the fines and penalties under §
350-32 of this article.
Any person violating any of the provisions of this article shall,
upon summary conviction before a Magisterial District Judge, be sentenced
to pay a fine of not less than $300 and not more than $500, and costs
of prosecution, including reasonable attorneys' fees, to be collected
as like fines are now collected by law. Each day of violation shall
constitute a separate offense, and fines and penalties shall be assessed
for each individual day a violation occurs.
The provisions of this article are severable. If any sentence,
clause, or section of this article is for any reason found to be unconstitutional,
illegal, or invalid, such unconstitutionality, illegality, or invalidity
shall not affect or impair any of the remaining provisions, sentences,
clauses, or sections of this chapter. It is hereby declared to be
the intent of the Board of Supervisors of Hamiltonban Township that
this chapter would have been adopted had such unconstitutional, illegal,
or invalid sentence, clause, or section not been included herein.
