As used in this chapter, the following terms shall have the
meanings indicated, unless a different meaning clearly appears from
the context:
CAMPFIRE
A small outdoor fire intended for recreation or cooking,
but not including a fire intended for disposal of waste wood, yard
debris or refuse.
CLEAN WOOD
Natural wood which has not been painted, varnished or coated
with a similar material; has not been pressure treated with preservatives;
and does not contain resins or glues, as in plywood or other composite
wood products.
GOVERNING BODY
The Board of Supervisors of Robinson Township, Washington
County.
OPEN BURNING
Kindling or maintaining a fire where the products of combustion
are emitted directly into the ambient air without passing through
a stack or a chimney. This includes burning in a burn barrel.
PATIO BURNING UNIT
A chiminea, patio warmer, or other portable wood-burning,
gas-burning or other device used for outdoor recreation and/or heating.
PERSON
Any individual, partnership, association, corporation, department,
bureau, agency or other legal entity.
REFUSE
Any waste material except trees, logs, brush, stumps, leaves,
grass clippings, and other vegetative matter.
The Supervisors of Robinson Township shall have the power and
duty to enforce the provisions of this chapter and therein, each Supervisor
shall be considered an enforcement officer and, additionally, the
same may be enforced by the Zoning Officer or any other enforcement
officer as designated by the Board of Supervisors from time to time.
Any person who shall violate any provision of this chapter shall,
upon conviction thereof, be sentenced to pay a fine of not more than
$500, and/or to imprisonment for a term not to exceed 60 days.
A person utilizing or maintaining an outdoor fire shall be responsible
for all fire suppression costs and any other liability resulting from
damage caused by the fire.
The Fire Chief, Emergency Management Representative, Zoning
Officer, or any authorized officer, agent, employee or representative
of the Township who presents credentials may inspect any property
for the purpose of ascertaining compliance with the provisions of
this chapter.
All ordinances or parts of ordinances which are inconsistent
herewith are hereby repealed.
If any sentence, clause, section or part of this chapter is
for any reason found to be unconstitutional, illegal or invalid, such
unconstitutionality, illegality or invalidity shall not affect or
impair any of the remaining provisions, sentences, clauses, sections
or parts of this chapter. It is hereby declared as the intent of Robinson
Township that this chapter would have been adopted had such unconstitutional,
illegal or invalid sentence, clause, section or part thereof not been
included herein.
This chapter, as amended, shall become a part of the Code of
the Township of Robinson.
This chapter shall become effective on August 14, 2017.
