As used in this article, the following terms shall have the
meanings indicated unless a different meaning clearly appears from
the context:
ACTOR
The person violating any ordinance of Robinson Township and/or
any laws of Robinson Township and/or any laws of the Commonwealth
of Pennsylvania, and/or those laws, rules, and regulations designated
as the Pennsylvania Crimes Code, Pa.C.S.A. Title 18, and Title 35,
Chapter 6, and Title 75 Pa.C.S.A., Motor Vehicle Code, in their entirety.
REQUEST FOR RESPONSE
Any communication to the Township, its police department,
or county 911 dispatch center or any other entity indicating the possibility
or existence of a crime or other emergency situation warranting immediate
action by the police.
REQUESTOR
Any person, corporation, tenant, resident, business organization,
nonprofit organization, charitable institution, and/or agent, servant,
principal or employee thereof who makes a request for response.
RESPONSE
Any request for response which causes the police department
providing services to Robinson Township to utilize its communication
systems, motor vehicles and/or personnel to arrive at or participate
at any place designated or specified by the requestor.

Any responses or determinations as set forth in §
215-2 of this article shall require the requestor or actor to pay to Robinson Township a fee set forth and adjusted from time to time by resolution of the Board of Supervisors, and any incidental costs, fees or expenses relating to a response.
The police department that serves the Township and/or the Township Secretary shall provide billings to those individuals creating the requirement of a police response and/or police action pursuant to the schedule of charges set forth in §
215-3 of this article. Said billings shall be issued within 60 days of the conclusion of the police involvement. Thereafter, payment shall be made to the Township for the aforesaid billings within 30 days of the date of the billing. Failure to pay the aforesaid billings shall subject the requestor to a municipal lien for the amount thereof and/or a judgment for the amount therein as established pursuant to a civil action brought within a court or forum of appropriate jurisdiction. The amount of said billings shall include the hourly rate indicated thereon plus any incidental costs, fees, or expenses. In addition, the Township, through the Police Department, may request any court having competent jurisdiction over a requestor or actor, to make restitution to the Township consistent with this article. Additionally, interest on the unpaid balance of any invoice of any fees and/or expenses shall carry an interest rate of 9% per annum on the unpaid balance. In addition, the Township may assess attorney's fees, costs and expenses associated with the collection of any fees or expenses authorized by this article.
If any section, clause or part of this article is, for any reason,
found to be unconstitutional, illegal or invalid, such unconstitutionality,
illegality or invalidity shall not affect or impair any of the remaining
provisions, sentences, clauses, sections or parts of this article.
It is hereby declared as the intent of the Board of Supervisors that
this article would have been adopted had such unconstitutional, illegal
or invalid sentence, clause, section or part thereof not been included
therein.
All ordinances or parts of ordinances which are inconsistent
herewith are hereby repealed.
The provisions of this article shall become effective within
10 days of its adoption.
