The following definitions apply to this article:
(a) 
Library means the Plainfield Public Library located at West 8th Street and Park Avenue in the City of Plainfield;
(b) 
Books means any books, magazines, reference material, records, or any other material which the Library keeps on its premises, whether or not the same are offered for loan;
(c) 
Person means any individual or individuals, including an agent, servant, or employee of the Library where the facts of the situation so require;
(d) 
Conceal means to conceal books so that, although there may be some notice of their presence, they are not visible through ordinary observation;
(e) 
Premises of the Library means and includes, but is not limited to, the Library building itself, and the parking lots thereof;
(f) 
Loan means the offering by the Library of books to the public for its use, whether such use is restricted to the Library premises or the books may be checked out for use away from the Library premises.

Book theft shall consist of any one or both of the following acts:
(a) 
For any person purposely to take possession of, carry away, transfer or cause to be carried away or transferred, any books displayed, held, stored, or offered for loan by the Library with the intention of depriving the Library of the possession, use, or benefit of such books or converting the same to the use of such person without properly checking such books out for loan.
(b) 
For any person purposely to conceal upon his person or otherwise any books offered for loan by the Library with the intention of depriving the Library for the possession, use, or benefit of such books or converting the same to the use of such person without properly checking such books out for loan.

Any person purposely concealing books not properly checked out for loan of the Library, either on the premises or outside the premises of the Library, shall be prima facie presumed to have so concealed the books with the intention of depriving the Library of the possession, use, or benefit of such books, and the finding of such books concealed upon the person or among the belongings of such person shall be prima facie evidence of purposeful concealment; and if such person conceals, or causes to be concealed, such books upon his person or among the belongings of another, the findings of the same shall also be prima facie evidence of willful concealment on the part of the person so concealing such books.

Any person found guilty of any offense under Section 10:10-2 shall be sentenced to pay a fine of not more than Twenty Five Dollars ($25.00) for a first offense; to pay a fine of not less than Twenty Five Dollars ($25.00) nor more than One Hundred Dollars ($100.00) for a second offense; and to pay a fine of not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00) for a third and any subsequent offense.
