The Department of Finance and Administration is hereby created
in and for the City of Asbury Park.

The Department of Finance and Administration shall consist of
the following divisions:
a. Finance, which may include the following: Purchasing, Treasury, and
Human Resources.

The Department of Finance and Administration shall at all times
be under the supervision of the Chief Financial Officer in all actions
relative to the duties and responsibilities of the Department to the
extent not prohibited by law. The Chief Financial Officer shall serve
as the Department head.

The Department of Finance and Administration shall consist of
employees hired by the City Manager and certification of available
funds.

a. Definition. "Chief Financial Officer" shall mean the official appointed
pursuant to N.J.S.A. 40A:9-140.10 to be responsible for the proper
financial administration of the City under the "Local Government Supervision
Act," N.J.S.A. 52:27B-1 et seq.; the "Local Bond Law," N.J.S.A. 40A:2-1
et seq.; the "Local Budget Law," N.J.S.A. 40A:4-1 et seq.; the "Local
Fiscal Affairs Law," N.J.S.A. 40A:5-1 et seq.; the "Local Public Contracts
Law," N.J.S.A. 40A:11-1 et seq., and such other statutes, rules, and
regulations promulgated by the Director of the Division of Local Government
Services, the local Finance Board or any other State agency, as may
pertain to financial administration of the City.
b. Appointment. The Chief Financial Officer shall be appointed by the
Mayor and Council pursuant to the provisions of N.J.S.A. 40A:9-140.10
and shall serve in accordance with the provisions of N.J.S.A. 40A:9-140.1
et seq.
c. Supervision. The Chief Financial Officer shall at all times be under
the supervision of the City Manager in all actions relative to the
duties and responsibilities of this office to the extent not prohibited
by law.
d. Duties. The Chief Financial Officer shall be responsible for the
proper financial administration of the City pursuant to N.J.S.A. 40A:9-140.1(d),
and the Chief Financial Officer shall provide the City Manager with
quarterly reports and goals and accomplishments.
e. Compensation. The Chief Financial Officer shall receive as compensation
the amount set forth in the salary ordinance for this position.

a. Creation. The office of Tax Collector is hereby created in and for
the City pursuant to the provisions of N.J.S.A. 40A:9-141.
b. Appointment. The Tax Collector shall be appointed by the Mayor and
Council and shall serve in accordance with the provisions of N.J.S.A.
40A:9-141 et seq. with the advice and consent of the City Council.
c. Supervision. The Tax Collector shall at all times be under the supervision
of the Chief Financial Officer in all actions relative to the duties
and responsibilities of the office to the extent not prohibited by
law.
d. Duties. The Tax Collector shall be responsible for overseeing the
collection of taxes and sewer charges, and duties inherent in the
collection of taxes and sewer charges, and duties pursuant to N.J.S.A.
40:56-31.
e. Compensation. The Tax Collector shall receive as compensation the
amount set forth in the salary ordinance for that position.

a. Creation. The office of Tax Assessor is hereby created in and for
the City pursuant to the provisions of N.J.S.A. 40A:9-146.
b. Appointment. The Tax Assessor shall be appointed by the Mayor and
Council and shall serve in accordance with the provisions of N.J.S.A.
40A:9-146 et seq.
c. Supervision. The Tax Assessor shall report to the Chief Financial
Officer, and shall at all times be under the supervision and direction
of the New Jersey State Division of Taxation and the Monmouth County
Board of Taxation, in accordance with applicable State regulations.
d. Duties. The Tax Assessor shall be responsible for overseeing the
assessment of property within the City of Asbury Park for the purpose
of general taxation, and all duties inherent in and associated with
the assessment of taxes, and such other duties as required pursuant
to applicable State law.
e. Compensation. The Tax Assessor shall receive as compensation the
amount set forth in the salary ordinance for that position.

There are hereby created the positions of City Attorney, Municipal
Prosecutor, Municipal Public Defender, and Code Enforcement Prosecutor
(collectively, the City's "law personnel"). In addition to the law
personnel positions referenced, the Mayor and Council may appoint
such other special counsels as they deem necessary who shall serve
at the pleasure of the Mayor and Council. The Mayor and Council shall
appoint the City Attorney and all special counsels. All other staff
appointments shall be made by the City Manager if such positions are
created by the Mayor and Council and the appointees shall serve at
the pleasure of the City Manager. All non-staff appointments are to
be made by the Mayor and Council.

The City Attorney shall be appointed on an annual basis for
a term of one year or until a successor is duly appointed and qualified,
and shall serve at the pleasure of the Mayor and Council.

The Municipal Prosecutor shall be appointed by the City Manager
if the position is defined as a staff position as per Federal and
State regulations. If this position is not a staff position and is
qualified as a consultant, then the Mayor and Council shall appoint
an attorney to the position for a term of one year or until a successor
is duly appointed and qualified. Dependent on the nature of the appointment,
there shall be at least one Alternate Prosecutor appointed. The Municipal
Prosecutor shall perform those duties as prescribed under N.J.S.A.
2B:25-5. (N.J.S.A. 2B:25-1 et seq.)

The Municipal Public Defender shall be appointed by the City
Manager if the position is defined as a staff position as per Federal
and State regulations. If this position is not a staff position and
is qualified as a consultant, then the Mayor and Council shall appoint
an attorney to the position for a term of one year or until a successor
is duly appointed and qualified. The Municipal Public Defender shall
perform those duties prescribed under N.J.S.A. 2B:24-6.
The Public Defender shall receive a salary if a staff position
or a contract if appointed by the Mayor and Council. The Public Defender
shall represent defendants in the Municipal Court as directed by the
Judge of the Municipal Court. Any person applying for representation
by a Municipal Public Defender shall be required to pay an application
fee of not more than two hundred ($200) dollars. The Municipal Court
may waive any required application fee, in whole or in part, if the
Court determines, in its discretion, that the application fee represents
an unreasonable burden on the person seeking representation.

The Code Enforcement Prosecutor shall be appointed by the City
Manager if the position is defined as a staff position as per Federal
and State regulations. If this position is not a staff position and
is qualified as a consultant, then the Mayor and Council shall appoint
an attorney to the position for a term of one year or until a successor
is duly appointed and qualified. The Code Enforcement Prosecutor shall
prosecute code violations on behalf of the City.

The City Manager may make such other appointments for such positions
as created by the Mayor and Council, if the position(s) are defined
as staff positions as per Federal and State regulations.

Compensation shall be set by salary ordinance (for staff positions)
and/or by contract (for consultant positions) approved by the Mayor
and Council.

Pursuant to N.J.S.A. 40A:14-118, there is hereby created a Police
Department within the City of Asbury Park, which shall consist of
a uniformed force as hereinafter set forth.

The Police Department shall not exceed more than the following:
a. Police Chief; Number of Positions - One (1)
b. Deputy Police Chief; Number of Positions - One (1)
c. Captain; Number of Positions - Four (4)
d. Lieutenants; Number of Positions - Six (6)
e. Sergeants; Number of Positions - Fifteen (15)
f. Police Officers Number of Positions - Seventy (70)
The above listing represents the chain of command within the
Department, with the Police Chief representing the highest position
and the remaining positions falling in descending hierarchical order.
The lowest ranking members of the Department shall be the Special
Police Officers, if any.
In addition civilian employees including but not limited to
laborers, telephone operators, clerks, computer personnel, telecommunications
officers, Special Law Enforcement Officer II (SLEO), school traffic
guards, and other special police officers may be hired subject to
the recommendation of the Chief of Police and/or Director of Public
Safety.
The establishment of a Table of Organization for the City of
Asbury Park Police Department shall not be deemed to require that
all positions be filled, but rather the number of sworn officers in
each rank and/or position shall not exceed those set forth in this
subsection unless the Table of Organization is amended by the City
Council of the City of Asbury and such positions are subject to available
funding of such positions by the adoption of a budget and salary ordinance
by the City Council of the City of Asbury Park. Any municipal salary
ordinance, as amended, and appointment of persons in accordance with
this Table of Organization shall be consistent with the foregoing
and shall serve to fill the positions allowed pursuant to this section.
In the event that a Police Chief is not named, then the next highest
ranking officer shall have all the vested duties of that of a Police
Chief.

The Police Department shall preserve the public peace, protect
life and property, detect, arrest and prosecute offenders of the laws
of the State of New Jersey and the ordinances of the City of Asbury
Park; direct and control traffic; provide attendance and protection
during emergencies; provide appearances in court; cooperate with other
law enforcement agencies; provide training for the efficiency of its
members and officers; and perform all other duties as required or
authorized by law.

The City Manager, or his/her designee, is hereby designated
as the Appropriate Authority pursuant to N.J.S.A. 40A:14-118. The
City Manager shall be responsible for the overall performance of the
Police Department. The City Manager, in consultation with the Police
Chief, shall adopt and promulgate such rules and regulations as necessary
for the government of the Police Department and for the discipline
of its members.

a. Executive Officer. The Police Chief shall be the executive officer
of the Police Department, and shall serve as the Department Head.
b. Appointment; Qualifications. The Police Chief shall be appointed
by the City Manager in accordance with applicable Civil Service Laws,
and shall possess such qualifications as are required for the position
by the State of New Jersey Civil Service Commission.
c. Compensation. The Police Chief's compensation shall be such sum as
shall be fixed by ordinance of the City Council.
d. Responsibilities. The Police Chief shall:
1. Be the head of the Police force.
2. Be directly responsible to the City Manager for the day-to-day operations
and internal organization of the Police Department, as well as the
Department's planning and research, training and Homeland Security
Operations.
3. Administer and enforce all ordinances of the City and the laws of
the State of New Jersey, and such rules and regulations as may be
promulgated for the regulation of the Police Department.
4. Have charge of and responsibility for all property of the City used
by the Police Department.
5. Have, exercise and discharge the functions, powers and duties of
the Department.
6. Prescribe the duties and assignments of all officers and Department
personnel, and provide advice and assistance as necessary.
7. Be vested with all authority and duties of a Police Officer.
8. Approve all invoices for the expense of the Department.
9. Keep and maintain an accurate record of all operations of the Department,
and report at least monthly to the City Manager on the operations
during the preceding month. The Police Chief shall also make such
other reports as may be requested by the City Manager.
10. Submit an annual report to the Mayor and Council, on or before January
15 of each year, which report shall assess the operations of the Police
Department and its personnel, equipment and property during the preceding
year, as well as summarize goals and objectives for the Department
for the year ahead. The Police Chief shall also make such other reports
as may be requested by the Mayor and Council from time to time.
11. Keep and maintain all records, reports, documents and data required
to be kept and maintained by the Federal and/or State government and/or
any of their respective subdivisions.
12. Keep and maintain a record of all appointments, dismissals, removals,
resignations and deaths of officers as they take place, with such
other information as may be necessary.
13. Have the authority to discipline any member of the Department for
insubordination, disorderly conduct, conduct unbecoming an officer
and/or any violation of law, rule, ordinance, regulation or otherwise.
14. Have the power, and it shall be his duty, to suspend summarily any
member of the Department for insubordination, disorderly conduct,
conduct unbecoming an officer or violation of law, rule, ordinance,
regulation or otherwise.
15. Have responsibility for developing the annual budget for the Police
Department and shall be responsible for overseeing any and all expenditures
by the Department, subject to the approval of the City Manager and
the City Council.
16. Have responsibility for ensuring that all officers and members of
the Department are fit for full duty at all times that they are on
active status.
17. Delegate such of his authority as he may deem necessary for the efficient
operation of the Department, with any delegated authority to be exercised
under his direction and supervision.
18. Perform such other duties as are prescribed for the position by the
State of New Jersey Civil Service Commission.
19. Perform such other appropriate duties as may be assigned to him by
the City Manager, and/or which are necessary for the efficient conduct
of the Police Department.

The Police Department shall consist of the following divisions
and such other divisions and/or units as may be designated by the
Police Chief:
a. Patrol Division. The Patrol Division shall be headed by a superior
officer chosen by the Police Chief, and shall consist of such officers
and patrol persons as assigned by the Police Chief to carry out the
duties assigned to the Division. The School Crossing Guards and Meter
Enforcement Officers shall be part of the Patrol Division. This Division
will be responsible for the conduct and operation of the main Police
desk and such other duties as determined by the Police Chief.
b. Administrative Service Division. The Administrative Services Division
shall be headed by a superior officer chosen by the Police Chief,
and shall consist of such officers and patrol persons as assigned
by the Police Chief to carry out the duties assigned to the Division,
which duties shall be determined by the Police Chief.
c. Investigation Division. The Investigation Division shall be headed
by a superior officer chosen by the Police Chief, and shall consist
of such other detectives and officers as assigned by the Police Chief
to carry out the duties assigned to the Division, which duties shall
be determined by the Police Chief. The grade of Detective shall be
of a temporary nature and shall apply to patrol persons when assigned
by the Police Chief to the Investigation Division of the Department.
In the absence of a superior officer, detectives shall rank patrol
persons in carrying out their duties.
d. Support Services Division. The Support Services Division shall be
headed by a superior officer chosen by the Police Chief and shall
consist of staff support to perform duties included but not limited
to Records, OPRA, Technical Services, etc.

a. Created. Pursuant to the Special Law Enforcement Officer's Act, N.J.S.A.
40A:14-146.8 et seq., the terms and requirements of which are incorporated
herein by reference, there is hereby created the position(s) of Special
Law Enforcement Officer in and for the City. Special Law Enforcement
Officers I and Special Law Enforcement Officers II may be hired and
utilized as prescribed by State Statute.
b. The City is hereby designated a "resort municipality."

a. Procedure. All appointments to and promotions within the Police Department
shall be made by the City Manager, upon recommendation of the Police
Chief. Appointments and promotions shall be made according to merit
and fairness, which shall be ascertained, as far as practicable, by
competitive examinations. All appointments and promotions are to be
made in accordance with the rules, regulations and qualifications
as prescribed by applicable Civil Service laws.
b. All appointments shall be made in accordance with N.J.S.A. 40A:14-123.1a.
Before any person shall be appointed as a member of the Police Department,
the City Manager shall classify all of the duly qualified applicants
for the position or positions to be filled in the following classes:
I. Residents of the City of Asbury Park.
II. Other residents of Monmouth County.
III. Other residents of the State of New Jersey.
IV. All other qualified applicants.
The classes of qualified applicants defined above shall be considered
as separate and successive lists of eligible applicants, in order
referenced above.
Veterans discharged from the service within 6 months prior to
making application who fulfill the requirements of N.J.S.A. 40A:14-123.1
and meet the residency requirements shall be placed in Class II.
c. Temporary Appointments. In making temporary or "provisional" appointments,
the City Manager shall classify accordingly all duly qualified applicants
for the position or positions to be temporarily filled and follow
all requirements prescribed by applicable Civil Service Laws.

No person shall be dismissed from office or employment in the
Police Department in any manner or by any means other than those prescribed
by the applicable Civil Service Laws.

The position of Police Chaplain ("Chaplain") is established.
The position shall be a volunteer position, subject to the control
of the Chief of Police. The person appointed as Chaplain shall be
an ordained clergyman in good standing in the religious body from
which he/she is selected. The Chaplain shall have basic training and
shall be a certified Police Chaplain credentialed in accordance with
the rules and regulations of the City of Asbury Park Police Department.
There shall not be more than eleven (11) Chaplains appointed in the
City. The duties of Chaplain shall include but not be limited to assisting
the Asbury Park Police Department in death notifications, station
house adjustments and any other duties that may be assigned by the
Chief of Police. Any person appointed as Chaplain shall serve in that
capacity without rank or salary. A person appointed as Chaplain shall
continue to serve until he/she is replaced, reappointed, or submits
a resignation. The Chief of Police may recommend to the City Council
persons that he/she believes meet the qualifications of N.J.S.A. 40A:14-141
as well as the rules and regulations of the Asbury Park Police Department
with reference to Chaplains, if any. The City Council shall appoint
one or more persons as Chaplain(s) in accordance with the terms set
forth herein.

Pursuant to N.J.S.A. 40A:14-7, there is hereby created a Fire
Department within the City of Asbury Park, which shall consist of
a uniformed force of career firefighters as may be required, subject
to such rules and regulations as shall be promulgated by the Fire
Chief to ensure the proper and efficient operation of the Department.

The uniformed force of career firefighters shall consist of
a Chief and such Battalion Chiefs, Captains, Firefighters, Fire Official(s),
Fire Prevention Specialists, Supervisor(s) of Emergency Medical Services
and other career firefighters as the City Manager shall appoint.

The Fire Department shall protect life and property from fire
and other disaster, preserve public safety, provide attendance and
protection during emergencies, cooperate with other public safety
agencies, provide training for the efficiency of its members and officers,
and perform all other duties as required or authorized by law.

the City Manager in accordance with applicable Civil Service Laws,

by the State of New Jersey Civil Service Commission jurisdictions
including New Jersey Division of Fire Safety Officer I, Incident Management
Level 3, Fire Service Instructor Level 2, Fire Official, and New Jersey
Department of Health and Senior Services Emergency Medical Technician
Basic (EMT-B).
c. Compensation. The Fire Chief's compensation shall be such sum as
shall be fixed by ordinance of the City Council.
d. Responsibilities. The Fire Chief shall:
1. Be the head of the Fire Department.
2. Promulgate such rules and regulations as deemed necessary to ensure
the proper and efficient operation of the Fire Department.
3. Be directly responsible to the City Manager for the day-to-day operations
and internal organization of the Fire Department, as well as the Department's
planning and research, and training operations.
4. Prescribe the duties and assignments of all officers and Department
personnel.
5. Have charge of the apparatus and all other property of the Department
and shall conduct inspections to ensure that all property of the Department
is kept in top condition for immediate and effective service.
6. Promptly report to the City Manager any equipment or property repairs
which may be necessary and make such recommendations or suggestions
as he may deem proper.
7. Approve all invoices for the expense of the Department.
8. Keep a record of all operations of the Department, and report at
least monthly to the City Manager on the operations during the preceding
month. The Fire Chief shall also make such other reports as may be
requested by the City Manager.
9. Submit an annual report to the Mayor and Council, on or before January
15 of each year, which report shall assess the operations of the Fire
Department and its personnel, equipment and property during the preceding
year, as well as summarize goals and objectives for the Department
for the year ahead. The Fire Chief shall also make such other reports
as may be requested by the Mayor and Council from time to time.
10. Keep and maintain all records, reports, documents and data required
to be kept and maintained by the Federal and/or State governments
and/or any of their respective subdivisions.
11. Keep and maintain a record of appointments, dismissals, removals,
resignations and deaths of officers and firefighters as they take
place, with such other information as may be necessary.
12. See that all laws, ordinances, rules and regulations and orders relative
to the Department are promptly enforced and obeyed and that all derelictions
or transgressions that may come up to his knowledge are promptly investigated
and reported to the City Manager.
13. Have the authority to discipline, including suspension, any member
of the Department, for any violation of law, rule, ordinance, regulation
or order.
14. Have the power, and it shall be his duty, to suspend summarily from
duty any member of the Department for insubordination, disorderly
conduct, or violation of a Department order, such suspension to continue
until the Fire Chief and City Manager shall act thereon.
15. Have responsibility for developing the annual budget for the Fire
Department and shall be responsible for overseeing any and all expenditures
by the Department subject to the approval of the City Manager and
the City Council.
16. Keep a record of all fire badges and identification cards distributed
by him and shall take written receipts from each member of the Department
to whom a badge and card is given.
17. Have responsibility for ensuring that all officers and members of
the Department are fit for duty at all times that they are in active
status.
18. Delegate such of his authority as he may deem necessary for the efficient
operation of the Department, with any delegated authority to be exercised
under his direction and supervision.
19. Recommend a standard of decoration for meritorious service.
20. Utilize National Fire Protection Association standards as a guideline
for the operation of the Department.
21. Perform such other duties as are prescribed for the position by the
State of New Jersey Department of Personnel for Civil Service jurisdictions.
22. Perform such other appropriate duties as may be assigned to him by
the City Manager, and/or which are necessary for the efficient conduct
of the Fire Department.

The Fire Department shall consist of the following divisions
and such other divisions and/or bureaus and units as may be designated
by the Fire Chief:
a. Fire Suppression Division. The Fire Suppression Division shall be
headed by the Chief and shall consist of such officers and firefighters
as assigned by the Chief to carry out the duties assigned to the Fire
Suppression Division.
b. Fire Prevention Bureau. The Fire Prevention Bureau shall be headed
by the Fire Official who shall be appointed by the City Manager upon
recommendation of the Fire Chief and shall consist of the Fire Prevention
Specialists and other personnel as assigned by the Chief to carry
out the duties assigned to the Division. All qualified applicants
shall be employees of the Fire Department. The Chief of the Department
will have the discretion to recommend to the City Manager the hiring
of a Fire Prevention Specialist as defined under the New Jersey Department
of Personnel, Division of County and Municipal Government Services
or Fire Prevention Specialist - UFD, as defined under the New Jersey
Department of Personnel, Division of County and Municipal Government
Services.
c. Emergency Medical Services Division. The E.M.S. Division shall be
headed by a qualified E.M.S. Officer who shall be appointed by the
City Manager upon recommendation of the Fire Chief and shall consist
of such duties assigned to the Division.
d. Right to Know/Open Public Records Division. The Right to Know/Open
Public Records Division shall be headed by the Fire Chief and shall
consist of such personnel as assigned by the Chief to carry out the
duties of the Right to Know/Open Public Records Division.

The fire officers in command at any fire scene are endowed with
full and complete Police authority, and may require and secure the
removal of any and all obstructions from in front and around fire
hydrants, sprinkler connections and/or standpipe connections or where
obstructions occur preventing firefighting operations and for that
purpose are authorized to call upon the head of any City department
for aid and assistance in securing such removal of obstructions.

It shall be the duty of the officer in charge of any company
at a fire or drill to report to the Chief all fire hydrants that are
found frozen, out of order, leaky or that are set in such a manner
as to make it difficult to connect thereto.

During the continuance of any fire or any other emergency within
the City wherein the Fire Department has taken the lead responsibility,
and for such time thereafter as the Chief shall deem necessary, the
Fire Department, under the control of the Chief, shall have complete
jurisdiction with the police, of the territory in and about the fire
or emergency scene, and may block the same territory from the public,
and prohibit the passage of all individuals and vehicles in or upon
any street adjacent to as they shall deem necessary.

No person shall, during time of fire, or while a fire hose is
laid out at a fire scene, ride or drive over the hose with any vehicle.

a. The Asbury Park Fire Department Auxiliary Firefighter/EMT Program
is a non-paid voluntary program. The program is designed to supplement,
not supplant the career staffing with individuals interested in providing
community services that reduce property loss caused by fire, hazardous
situations, injuries, deaths, and other emergencies. Auxiliary firefighters
can provide essential functions that assist the department and the
residents of Asbury Park. Auxiliary personnel participate in training
classes, community events, department drills, and emergency response.
b. The Auxiliary program consists of three types of personnel: (Level-1)
"Auxiliary Firefighter/EMT" (Immediately Dangerous to Life or Health-IDLH
qualified), (Level-2) "Auxiliary Emergency Medical Technician (EMT)"
(Non-IDLH qualified) personnel, and (Level-3) non-emergency personnel
that wish to assist the department in a non-emergency role. Level-1
and 2 Reserve Firefighter/EMT's and EMT's may ride on front line emergency
vehicles with the Asbury Park Fire Department crew and are expected
to meet all standards and perform the same duties and functions as
full-time firefighters. Level-3 Auxiliary personnel can only assist
with fire and emergency medical scene activities which are outside
the IDLH atmospheres, hot zones, and inner action circle.
c. Personnel assigned to the Asbury Park Fire Department Reserve must
document a minimum of training hours per month and report for a number,
previously scheduled twenty-four (24) hours shifts per month, as determined
by the Fire Chief.
d. Auxiliary Firefighters shall be subject to the jurisdiction and orders
of the Fire Chief and/or his/her designee.
e. No person shall become an Auxiliary Firefighter until the required
"Disclosure of Information Application" is completed and a background
check is made by the Fire Chief. Upon completion of this background
check and with the approval of the Fire Chief, said applicant must
be approved by the City Manager.

The following fees are hereby established for emergency medical
services as provided through the "Emergency Medical Services Division"
of the Fire Department of the City of Asbury Park:
a. Ambulance Transportation. There shall be a fee associated with the
provision of ambulance transportation in the amount of seven hundred
eighty ($780) dollars.

b. Basic Life Support (BLS) Mileage. There shall be a fee for basic
life support (BLS) mileage in the amount of fifteen ($15) dollars
per loaded mile.

The following fees are hereby established for the Fire Department
of the City of Asbury Park:
a. Lockout Services for Motor Vehicles. Lockout service calls for motor
vehicles shall be provided to City of Asbury Park residents at no
charge up to two (2) times per calendar year. Any resident who exceeds
the two (2) calls per calendar year and any non-resident shall be
assessed a fifty ($50) dollar charge for each lockout service call.

a. Any and all extra duty assignments for police and fire personnel
shall be determined and approved by the appropriate Chief (Police
or Fire) or his/her designee, in consultation with the City Manager.
No police officer or firefighter (hereinafter "officer") shall perform
special duty assignments for private persons or organizations for
compensation other than through the procedure set forth in this subsection.
b. The appropriate Chief shall obtain such information as he/she determines
necessary and is authorized to approve such special duty work in accordance
with this subsection.
c. The appropriate Chief may assign a patrol vehicle or other vehicle
for use in performing extra duty if and in the event it is determined
that the use of such vehicle is necessary and available to perform
the contracted duty. The appropriate Chief may deny the assignment
or use of police officers, firefighters and/or vehicles and/or impose
any condition or requirement as in his/her sole discretion and determination
is in the best interest of the City and/or the officer's or public
safety. The Chief shall be guided by the nature of the assignment
and should avoid those with conflicts of interest and/or high risk
of injury.
d. The work to be performed shall be considered a "special assignment
from independent contractors" and will not be considered a direct
assignment. The taking of any and all extra duty assignments covered
under this Chapter shall be on a strictly voluntary basis in accordance
with a fair and reasonable system established and administered by
the Chiefs.
e. Police officers engaged in special duty assignments shall be deemed
"on-duty" and shall conform to all Police Department rules, regulations,
procedures and orders. Firefighters engaged in special duty assignments
shall be deemed "on-duty" and shall conform to all Fire Department
rules, regulations, procedures and orders. All such agreements for
the furnishing of services to any contractor referred to herein as
"special duty assignments for the furnishing of services to any contractor
referred to herein as "special duty assignments" shall be by written
contract between the City and the contractor. No assignment may be
made for such work in the absence of such a written contract. The
contract to be entered into must be the form contract available from
the Police Department and Fire Department and shall be kept on record
as other such public documents.
No amendments to such contracts will be made without the express
written approval of the appropriate Chief.
f. All special duty assignments shall be within the City, unless specific
written approval is given by the appropriate Chief to the officer
to work outside of the City. The appropriate Chief may contact adjoining
municipal police departments and/or fire departments to fill such
special assignments if sufficient personnel cannot be found within
the Asbury Park Police Department or Fire Department.
g. All private persons or entities requesting extra duty assignments
by police and/or fire personnel will be required to submit payment,
based on estimates of the work to be done, in advance of services
rendered. The City will "escrow" the monies in a dedicated "special
duty account," to ensure timely payment to the police or fire personnel
subject to the required deductions, and an administrative fee to be
retained by the City. Those private persons or entities which require
continuous service shall maintain a minimum balance in an amount equal
to the average amount paid to the City's police or fire personnel
within a specified time, either monthly, or quarterly, and shall be
billed as necessary to ensure a sufficient balance at all times. If
there are insufficient funds, services shall be cut off until the
fund is replenished. Conversely, the City shall return any monies
in the fund in excess of the cost of the services to private persons
or entities within a reasonable period.
The City shall be entitled to an administrative fee as set forth
below for each hour associated with an extra duty assignment. Said
fee shall be in addition to the hourly rate prescribed for the services
rendered.
The hourly rates and administrative fees for all extra duty
assignments are hereby established as follows:

h. Any dispute between the contractor and the officer on assignments
as to services required or compensation due shall be determined by
the appropriate Chief.
i. Any assignment which is cancelled on less than two (2) hours' notice
shall be charged against the party. The amount charged for late cancellation
shall be the entire duration of the assignment as contracted for,
or four (4) hours, whichever is less.
j. The appropriate Chief has the authority to order any officer to vacate
or terminate any special duty assignment in response to emergency
situations or whenever the assignment creates an unacceptable risk
to the health, safety and welfare of the officer and/or public, which
decision shall be in the sole discretion of the appropriate Chief.
The contractor shall not be responsible for payment for the time that
the officer is away from the special duty assignments due to such
a decision of the Chief but shall have no claim whatsoever for any
costs or damages against the City, the Chief, or the officer arising
from the termination of special duty assignment other than the prorated
return of any monies prepaid to the City.
k. The City shall be responsible for providing all necessary insurance
coverage as required by law, including but not limited to workers'
compensation, public liability, and claims for damage, for personal
injury, including death, or damage to property which may arise as
a result from the municipality's performance under the contract.

The Mayor and Council shall provide for the appointment of a
municipal Engineer and fix his/her compensation in the annual salary
ordinance or on a fixed fee basis or at an hourly rate and based upon
actual time and expenses agreed upon prior to the rendering of the
services. No municipal Engineer shall be compensated by receiving
a percentage of the contract for which he/she renders services. The
term of the appointment shall be one year.

of Building and Construction, the head of which shall be the Construction
Official.

a. Plan, direct, organize and supervise all inspection activities within
the City including plumbing, electrical, building, public health,
air pollution control and code enforcement;
b. Supervise daily function of the department;
d. Provide the City Manager with quarterly reports regarding goals and
accomplishments;
e. Enforce the New Jersey State Uniform Construction Code;
f. Enforce the provisions of Chapter XII, Building and Construction,
of the City Code.

The Director shall provide the City Manager with quarterly reports

who shall be certified and act as the Principal Public Works Manager.

a. Administer all programs and activities of the Public Works Department;
b. Be responsible for the development and implementation of a comprehensive
maintenance program for all City-owned facilities, property, equipment
and natural resources.
c. Supervise all employees of the Public Works Department;
d. Prepare an annual budget;
e. Be responsible for those duties of the Assistant Superintendent when
such office is not established and/or vacant;
f. Supervise the Clean Communities program;
g. Provide quarterly reports to the City Manager with the goals and
accomplishments of the Department.

There shall be created the position of Assistant Superintendent
of Public Works who shall act as the Superintendent when the Superintendent
is not available. The Assistant Superintendent of Public Works shall
be responsible for the following duties:
a. Supervise contracts for refuse removal and other contracts involving
the Department of Public Works;
b. Supervise the enforcement of litter, trash, recycling and refuse
regulations;
c. Be responsible for reporting violations of the Property Maintenance
Code to proper City officials;
d. Shall pursue grants relevant to the Department;
e. Be responsible for the supervision of the Department in the absence
of the Superintendent.

The Department of Planning and Redevelopment (the "Department")
within the City of Asbury Park is hereby created. The head of the
Department shall be the Director of Planning and Redevelopment. The
Department shall consist of the following divisions:

a. Appointment. The Director of Planning and Redevelopment shall be
appointed by the City Manager. The Director of Planning and Redevelopment
shall also hold the title and/or duties as found in Chapter III, Land
Development, as: Administrative officer; Development Coordinator.

b. Qualifications. The Director shall be qualified by education and
experience and shall possess, at a minimum, the following qualifications
prior to his or her appointment by the City Manager.
1. The Director shall be a licensed professional planner in the State
of New Jersey.
2. The Director shall have at least five (5) years of full-time experience
in the fields of planning, zoning, development and/or redevelopment.
The City Manager may waive any of the requirements set forth
above when, in his or her judgment, the best interests of the City
shall be served thereby.
3. The Director shall possess certification from the American Institute
of Certified Planners (AICP).

c. Compensation. The Director shall receive such compensation as shall
be set forth by ordinance of the City Council.
d. The Director
of Planning and Redevelopment shall also be known as the City Planner.

The Department, under the supervision of the Director of Planning
and Redevelopment, shall perform or supervise all appropriate functions
associated with the following:
a. Professional services relating to all planning, zoning, development
and redevelopment matters within the City. Such services shall be
available to the Mayor and Council, the Redevelopment Entity, the
Technical Review Committee, the Planning Board and the Zoning Board
of Adjustment, as well as to City staff members and the public.
b. Preparation and submission of grant applications.
c. Drafting of land use ordinances, including amendments thereto, concerning
development regulations within the City.
d. Drafting of redevelopment plans and the preparation of preliminary
investigation reports pursuant to the New Jersey Local Redevelopment
and Housing Law, N.J.S.A. 40A:12A-1 et seq.
e. Issuance of zoning permits and certificates of zoning compliance.
f. Receipt, completeness review, processing of all development or redevelopment
applications and subsequently forwarding the applications to the applicable
board secretaries, federal, state or county or municipal office or
other offices as required, for development within the City

g. Maintaining a central system of filing of applications for development
within the City.
h. Maintaining and having available for public inspection and purchase
copies of the City Zoning Map, Land Development Regulations, Redevelopment
Plans, Master Plans and other planning related documents.
i. Such other related responsibilities as may be assigned by the City
Manager which are necessary for the conduct of City business.

j. Shall supply the City Manager with quarterly reports on the department's
goals and accomplishments.
k. In the
prolonged absence of the Director of Planning and Redevelopment, the
respective Zoning Board and Planning Board Planner shall serve as
the Administrative Officer and Development Coordinator or designee
of the City Manager. If that individual or firm is not available,
then the respective Board Secretary shall serve as the Administrative
Officer and Development Coordinator or designee of the City Manager.

The internal organization of the Department shall be as recommended
by the Director of Planning and Redevelopment, and as approved by
the City Manager. In addition to the Director of Planning and Redevelopment,
the Department may include, but shall not necessarily be limited to,
the following administrative personnel: the Zoning Officer also known
as the Zoning Enforcement Officer, the Development Coordinator and
the Assistant Planner (all of whom may be the same person), who shall
be appointed by the City Manager, and such other personnel whose positions
may be established by the Mayor and Council and who shall be appointed
by the City Manager. All additional staff of the Department shall
possess such qualifications as are required for the particular position
by the Civil Service Commission, where applicable, and shall perform
such duties as are prescribed by the Civil Service Commission for
the particular position, where applicable, and/or as directed by the
Director of Planning and Redevelopment and/or City Manager. All staff
of the Department, including the Director of Planning and Redevelopment,
shall be governed by Civil Service Commission requirements, where
applicable, as well as those provisions set forth in any applicable
collective bargaining agreements, and shall receive such compensation
as shall be set forth by ordinance of the Mayor and Council.

a Division of Planning and Zoning.
b. The Division of Planning and Zoning, under the supervision of the
Director of Planning and Redevelopment, shall be responsible for the
following duties:
1. Administering all planning and zoning activities within the City, as prescribed by applicable laws and local ordinances. Such activities shall include enforcement of the zoning ordinances of the City and monitoring and enforcing compliance with all requirements imposed upon developers by the various boards and agencies of the City, and performance of all activities as set forth in Chapter
30, Land Development Regulations.
2. Providing assistance to developers regarding pending or prospective
development applications, and coordinating development applications
between the respective Boards and agencies within the City.
3. Coordinating with City professionals and staff members regarding
development applications.
4. Providing in-house planning advice and services to the City's boards,
agencies, professionals and staff members.
5. Such other related responsibilities as may be assigned by the Director
of Planning and Redevelopment and/or the City Manager, and/or which
are necessary for the conduct of City business.

a. There shall be within the Department of Planning and Redevelopment
a Division of Redevelopment.
b. The Division of Redevelopment, under the supervision of the Director
of Planning and Redevelopment, shall be responsible for the following
duties:
1. Drafting of redevelopment plans, preparing preliminary investigation
reports and such other matters as are required pursuant to the New
Jersey Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et
seq.
2. Providing assistance to developers and the public with interpretation
of Redevelopment Ordinances, Plans and/or requirements, and providing
information regarding local regulations and application procedures.
3. Coordination and supervision of development applications within redevelopment
areas designated by the City.
4. Interfacing with all redevelopers and potential redevelopers within
the City and monitoring developer responsibilities, including compliance
with adopted Redevelopment Plans and/or Redeveloper Agreements.
5. Providing assistance with and overseeing the implementation of Redevelopment
Plans within the City.
6. Such other related responsibilities as may be assigned by the Director
of Planning and Redevelopment and/or the City Manager, and/or which
are necessary for the conduct of City business.

A Department of Social Services for the City is hereby established.
The head of the Department shall be the Director of Social Services.
The Department shall be responsible for Senior Services, Human Services
and Health Services.

a. The Director shall be appointed by the City Manager. The Director
of the Department of Social Services shall, prior to his appointment,
be qualified by professional training in public health or public welfare
and shall be further qualified by experience in responsible administration.

when, in their judgment, the best interest of the City shall be served
thereby.
The Director's compensation shall be such sum as shall be fixed
by ordinance of Council.
b. The Director, through the divisions and otherwise may:
1. Coordinate and supervise all of the social and human services in
relation to all of the socially dependent population and activities
of the City government.
2. Administer State laws and ordinances relating to senior citizens
including, but not limited to recreational activities, housing and
health issues.
3. Administer State laws and ordinances relating to public health.
4. Maintain a continuous study of social services in the City, and from
time to time recommend to the Mayor and Council appropriate plans
and programs for the protection and improvement of the health and
welfare of the people of the City.
5. Coordinate liaison with the Monmouth County Health Department.
6. Provide quarterly reports to the City Manager with the department's
goals and accomplishments.
7. Publicize and disseminate information on drug abuse services, education
and assistance available to citizens within the City.

a. There shall be within the Department of Social Services a Division
of Senior Services, the head of which shall be the Supervisor, Division
of Senior Services.
b. The Division of Senior Services, under the supervision of the Director
of the Department of Social Services, shall be responsible for the
following duties:
1. Administer Old Age Assistance laws and local ordinances relating
to senior citizens;
2. Provide related social services including a senior citizen center,
counseling, and other public welfare activities;
3. Administer and implement a comprehensive social and recreational
program for senior citizens of the City;
4. Publicize and disseminate information on recreational activities
and services available to senior citizens within the City.

1. Plan, initiate, organize, direct and execute City programs for the
delivery of social services;
2. Publicize and disseminate information on the social services, activities,
and opportunities available to residents of the City;

interventions;
4. Administer laws and local ordinances relating to drug abuse and drug
awareness programs.
a. There shall be within the Department of Social Services a Health Services office responsible for those duties as established in Chapter
28, Health Regulations.

of Recreation, the head of which shall be the Recreation Director.

a. The Director of the Department of Recreation shall be appointed by
the City Manager, and shall be qualified for appointment by education,
professional training and/or experience, and shall possess such qualifications
as are required for the position by the Civil Service Commission.
b. The Director shall report to the City Manager.
c. The Director's compensation shall be such sum as shall be fixed by
ordinance of the Council.
d. The Director shall be responsible for the following duties:
1. Planning, initiating, coordinating, organizing, directing, executing
and supervising all of the City's recreational programs, functions
and activities.
2. Administering and implementing a comprehensive recreational program
for the children and citizens of the City.
3. Publicizing and disseminating information on the recreational activities
and services available within the City.
4. Such other duties as are prescribed by the N.J.D.O.P. for the position.
5. Such other responsibilities as may be assigned to him or her by the
City Manager, and/or which are necessary for the efficient conduct
of the Department of Recreation.
6. Provide the City Manager with quarterly reports on the department's
goals and accomplishments.

may be established by the Mayor and Council from time to time and
who shall be appointed by the City Manager. Where applicable, all
staff of the Department shall possess such qualifications as are required
for the particular position by the Civil Service Commission, and shall
perform such duties as are prescribed by the Civil Service Commission
for the particular position and/or as directed by the Recreation Director
and/or City Manager. All staff of the Department shall be governed
by Civil Service Commission, where applicable, as well as those provisions
set forth in any applicable, collective bargaining agreements, and
shall receive such compensation as shall be set forth by ordinance
of the Mayor and Council.

of which shall be the Director of the Department of Communications.
The Department shall consist of those offices as established by ordinance
of the Mayor and Council. Appointments shall be made by the City Manager

The Director of the Department of Communications shall be responsible
for the following:
a. Managing and directing communications with:
d. Serve as the Public Information Officer as required by the Office
of Emergency Management during an emergency or at any time as directed
by the City Manager;
f. Digital, internet, social media and print marketing campaigns;
g. Support and manage the City's computer systems including the maintenance
and upgrades for hardware and equipment;
h. Provide user training for employees;
i. Oversee the Asbury Park TV Board of Commissioners;
j. Develop, coordinate, implement and supervise the City's workforce
development initiative, including the potential creation and implementation
of a plan to assist City residents in obtaining employment and/or
to counsel City residents as to how they may best be able to obtain
the skills and/or credentials needed for meaningful employment.
k. Provide the City Manager with quarterly reports as to the Department's
goals and accomplishments.
