Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of the State of New Jersey shall be deemed to
apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

a. The
Chief of Police is hereby authorized to provide by regulation for
the closing of any street or portion thereof to motor vehicle traffic
on any day or days whenever he/she finds that such closing is necessary
for the preservation of the public safety, health or welfare.
b. Any
regulations promulgated by the Chief of Police and in accordance with
paragraph a above, shall provide for the posting of proper warning
signs of such closing on any street or portion thereof during the
time the same is closed in pursuance thereof.
c. Any
violation of this regulation promulgated hereunder shall be punished
by a fine not to exceed fifty ($50.00) dollars.
d. Any
regulation adopted that mandates the closing of any street for a period
greater than forty-eight (48) consecutive hours shall not become effective
unless and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any Police Officer may provide for the removal of that vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than fifty ($50.00) dollars or imprisonment for a term not exceeding
fifteen (15) days or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

All former traffic ordinances of the Borough of Little Ferry
are hereby repealed, and all ordinances or parts of ordinances in
conflict with or inconsistent with the provisions of this chapter
are hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.

When the Borough Council finds and declares that problems of
traffic control occur when traffic must be moved through or around
street construction, maintenance operations, and utility work, above
and below ground which requires blocking the street and obstructing
the normal flow of traffic; and that such obstructions are or can
become dangerous when not properly controlled. In order to better
promote the public health, safety, peace and welfare, it is necessary
to establish controls and regulations directed to the safe and expeditious
movement of traffic through and around construction and maintenance
zones and to provide safety for the work force performing these operations.
The Borough of Little Ferry, in the County of Bergen, State
of New Jersey, does hereby adopt the current Manual on Uniform Traffic
Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented
and amended, as it controls and regulates whenever construction, maintenance
operations or utility work obstructs the normal flow of traffic. Any
person, contractor, or utility who fails to comply with the provisions
of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or
in the case of a public utility as required under a public utility
agreement, wishing to conduct work on, under or above the street to
contact the Police Department of the Borough of Little Ferry and arrange
a preconstruction meeting in order to submit plans for the safe movement
of traffic during such period of construction or work. Any person,
contractor or utility who fails to comply with this section prior
to the start of such work, or whose plans are not approved by the
Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police
Department with at least two (2) emergency contact phone numbers to
be called in case of emergency problems at the construction or maintenance
site prior to the start of any work. If for any reason emergency contact
cannot be reached, or if the emergency contact person does not respond
to the call from the Police Department to correct a hazardous condition,
the Borough may respond to correct the hazardous condition. The reasonable
fees for such emergency services by the Borough shall be charged to
the person, contractor, or utility responsible for such condition.

There shall be no construction, maintenance operations, or utility
work on any roadway in the Borough before the hour of 8:00 a.m. or
after 4:00 p.m. The Officer in charge of the Police Department may
adjust this time limit to permit work prior to 8:00 a.m. or after
4:00 p.m. If the Officer in charge determines that the construction
or maintenance operations prior to 8:00 a.m. or after 4:00 p.m. would
substantially delay traffic or cause a safety or health hazard, the
work shall then be permitted only between 8:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless
approved by the Police Department.

Traffic Directors shall be posted at all construction or maintenance
sites when determined by the Police Department that same is necessary
to provide for the safe and expeditious movement of traffic.

The Police Department shall have the authority to stop work,
including the removal of equipment and vehicles, stored material within
the street right-of-way, back filling of open excavations and/or other
related work, in order to abate any nuisance and/or safety hazard
or for any violation of this section.

It is to be expressly understood that no materials, vehicle
or equipment are to be placed in the roadway or sidewalk or until
all construction signs, light devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of
this section shall, upon conviction thereof for a first offense, pay
a fine of not less than one hundred ($100.00) dollars nor more than
five hundred ($500.00) dollars and/or be imprisoned in the County
Jail for a term not exceeding ninety (90) days. For a second offense,
the person, contractor or utility shall, upon conviction thereof,
pay a fine of not less than two hundred and fifty ($250.00) dollars
and/or be imprisoned in the County Jail for a term not exceeding ninety
(90) days.
A separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

a. Upon
the declaration of an emergency, there shall be no parking upon streets
or sections of streets where temporary EMERGENCY NO PARKING signs
are displayed. The Chief of Police or, in his/her absence, the ranking
Police Officer is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
b. The
effectiveness of this section is contingent upon the signs being erected
as required by law.

a. Whenever snow has fallen and the accumulation is such that it covers
the streets or highways, an emergency shall exist and no vehicles
shall be parked on the streets or highways or portions thereof indicated.
The above parking prohibitions shall remain in effect after the snow
has ceased, until the streets have been plowed sufficiently, and to
the extent that parking will not interfere with the normal flow of
traffic.
b. Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal before regaining possession
of the vehicle.
c. In accordance with the provisions of paragraphs a and b, no person
shall park a vehicle upon either side of any of the streets or parts
of streets thereof in the Borough whenever snow has fallen and the
accumulation is such that is covers the street or highway with one
(1) inch or more of snow.

No person shall park a vehicle on streets or parts of streets
as described within the following sections unless an appropriate and
current parking permit as issued by the Township of Little Ferry is
displayed on the vehicle for those streets or parts of streets as

e. Exceptions. The prohibitions set forth in this section shall not
apply to the following classifications of vehicles:
1. Visitor's Vehicles. A vehicle displaying a current visitor parking
permit may park, provided that the operator of the vehicle is a bona
fide guest of a resident of the Borough. The visitor's permit shall
be displayed on the driver's side dash of the vehicle in such a manner
as to be clearly visible by an officer enforcing parking regulations.
Visitors' vehicles must possess and present to the Police current
insurance and registration if requested.
2. Contractor/Service and Delivery Vehicles. Contractor, services and
delivery vehicles bearing the name and address of a commercial business
may park without permit during the times they are rendering service
within the Borough.
3. Emergency and Utility Vehicles. Emergency vehicles, gas, electric,
telecommunication, and other similar vehicles may park within the
Borough during the times they are rendering service or repairs within
the Borough.
4. Health care providers may park their vehicles within the Borough
during the times they are rendering assistance and/or health care
service to residents of the Borough. ("Health care provider" defined
as nurse, home health aid, physical therapist or any other medical
professional.)
f. Application for Permit; Terms and Conditions. Application for parking
permits under this section shall be made in writing on forms provided
by the Police Department. Permits shall be granted only under the
following terms and conditions:
1. Residents. To persons who are residents, a permanent permit valid
for two (2) years shall be issued for every vehicle owned or principally
operated by such person provided the resident provides at the time
of the issuance of the permit proof of current insurance and registration
for each such vehicle. New Parking Stickers shall be affixed to the
left rear window of the driver's side of the vehicle.
2. Visitors. A maximum of two (2) visitor permits shall be issued to
each residential unit requesting them for use only by visitors to
that residential unit. The visitor's permit shall be placed on the
driver's side dash of such visiting vehicle.
3. Nonresident Employees. To bona fide employees of the Borough of Little
Ferry, the Little Ferry Board of Education or any private employer
with places of employment within the Borough, upon presentation of
valid proof of employment, e.g., pay stub or letter on employer's
letterhead. Permits issued pursuant to this section will remain valid
for a period of two (2) years.
g. Parking Permit Fee. There shall be no fee for an initial parking
permit issued pursuant to this section. The fee for a replacement
parking permit due to a parking permit having been lost, stolen, placed
on a new vehicle or otherwise, shall be five ($5.00) dollars per automobile.
h. Regulations Not Exclusive.
1. The provisions of this section imposing a time limit on parking shall
not relieve any person of the duty to observe other and more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles set forth in N.J.S.A. 39:4-138.
2. The provisions of Section
7-15, Parking Prohibited During Certain Hours on Certain Streets, shall remain in effect and the possession of a parking permit shall not be a defense to a violation of this section.
3. The creation of a residential parking permit shall have no effect
upon metered parking spaces or business parking areas within designated
areas. Parking metered spaces shall be available to all vehicles with
or without a residential permit. A residential parking permit shall
not exempt a resident when parked in a metered space, from purchasing
time from the meter at the established rate.
i. Violations and Penalties. Any person who violates any provision of
this section, shall, upon conviction thereof, be punished by a fine
in the amount of thirty-five ($35.00) dollars. A separate offense
shall be deemed committed on each day during or on which a new violation
occurs or continues.

h. Statutory Authority. In accordance with the provisions of N.J.S.A.
39:4-197, 39:4-197.6, 39:5a-1, 39:5a-4, and 40:48-2.46, the following
regulations apply to parking spaces reserved for handicapped persons.

1. Definitions. Whenever any words and phrases are used in this section,
the meanings respectively ascribed to them in N.J.S.A. 39:4-204 through
N.J.S.A. 39:4-207.8 shall be deemed to apply to such words and phrases
used herein.
i. Identification of Spaces. Each space or group of spaces shall be
identified with a clearly visible sign. The signs shall be posted
and maintained and the signs shall conform to regulations adopted
by the Motor Vehicle Commission and/or be in conformance with N.J.S.A.
39:4-198 and other relevant statutes.

j. Parking Reserved for Handicapped Persons. No person shall park, stop
or stand a vehicle in the locations reserved for handicapped parking
except those persons who have been issued a special vehicle identification
card by the Motor Vehicle Commission pursuant to N.J.S.A. 39:4-205
or those persons who are transporting a handicapped person and is
utilizing the handicapped parking space for the benefit of the handicapped
person and then only when using a motor vehicle on which there is
displayed a certificate, or handicapped license plate, for which a
special vehicle identification card has been issued pursuant to N.J.S.A.
39:4-206.

k. Removal of Unauthorized Vehicles. Any motor vehicle which is parked
unlawfully in a parking space which is restricted for use by a handicapped
person may be removed and stored at the request of a police officer.
It shall be the obligation of the owner of the motor vehicle to pay
the reasonable costs of removal and storage which may result from
the removal.

l. Violations and Penalties. The penalties for violations of the handicapped
parking section of these regulations shall be liable to a fine of
two hundred fifty ($250.00) dollars for the first offense and, for
subsequent offenses, a fine of at least tow hundred fifty ($250.00)
dollars and up to ninety (90) days community service on such terms
and in such form as the court shall deem appropriate, or any combination
thereof.

m. Signs, Pavement, Markings, Installation and Maintenance. The owners
of the premises referred to in paragraphs c, d and g shall provide
and install signs and pavement markings for each parking space reserved
for the use of handicapped persons, which signs and markings shall
be in accordance with the Manual on Uniform Traffic Control Devices
for Streets and Highways. The cost of procurement and installation
of the signs and pavement markings shall be the responsibility of
the owner of the property. The owner shall, subsequent to initial
procurement and installation, maintain such signs and pavement markings
in good condition at no cost or expense to the Borough of Little Ferry.
The owner shall be responsible for the repair and restoration or replacement
of same.

Municipal Building Lot
|
1. One (1) space marked "Borough Administrator"
on the east side of the lot and contiguous to the three (3) "30-minute"
parking spaces.

the use of Borough employees and the use of the general public for
the purpose of visiting or otherwise conducting business at Borough
Hall.

1. All library employees shall not park in the library
lot while working and shall utilize available spaces in the Municipal
Parking Lot or Public Street so as to ensure the available spaces
in the library lot are available for the residents and patrons of
the Little Ferry Free Public Library.

for the parking space immediately adjacent to the north side of the
island.
