The purpose of this chapter is to establish a schedule of miscellaneous fees for a variety of duties, services and materials that are performed or provided by the borough officials to the public and not otherwise established in this Code.

The following fees are established and shall be paid by the applicant for such service or materials:
a. 
Notices—Agenda (by Mail).
1. 
Annual notice of regular meetings (or revisions thereto): one ($1.00) dollar.
2. 
Forty-eight (48) hour advance written notice of nonregular meetings: ten ($10.00) dollars.
3. 
Notice of special, rescheduled or emergency meetings: ten ($10.00) dollars.
4. 
Agendas: per meeting, two ($2.00) dollars, annual fee, forty ($40.00) dollars.
b. 
Copies (In Person and by Mail).
1. 
Official minutes of regular and special open meetings (or revisions thereto): $.05 cents per page for letter size and $.07 per page for legal size paper.
2. 
All other copies (except oversized documents requiring outside copying or special handling): $.05 per page for letter size and $.07 per page for legal size paper.
Copies in Person:

Copies by Mail:
$.05 per page for letter size plus postage
$.07 per page for legal size plus postage

The fee for any oversized documents or documents requiring outside copying or special handling shall be the actual cost of copying, plus applicable postage and handling not to exceed ten (10%) percent of the actual copying charge or ten ($10.00) dollars, whichever is greater.

Map Copies:
(a) 
Eight (8) inches by eleven (11) inches: $.05 cents per page plus the cost of postage and handling.
(b) 
Eight (8) inches by fourteen (14) inches: $.07 cents per page plus the cost of postage and handling.
(c) 
Eleven (11) inches by seventeen (17) inches: $.10 cents per page plus the cost of postage and handling.
5. 
The fee for computer disk copies of recordings of Borough Meetings shall be two ($2.00) dollars per disk.
c. 
Searches.
1. 
Assessment Search (per block and lot): ten ($10.00) dollars.
2. 
Tax Search (per block and lot): ten ($10.00) dollars.
3. 
Continuation Search (per year up to three (3) years from the date of the original search: two ($2.00) dollars per year.
d. 
Police Reports.
1. 
Motor vehicle accident reports:
(a) 
In person: $.05 cents per page for letter size
$.07 cents per page for legal size
(b) 
By mail: $.05 cents per page plus postage.
(c) 
$.07 cents per page plus postage.
2. 
Investigations/incident reports subject to and in accordance with Flemington Borough Police policy for release of information.
(a) 
Victims: $.05 cents per page for letter size.
(b) 
Discovery/civil/insurance requests: twenty-five ($25.00) dollars plus two ($2.00) dollars per photo duplicated.
3. 
Noncurrent information: general research of public of subpoenaed information or noncurrent information and comments and/or information to be reviewed and copied (applicant to be advised in advance and deposit will be required based on estimated time and cost): Twenty ($20.00) dollars per hour (with a one (1) hour minimum), plus actual copy costs.
4. 
Duplicates.
(a) 
Audio duplicate of tape (per tape): Twenty-five ($25.00) dollars.
(b) 
Video duplicate of video recorded proceedings: one hundred ($100.00) dollars.
e. 
Certification of Documents.
1. 
Certification of Documents: the charge shall be five ($5.00) dollars.
2. 
Certified copies (raised seal): a fee of ten ($10.00) dollars per copy will be charged for Registrar of Vital Statistics.
f. 
Duplicates.
1. 
Tax Bills.
(a) 
First duplicate copy: five ($5.00) dollars.
(b) 
Each additional duplicate copy, which may be requested in the same tax year: twenty-five ($25.00) dollars.
The above set forth fees to be charged may, at the discretion of the Tax Collector, be assessed to a mortgagee, servicing organization or property tax processing organization as such terms are defined in P.L. 1990, Chapter 69, N.J.S.A. 54:4-dd, and upon such request for said duplicate tax bill made in writing to the Tax Collector.
g. 
Certified Property Owners List. Within two hundred (200) feet of a single block and lot: ten ($10.00) dollars.
h. 
Miscellaneous Documents and Research.
1. 
Zoning map: five ($5.00) dollars.
2. 
Development Ordinance: twenty-five ($25.00) dollars.
3. 
Master Plan or Master Plan Draft: thirty ($30.00) dollars.
4. 
Historic District Design Guidelines: fifteen ($15.00) dollars.
i. 
Returned Checks.
1. 
There is established a service charge of thirty ($30.00) dollars per check or other written instrument returned for insufficient funds.
(a) 
The service charge shall be paid in cash immediately;
(b) 
The service charge shall be added to any account owing to the borough if payment tendered on the account was by a check or other written instrument which was returned for insufficient funds; or
(c) 
Whenever an account owing to the borough is for a tax or special assessment, the service charge shall be included on any list of delinquent accounts prepared for the enforcement of the lien.

The service charge authorized by this subsection shall be collected in the same manner prescribed by law for the collection of the account for which the check or other written instrument was tendered. The borough, through the Chief Financial Officer, may require future payments to be tendered in cash or by certified or cashier's check.
j. 
Subpoena of Borough Employees. (Where borough or employee is not party to the suit):
1. 
All payments required hereunder shall be made in advance of the actual date of the appearance. Payments shall be made for an entire day's appearance without any prorating for the actual hours spent in traveling to or from the place of appearance or the actual time spent in depositions, court appearances, etc.
2. 
Any subpoena which is issued and places an employee on call shall be billed and paid in advance at the same rate as though an actual appearance was required.
3. 
In the event that advance payment has not been made for an actual or on call appearance, the employee shall not be scheduled nor be available for the appearance noticed, and a copy of the requirements of this provision shall be provided to any party making an inquiry or issuing a subpoena.
(a) 
Police officers: (appearances shall be subject to availability of sufficient back-up officers so as to insure borough police coverage to protect public health, safety and welfare), the party issuing the subpoena shall pay the borough a sum equal to one and one-half (1 1/2) times the police officer's total daily compensation for each day, or part thereof, of the officer's appearance.
(b) 
All other borough employees: the party issuing the subpoena shall pay to the borough a sum equal to the borough employee's total daily compensation for each day, or part thereof, of the borough employee's appearance.
k. 
Facsimiles. A charge of one ($1.00) dollar per page shall be paid in advance or by invoice to the requesting party, in addition to any other charges established in this section.
l. 
Transcripts. Transcript fees: five ($5.00) dollars per page of original transcript document; copies of original transcript shall be in accordance with paragraph b, 2 of this subsection.
m. 
Noncurrent Information. General research of public or subpoenaed information and documents, and/or information to be reviewed and copies (applicant to be advised in advance and deposit will be required based on estimated time): twenty ($20.00) dollars per hour (with a one (1) hour minimum), plus actual copy costs of this subsection.
n. 
Registrar Fees.
1. 
Death Certificates are $25 each for the first copy. Each copy thereafter is $5 each.
2. 
Birth and Marriage Certificates are $25 each for the first copy. Each copy thereafter is $5 each.

When any fees herein described are at anytime at variance with fees for said services or materials as prescribed by the Revised Statutes of New Jersey, the fees prescribed by the statute shall govern.
