Conservation of recyclable materials is now a necessity in order
to conserve our material resources; and the cost of solid waste disposal
is increasing while convenient landfill facilities are rapidly decreasing.
The reduction of the amount of solid waste to be disposed of will
reduce the cost of landfill disposal fees and extend the life of landfills,
and at the same time the separation, collection, and sale of recycling
materials will be additional environmental financial benefit.

The following words and phrases shall have the following meaning:
ALUMINUM
Shall mean all aluminum beverage containers.
BATTERIES
Shall mean dry cell batteries such as radio, toy, watch or
calculator batteries.
CORRUGATED CARDBOARD
Shall mean paper cartons, sheets, spacer material or any
other container consisting of two (2) layers of brown paper separated
by an inner rippled core.
GLASS
Shall mean all glass bottles and jars of any color, thoroughly
rinsed with caps and closures removed.
MIXED PAPER
Shall mean all magazines, glossy inserts, computer paper,
colored paper, catalogs, store fliers with mailing labels, office
paper, hardcover books with hard covers removed, junk mail, writing
or school paper, envelopes, paperback books and copy paper.
NEWSPAPERS
Shall mean all paper of the type commonly referred to as
news print and distributed at stated intervals, usually daily or weekly,
having printed thereon news and opinions, containing advertisements
and other matters of public interest. The term "newspapers" shall
also include inserts that come with the newspapers, such as comics,
colored store or grocery advertisements, TV and magazine sections
and glossy coupons.
PLASTIC
Shall mean plastic bottles or jugs bearing a "#1" or "#2"
in a recycling triangle, thoroughly rinsed with caps, lids or closures
removed.
RECYCLABLES
Shall mean the following mandatory items to be separated
from waste

RESIDENTIAL PROPERTY
Shall mean all single-family and multiple-family dwellings
or structures within the Borough of Peapack and Gladstone, including
townhouses, condominiums and apartments.
TEXTILES
Shall mean any clean clothing, drapes, curtains, sheets,
towels, belts, handbags or clean cloths at least fifteen inches by
fifteen inches (15" x 15") in size.

There is hereby established a program for mandatory separation
of the following recyclable materials in the Borough:

*These items to be collected at such time as the County of Somerset
has established a mechanism for doing so and promulgated standards
applicable thereto.

The occupant or owner of any residential dwelling or structure
within the Borough shall place for disposal, removal or collection
and the following named items in conformity with the following regulations:
a. Newspapers shall be secured in separate bundles not to exceed thirty-five
(35) pounds and shall not be contained in plastic bags.
b. Glass, aluminum, post-consumer plastic containers and steel cans
(cleaned, flattened with labels removed) shall be contained in recycling
buckets and may be mixed together but individual buckets may not exceed
fifteen (15) pounds. Glass bottles, jars and plastic containers should
have lids and neck rings removed and be reasonably clean of foreign
matter.
c. Corrugated paper should be broken down, stacked and tied in twenty-four
(24") inch-square bundles.
d. Household batteries shall be contained in zip-top plastic bags that
shall be placed beside your recycling bucket for collection.
e. Textiles are to be recycled as per the directions on the textile
bags supplied by Somerset County and placed at curbside for collection.

The owner, operator or occupant of any commercial, professional,
institutional or industrial establishment shall recycle material according
to the requirements under the Somerset County Recycling Amendment
of December 1985 and P.L. 1987 Chapter 102 and such other applicable
requirements as may hereinafter be adopted, including but not limited
to: post-consumer plastic containers, newspapers and magazines, glass
bottles and jars, aluminum beverage containers, corrugated cardboard
and office paper.

a. The collection, removal and disposal of recyclable materials shall
be supervised by the Borough or its designated agent, who shall establish
the time, method and routes of service.
b. All recycling buckets, newspapers, magazines and corrugated paper
shall be placed prior to collection between the curb and sidewalk
where they shall be readily accessible to the collector. Recycling
buckets, newspapers, magazines and corrugated paper shall be placed
outside prior to 12:00 noon of the day immediately preceding the day
of collection but not later than 7:00 a.m. on the day of collection.

All recyclable materials shall be brought to the municipal depot
in market ready condition. The depot shall be supervised by the Borough
or its designated agent, who shall establish the time and dates the
depot shall be opened.

It shall be a violation of this section for any person unauthorized
by the Borough to collect or pick up, or cause to be collected or
picked up, any such items during the twenty-four (24) hour period
commencing at 6:00 p.m. on any day preceding a day designated for
collection. Any and each such collection in violation hereof from
one (1) or more residences during the twenty-four (24) hour period
shall constitute a separate and distinct offense punishable as hereinafter
provided.

The Superintendent of Public Works is hereby authorized and
directed to enforce this section.

The Superintendent of Public Works or his designated agent shall
spot check on alternate pick up days to determine compliance.

Any person, firm or corporation that violates or neglects to comply with any provisions of this section or any regulation promulgated pursuant thereto shall, upon conviction thereof, be liable to the penalty stated in Chapter
1, Section
1-5.

Landfills which have accepted solid waste are fast being filled
up. Somerset County's Solid Waste Management Plan, as amended,
requires all municipalities in the County of Somerset to adopt an
ordinance requiring the separate disposal of leaves.
Be it resolved, by the Mayor and Borough Council:
a. Leaves. It is prohibited and will be deemed a violation hereof for
any owner, lessee or occupant of any residential, commercial or institutional
property in the Borough to put into or cause to be put into the solid
waste collection system of the Borough any leaves.
b. Enforcement. The Superintendent of Public Works hereby is authorized
and directed to enforce this section.
c. Violation and Penalty. Any person which violates or neglects to comply with any provision of this section or any regulation promulgated pursuant thereto shall, upon conviction thereof, be liable to the penalty stated in Chapter
1, Section
1-5.

It is prohibited and will be deemed a violation hereof for any
owner, leasee or occupant of any residential, commercial, institutional
or professional property in the Borough of Peapack and Gladstone to
put leaves, grass clippings or other vegetative debris onto or cause
to be put onto any municipal or county roadway within the Borough.

The Superintendent of Public Works and/or Police Department
is hereby authorized and directed to enforce this section.

Any person or other entity that violates or neglects to comply
with any provision of this section or any regulation promulgated pursuant
thereto shall, upon conviction thereof be punishable by a fine not
to exceed five hundred ($500.00) dollars.

The purpose of this section is to require dumpsters and other
refuse containers that are outdoors or exposed to stormwater to be
covered at all times and prohibits the spilling, dumping, leaking,
or otherwise discharge of liquids, semi-liquids or solids from the
containers to the municipal separate storm sewer system(s) operated
by the Borough of Peapack and Gladstone and/or the waters of the State
so as to protect public health, safety and welfare, and to prescribe
penalties for the failure to comply.

For the purpose of this section, the following terms, phrases,
words, and their derivations shall have the meanings stated herein
unless their use in the text of this section clearly demonstrates
a different meaning. When not inconsistent with the context, words
used in the present tense include the future, words used in the plural
number include the singular number, and words used in the singular
number include the plural number. The word "shall" is always mandatory
and not merely directory.
a. Municipal separate storm sewer system (MS4) shall mean a conveyance
or system of conveyances (including roads with drainage systems, municipal
streets, catch basins, curbs, gutters, ditches, manmade channels,
or storm drains) that is owned or operated by the Borough of Peapack
and Gladstone or other public body, and is designed and used for collecting
and conveying stormwater.
b. Person shall mean any individual, corporate, company, partnership,
firm, association, or political subdivision of this State subject
to municipal jurisdiction.
c. Refuse container shall mean any waste container that a person controls
whether owned, leased, or operated, including dumpsters, trash cans,
garbage pails and plastic trash bags.
d. Stormwater shall mean water resulting from precipitation (including
rain and snow) that runs off the land's surface, is transmitted
to the subsurface, is captured by separate storm sewers or other sewerage
or drainage facilities, or is conveyed by snow removal equipment.
e. Waters of the State shall mean the ocean and its estuaries, all springs,
streams and bodies of surface or groundwater, whether natural or artificial,
within the boundaries of the State of New Jersey or subject to its
jurisdiction.

Any person who controls, whether owned, leased, or operated,
a refuse container or dumpster must ensure that such container or
dumpster is covered at all times and shall prevent refuse from spilling
out or overflowing.
Any person who owns, leases or otherwise uses a refuse container
or dumpster must ensure that such container or dumpster does not leak
or otherwise discharge liquids, semi-liquids or solids to the municipal
separate storm sewer system(s) operated by the Borough of Peapack
and Gladstone.

This section shall be enforced by the Police Department and/or
the Stormwater Management Coordinator of the Borough of Peapack and
Gladstone.

Any person(s) who is found to be in violation of the provisions of this section shall be subject to the penalty stated in Chapter
1, Section
1-5 of the Code of the Borough of Peapack and Gladstone.
