The County of Albany is vitally interested in ensuring the timely and proper performance of all public works contracts and the promotion of labor relations in Albany County. In order to ensure the timely and proper performance of public works contracts and the promotion of labor relations, a policy must be established by the County of Albany with regard to its public works contracts.
Any person, firm, corporation, partnership or other entity (hereinafter "contractor"), as a prerequisite to the award of any public works contract by the County of Albany, shall agree that it will not intentionally engage in any course of conduct or activity, or employ for the purposes of performing the public work any subcontractors, employees, labor or materials, which will or may result in the interruption of the performance of the public work due to labor strife or unrest by workers employed by the contractor or by any of the trades working in or about the public works and/or premises where the work is being performed.
In awarding contracts for public works, the County of Albany shall consider the ability of the contractor to undertake the work without interruption due to labor strife or unrest.
Unless such contractor shall demonstrate to the satisfaction of the County of Albany that it will not intentionally engage in such conduct as aforesaid which will or may result in the interruption of the performance of the public work, then and in that event such public works contract shall not be awarded to such contractor.
