Albany County leases several properties as part of the operation
of providing services to Albany County residents. In order to ensure
that taxpayer dollars are spent in an effective manner, the Legislature
finds that County funds should not be paid to an entity that refuses
to act in a responsible manner by paying its taxes. The County Executive
has administratively directed that certain preventative steps be taken
pertaining to specific leases; however, as the policy-making body,
the Legislature is able to set standards for all future County leases
and renewals of existing leases. The Legislature wants to assure the
citizens of Albany County that County tax dollars will not be expended
to landlords who have not met their responsibilities by paying their
real estate taxes in a timely manner.
All properties which the County contemplates leasing or all
renewals of existing leases shall have a real estate tax search completed
indicating that no real estate taxes are owed by the landlord prior
to submitting an approval request to the Legislature.
The County Attorney shall include language in all proposed real
property leases and renewal leases that shall indicate that in the
event the landlord defaults on paying the required real estate taxes
during the term of the lease with Albany County, all future rents
paid by the County shall be deposited into an escrow account for the
purpose of paying said taxes.
