The Code described and commonly known as the "Swimming Pool Code of New Jersey — 1970" regulating the location, construction, bathing water quality, use and maintenance, the issuance of licenses and permits to locate, construct, and alter and fixing penalties for the violation thereof is hereby adopted pursuant to Sections 26:3-69.1 to 26:3-69.6 of the Revised Statutes of New Jersey. Three copies of such Code similarly marked so as to indicate plainly what portions of the Code, is less than the whole, is intended to be adopted, have been placed on file in the Office of the Health Officer and shall remain on file in such office for use and examination of the public.

Filing fee for permit to construct and locate: $100.
b. 
Filing fee for a license to alter: $100.
c. 
Fee for annual license to operate: $300.
d. 
Plan review: $150.

The "Swimming Pool Code of New Jersey — 1970" which this chapter adopts by reference, is hereby amended by the Montgomery Township Board of Health as set forth below:
a. 
Section 14.1 (General) is hereby amended to read as follows:
14.1 General — Swimming pools, when open for use shall, at all times, be under the supervision of a competent adult director 18 years of age or over, who shall be responsible for all phases of pool operation including the applicable provisions of this Code.
b. 
Section 15.5 of said Code is amended to read as follows:
15.5 Samples Not Meeting Standards — The administrative authority or its authorized agent shall obtain and have additional samples analyzed if those taken pursuant to Section 15.2 do not meet standards established by Section 15.4. The licensee shall be required to pay the full laboratory and delivery costs of any additional samples.
c. 
Section 12 of said Code is hereby amended by the addition of the following new Section 12:4:
12.4 Composition of Fixtures — The fixtures referred to in this section shall be constructed of china or such other materials acceptable to the administrative authority.

Any person violating any of the provisions of or any order promulgated under this Chapter or the "Swimming Pool Code of New Jersey — 1970" shall, upon conviction thereof, be liable to the penalty established in Chapter BH1, section BH1-2.
