No person may place a dumpster, demolition container or roll-off
container (hereafter referred to as "dumpster") on any public street
or public right-of-way in the Borough of Avon-by-the-Sea without first
obtaining a dumpster permit from the office of the Borough Clerk.
No person shall permit a dumpster to remain on any street or right-of-way
after the expiration date of said permit. Dumpster permits shall be
issued for a specified period and shall cover a particular dumpster
at a particular place. Fees for dumpster permits shall be twenty-five
dollars ($25) for the first seventy-two (72) hours and ten dollars
($10) for each day thereafter for a period not to exceed seven (7)
days. Any person seeking to extend such period beyond seven (7) days
may do so by filing a new application. A maximum of two (2) seven
(7)-day periods within a sixty (60)-day period may be granted upon
filing of the proper applications. Any person seeking to have permit
issued for a period in excess of said maximum period shall file an
application with the Borough Clerk citing such special circumstances,
whereupon the Board of Commissioners or their designee shall determine
whether or not such extra period shall be granted.
Permit applications shall be in writing and signed by the person
requesting such permit. The application shall set forth the location
of the proposed dumpster, the nature of the demolition, the reason
for its use and the estimated duration of the use of said dumpster.
All dumpsters shall have displayed in a conspicuous place on the
dumpster a copy of the permit authorizing its use. In addition to
permit being displayed, all dumpsters shall bear an identification
number assigned by the state and the name, address and telephone number
of the person responsible for the dumpster.
All dumpsters shall be equipped with suitable reflective or other
warning devices (such as flashers, etc.) of a type approved by the
Director of the Division of Motor Vehicles. Said reflectors or flashers
shall, at a minimum, be placed in the top corners of the dumpster
facing approaching and opposing traffic.
Any dumpster placed upon any public roadway or right-of-way within
the Borough shall be subject to inspection by the Borough Police Department
or the Code Enforcement Official. Any dumpster found not to conform
with the permit requirements or is placed or left in such a position
or state, so as to create a traffic hazard shall be considered a violation
of this section and shall be moved immediately by the owner of the
dumpster. If the owner does not immediately comply and the Police
Department believes that the dumpster creates a traffic hazard, it
may be removed by the police at the owner's expense.
The areas surrounding the dumpster shall be kept clean at all times.
The areas beneath and surrounding the dumpster shall be cleaned immediately
upon removal. Dumpsters shall not be filled higher than the height
of the sides and shall be covered once they are full and during transport.
Any person who violates any provision of this Article shall, upon conviction thereof, be liable to the penalty provided by Chapter 1, Section 1-15. Each day of violation shall be considered a separate violation.
