GARAGE SALE
All sales entitled "garage sale," "lawn sale," "attic sale,"
"rummage sale" or "flea market sale" or any similar casual sale of
tangible personal property which is advertised by any means whereby
the public at large is or can be made aware of the sale.
PERSON
Individuals and/or household entity, partnerships, voluntary
associations and corporations.
No person shall conduct, hold, permit or allow any garage sale
or other similar activity upon residential property in the Borough
of Avon-by-the-Sea without complying with the provisions of this chapter
and without first obtaining a license therefor as required herein.
Upon making application to the Borough Clerk for a license,
the applicant shall pay a fee of five dollars ($5) The Clerk shall
thereupon issue the license which shall permit a garage sale at the
specific premises to be held within thirty (30) days and on not more
than two (2) consecutive dates within the said thirty (30) day period.
Not more than one (1) such license shall be issued to the same person
or premises per calendar year. The license shall be prominently posted
at the premises during the sale.
All such garage sales shall be conducted between the hours of
9:00 a.m. and 5:00 p.m.
All signs and display tables or other equipment used in the
conduct of the sale shall be removed within twenty-four (24) hours
after completion of the sale. Off-premises signs of any type are not
allowed.
No display of items for sale at any garage sale shall be displayed
on the sidewalk or in that area between the residence of the applicant
and the sidewalk, but shall be displayed behind the building line
of the premises at which the garage sale is to be held.
The person to whom such license is issued and the owner or tenant
of the premises on which such sale is conducted shall be jointly and
severally responsible for the maintenance of good order and decorum
on the premises during all hours of the said sale. No such person
shall permit any loud or boisterous conduct on the premises nor permit
vehicles to impede the passage of traffic on any roads or streets
in the area of such premises. All such persons shall obey the reasonable
order of any member of the police or fire departments of the Borough
in order to maintain the public health, safety and welfare.
Nothing contained in this chapter shall be construed to authorize
any violation of other provisions of this Code or other applicable
law.

Any person who violates any provision of this chapter shall, upon conviction thereof, be liable to the penalty provided by Chapter
1, Section
1-15. Each day that a violation continues shall be deemed a separate violation.
