When signs are erected in each block giving notice thereof,
no person shall park a vehicle at such places and during the times
designated by the City.

A. Alleys: No person shall park a vehicle within an alley except for
the purpose of loading and unloading merchandise and then in such
a manner or under such conditions as to leave available not less than
10 feet of the width of the roadway for the free movement of vehicular
traffic, and no person shall stop, stand or park a vehicle within
an alley in such a position as to block the driveway entrance to any
abutting property.
B. Vehicles For Sale; Selling Merchandise From Vehicles; Vehicles Without
Plates: It shall be unlawful to park any vehicle upon any street for
the purpose of displaying it for sale or to park any vehicle upon
any business street from which vehicle merchandise is peddled, or
to park any vehicle upon any street without state license plates upon
it issued for such vehicle to the owner of the vehicle in accordance
with the Illinois Compiled Statutes.
C. Private Property: It shall be unlawful to park any motor vehicle
on any private property without the consent of the owner of the property.

A. Definitions:
OFFICIAL SIGN
Any sign erected on public or private property which complies
with regulations promulgated by the City of Le Roy for the erection
and maintenance of signs and with the requirements of 625 Illinois
Compiled Statutes 5/11-301, as may hereafter be amended, revised or
recodified for designating the reservation of parking spaces for persons
with disabilities.
PERSON WITH DISABILITIES
A natural person who, as determined by a licensed physician:
1.
Cannot walk 200 feet without stopping to rest;
2.
Cannot walk without the use of, or assistance from, a brace,
cane, crutch, another person, prosthetic device, wheelchair, or other
assistive device;
3.
Is restricted by lung disease to such an extent that his forced
(respiratory) expiratory volume for one second, when measured by spirometry,
is less than one liter, or the arterial oxygen tension is less than
60 mm/Hg on room air at rest;
5.
Has a cardiac condition to the extent that the person's functional
limitations are classified in severity as Class III or Class IV, according
to standards set by the American Heart Association; or
6.
Is severely limited in the person's ability to walk due to an
arthritic, neurological, or orthopedic condition.
B. Scope: The parking privileges granted by this section are strictly
limited to the person to whom the special license plate, special decal
or card were issued and qualified drivers of motor vehicles who are
acting under the express direction of the person with disabilities
to whom the special license plate, special decal or card were issued
and while the person with disabilities is present.
C. Parking Places Designated:
1. Public Spaces: Public parking spaces for handicapped persons shall
be designated by City ordinance. As of the effective date hereof,
handicapped parking spaces are hereby designated as follows:

East Center Street, 1 space being the furthest east space on
the north side in the block of said street located between North Chestnut
and North East Street, at the northwest quadrant of the intersection.

East Center Street, 1 space being the furthest west space on
the south side at the intersection of Chestnut and Center Streets,
on the southeast quadrant of the intersection.

Kiwanis Park, 1 space being the furthest parking space to the
north in the 100 block of East Center Street in the parking area northeast
of Kiwanis Park, between the intersection of East Center Street and
North Main Street.

Le Roy municipal building parking lot, 207 S. East Street, 1
space being the first space on the south side of the drive near the
East Street entrance to the property.
|
North Main Street, 1 space being the first parking space in
the 100 block on the east side, immediately north of the intersection
of Center and Main, on the east side of North Main in the first block
north of Kiwanis Park.

South Chestnut Street, 1 space being the closest parking space
north of the alley located between Center Street and Pine Street in
the 100 block of South Chestnut Street on the west side of South Chestnut
Street.

South Chestnut Street, 1 space being the furthest north space
on the east side at the intersection of Chestnut Street and East Center
Street, on the southeast quadrant of the intersection.

Spiritualist Church, 102 South Pearl Street, 1 space in front,
the north most boundary line of said space being 52 feet south of
the south right of way line of East Center Street, measured from the
intersection of the south right of way line of East Center Street
and the east right of way line of South Pearl Street.

Town Hall Building, 111 East Center Street, 1 space being the
first space nearest the front of the building on the east end of the
available parking spaces located on the south side of Kiwanis Park
and Center Street in block 18.

West Center Street, 1 space being the last parking space in
the 200 block on the west side, immediately north of the intersection
of Center and Main, on the west side of North Main in the first block
north of Kiwanis Park.

2. Public Parking Lots: The City may designate certain on street and
certain off street parking spaces in municipal parking lots as being
reserved for use only by persons with disabilities by posting each
such parking space with an official sign which so reserves such parking
space pursuant to the laws, rules and regulations which apply thereto.
When these parking spaces are so signed, it shall be illegal for any
person to park a vehicle in the parking space reserved in this manner
for persons unless such vehicle has a license plate or decal or card
indicating use in compliance with this section and state law. When
not with a person with disabilities, it shall be illegal for any person
at any time to park any such licensed vehicle in a space designated
as being reserved for persons with disabilities or to use a decal
or card of a person with disabilities to park any vehicle at any time
in such a reserved space.
3. Private Parking Lots: Parking spaces on private parking lots may
be reserved by the owner of the parking lot for use only by persons
with disabilities. Such spaces shall be marked for reserved use by
persons with disabilities by posting each such parking space with
an official sign which so reserves each parking space pursuant to
the laws, rules and regulations of both the state and the City which
apply thereto. When these parking spaces are so signed, then it shall
be illegal for any person to park a vehicle in a parking space reserved
in the manner for persons with disabilities unless such vehicle has
license plates indicating that the vehicle is registered to a person
with disabilities or unless a legal decal or card is being properly
used indicating that the vehicle is then being used by a person with
disabilities who is qualified to have such license plates or decal
or card. It shall be illegal for any person to park any such licensed
vehicle in a space on a private parking lot which is designated as
being reserved for persons with disabilities or to use a decal or
card of a person with disabilities to park in such a reserved space
when not with the person with disabilities.
D. Application Of Parking Regulations To Persons With Disabilities:
A motor vehicle bearing license plates issued to a person with disabilities
or a special decal or card issued to a person with disabilities or
a motor vehicle registered in another jurisdiction upon which is displayed
such license plates, a special decal or card issued by the other jurisdiction
designating that the vehicle may be operated by or for a person with
disabilities shall be exempt from any statute or ordinance imposing
time limitations on parking when the person with disabilities is present.
All drivers and owners of such vehicles shall be subject to the laws
that prohibit parking in zones in front of or near fire hydrants,
driveways, public building entrances and exits, bus stops, loading
areas and all other locations where parking is prohibited whether
only by laws which prohibit parking in specified types of locations
at all times, during certain hours or times, or for limited types
of vehicles, or also by signs which prohibit such parking. Each such
vehicle is also prohibited from parking when the motor vehicle constitutes
a traffic hazard, and it shall be illegal for any person not to promptly
move such vehicle at the instruction or request of a law enforcement
officer to a legal location at the choice of the driver or to a location
designated by the officer.
E. Enforcement Of Provisions: Any person or local authority owning or
operating any public or private off street parking facility in the
City may, after notifying the Le Roy police department, remove or
cause to be removed by towing to the nearest garage or other place
of safety any vehicle parked within a space reserved for use by persons
with disabilities which does not display registration plates or a
special decal or card for persons with disabilities as required by
this section. The erection of an official sign on private property
specifically reserving any parking place for use by a person with
disabilities shall be deemed authorization for the City to enforce
such parking prohibition. The City street superintendent shall cause
to be maintained an official inventory of private parking places complying
with this section.
F. Permitting Violations: No person shall directly or indirectly permit
any vehicle owned by such person to be used in any manner so as to
violate any of the provisions of this section.
G. Penalties: Any person found guilty of violating any provision of this section shall be subject to penalty as provided in Title 1, Chapter
1-4, of this Code for each violation. Such penalty shall be in addition to any costs or charges connected with the removal, towing, and/or storage of any motor vehicle authorized under this section. A separate offense shall be deemed committed for each 1/2 hour any person permits a motor vehicle to remain parked in violation of this section.

The Police Chief may determine the location of loading zones
and shall erect or maintain or cause to be erected or maintained appropriate
signs indicating the same. It shall be unlawful to stop, stand or
park a vehicle for a period of time longer than necessary for the
unloading and delivery or pick up of materials in any place marked
as a loading zone.

A. Parking Time Limited; Exceptions: It shall be unlawful to park any
vehicle on any block of a public street or within any portion thereof
in excess of the amount of time designated by ordinance for said block
and so posted. This subsection, except time limitations of 1/2 hour
or less, shall not apply to motor vehicles bearing registration plates
or decals issued to a person with disabilities when such vehicle is
operated by such person with disabilities or is operated under the
express direction of such person with disabilities while he is present.
The moving of a vehicle unlawfully parked due to exceeding the time
limits as designated by ordinance and so posted from one area of said
block to another area thereof shall not constitute either abatement
of the unlawful parking time or commencement of a new and lawful parking
time.
B. Fine: In the event of a violation of Subsection
A of this section, the fine shall be as stated in Subsection 1-4-3B4 of this Code.
C. Violation; Penalties: In addition to the foregoing, any person found
guilty of violating, disobeying, omitting, neglecting or refusing
to comply with, or resisting or opposing the investigation or enforcement
of any of the provisions of this section, upon conviction thereof,
shall be punished by a fine of not less than $50 nor more than $500;
provided, however, that all actions seeking the imposition of fines
only shall be filed as quasi-criminal actions subject to the provisions
of the Illinois civil practice act. In the alternative, such offense may be punishable as
a misdemeanor by incarceration in the county jail for a term not to
exceed six months; provided, however, actions seeking incarceration
shall be filed under the procedures set forth in the Illinois municipal
code and under the provisions of the Illinois code of civil procedure. A separate and distinct offense shall be regarded as committed
each day upon which said person shall continue any such violation,
or shall permit any such violation to exist after notification or
knowledge of the existence thereof.

The fact that a vehicle is registered in a person's name shall
be prima facie proof that such person was responsible for any violation
of any parking regulation involving such vehicle.
