The Township of Wayne shall adopt by reference the regulations
as set forth in N.J.A.C. 7:9A et seq.
The construction or installation of any privy or privy vault
within the Township is prohibited unless special approval therefor
is first obtained from the Department of Health. Such permission shall
be granted only if a health hazard will not result from its installation
and use and upon such terms and conditions as the Department may direct.

A.
No person shall construct, reconstruct, alter or extend, or cause
to be constructed, reconstructed, altered or extended, in the Township
any individual sewage disposal system or part thereof unless a permit
therefor has first been obtained by the contractor from the Department
of Health as hereinafter provided. All permits issued under this section
shall expire 6 months from the date of issuance.
B.
A permit to alter, repair or construct an individual sewage disposal
system or part thereof shall not be used unless the contractor provides
proof of the following:
1.
A current and valid N.J. Home Improvement Contractor License;
2.
Certifications:

(a)
An authorized installer shall, upon request, provide the Department
or the administrative authority with written evidence from those manufacturers
and/or system integrators certifying that the installer has sufficient
knowledge to install the proprietary technologies in accordance with
all manufacturer specifications and this rule pursuant to N.J.A.C.
7:9A-8.3, 9.8 and 10.8, as applicable.
(b)
An authorized service provider shall, upon request, provide
the Department or the administrative authority with either:
(1)
Written evidence from manufacturers and/or system integrators
certifying that the service provider is sufficiently knowledgeable
to provide maintenance services on the proprietary technologies in
accordance with all manufacturer specifications and this section pursuant
to N.J.A.C. 7:9A-8.3 and 10.8, as applicable; or
(2)
An S2 or higher public wastewater treatment system operator
license from the Department issued pursuant to N.J.A.C. 7:10A.
(c)
An authorized service provider who holds an S2 or higher public
wastewater treatment system license but is not authorized by the manufacturer
and/or system integrator, as applicable, shall meet all applicable
requirements of N.J.A.C. 7:10A when performing maintenance on any
advanced wastewater pretreatment unit or drip dispersal system, in
addition to all applicable requirements of this chapter.
3.
All other current valid licenses and certifications required for
the system proposed in accordance with N.J.A.C. 7:9A et seq.
C.
Contractor must complete all work in accordance with N.J.A.C. 7:9A
et seq. within 30 days of the system being backfilled. Should the
contractor fail to do so, he/she shall be subject to a penalty of
$10.00 per day payable weekly to the Township of Wayne for each day
beyond 30 days that the work remains incomplete.
A.
No person shall engage in the business of emptying or cleaning any
individual sewage disposal system or part thereof without first registering
with the N.J. Department of Environmental Protection.
A.
Approval of an individual sewage disposal system shall not become
effective until the designing engineer provides two sealed as-built
drawings and two sealed certificates of compliance to the Department
of Health.

B.
The designing engineer must provide the documents referred to in
paragraph A within 30 days of the system being backfilled. Should
the engineer fail, the engineer shall be subject to a penalty of $10.00
per day payable weekly to the Township of Wayne for each day beyond
30 days that he/she has not provided the required documents as referred
to in paragraph A.
