No dog owner shall permit a dog to soil, defile, defecate on
or commit any nuisance on any common thoroughfare, sidewalk, passageway,
by-path, play area, park, or any place where people congregate or
walk, or upon any public property whatsoever, or upon any private
property without the permission of the owner, without having such
feces immediately removed and disposed of by the dog owner by any
sanitary method approved by the Animal Control Officer.

Such license may be issued by the Board of Health upon payment
of a fee of $5 annually and shall expire on February first annually,
or prior thereto, if the premises licensed shall be converted to a
use other than that provided in this chapter, or if the license is
revoked for cause. Application for such license shall be made upon
blanks furnished by this Board.

The Board of Health shall have the right to revoke, after five
days' written notice is given, any permit or license whenever
the holder thereof or any of his employees violate any of the provisions
of this chapter or the rules and regulations of this Board, or where
a nuisance is caused by the keeping, raising, harboring or maintaining
a pig or pigs.

When any person, firm, corporation, partnership or association
of persons shall violate any of the provisions of this chapter, each
day upon which such violation occurs shall be deemed to constitute
a distinct and separate offense.

The Board of Health or its Health Officer shall have the right
to inspect, as often as is reasonably necessary, all premises where
pigs are kept, raised, harbored or maintained and all premises wherein
the Health Officer has reason to believe that pigs are kept, raised,
harbored or maintained, and the Board of Health or Health Officer
shall have full and free access to all buildings, yards and places
of every kind and character and shall have power to enter and inspect
the premises used in connection with any such buildings, yards or
places for such purpose.

The Board of Health shall have the right to waive or to make
exceptions or modifications to the provisions of this chapter as they
may deem advisable and to adopt any rules or regulations they may
deem necessary for the protection of health.
Any person who violates any provision of this chapter shall be liable, upon conviction, for the penalty stated in Chapter BHI, Section
BH1-2.
