As used in this article, the following terms shall have the meanings indicated:
FARMER'S MARKET
A farmer's market is a public and recurring assembly of farmers or their representatives selling food grown, raised and/or harvested or prepared, produced and/or packaged from the food grown, raised or harvested by the farmer directly to consumers.
A. 
It shall be unlawful for any person(s), organizations, groups or any corporate body which is sponsoring, promoting and/or organizing a farmer's market as defined in this article to do so without first having procured a permit from the Health Officer or designee, or to conduct said activities without complying with any or all of the provisions concerning the layout, construction, operation and maintenance of the same as contained in N.J.A.C. 8:24-1.1 et seq.
B. 
No farmers or their representatives may participate, sell, carry on, conduct or operate within the permitted farmer's market without first obtaining a farmer's market vendor's license therefor from the Health Officer or designee.
C. 
The annual license fee to be paid for a farmer's market permit shall be as provided in Chapter 75, Fees. The annual fee shall be waived for those farmer's market permit applicants which are bona fide civic and/or religious nonprofit organizations.
D. 
The annual license fee to be paid for a farmer's market vendor's license shall be as provided in Chapter 75, Fees. The licensing requirements and fees set forth in this article shall be waived for those farmer's market vendors who sell only fresh, whole, uncut produce or are bona fide civic and/or religious nonprofit organizations.
E. 
The Farmer's Market Permit and the Farmer's Market Vendor's licenses granted by the Health Officer shall expire on the 31st day of December of each year.
F. 
The farmer's market permit shall authorize the operation of the market for an unlimited, but pre-scheduled, pre-approved number of days, dates and times within the annual permit period.
G. 
The farmer's market vendor's license shall authorize a vendor to participate and operate within the approved market for an unlimited, but pre-scheduled, pre-approved number of days, dates and times within the annual license period.
A. 
Application for a farmer's market permit shall be submitted on forms to be furnished by the Health Officer. The application shall be accompanied by:
(1) 
The permit fee in cash, check or money order.
(2) 
A floor plan or layout of the location of the farmer's market.
(3) 
Sponsor's and/or organizer's business/organization name, address, phone number, email address and name of contact person.
(4) 
A list of all participating farmer's market vendors complete with the business name, address, phone number, email address and name of contact person.
(5) 
If an outdoor event, a copy of the outdoor activity license issued by the Township Clerk's Office.
A. 
Application for a farmer's market vendor's license shall be submitted on forms to be furnished by the Health Officer. The application shall be accompanied by:
(1) 
The license fee in cash, check or money order.
(2) 
The vendor's business/organization name, address, phone number, email address and name of contact person.
(3) 
All required documentation specified on the license application.
(4) 
Letter verifying approval from the event organizer and permit holder to attend the event.
A. 
The granting of a farmer's market permit shall be by the Health Officer or designee.
B. 
The permit shall state:
(1) 
Date of issuance.
(2) 
Name of business or organization applying.
(3) 
Purpose for which issued.
(4) 
Address/location of the farmer's market.
(5) 
Dates the farmer's market will be operating at the address/location.
C. 
The term of the permit shall be for one year commencing on January 1 and expiring December 31.
D. 
The farmer's market permit shall only be valid for a single, multidate event conducted at the same address/location by the applicant.
A. 
The granting of a farmer's market vendor's license shall be by the Health Officer or designee.
B. 
The license shall state:
(1) 
Date of issuance.
(2) 
Name of licensee.
(3) 
Purpose for which issued.
(4) 
Address/location of licensed vendor's operation.
(5) 
Dates the licensed vendor will be operating at the market.
C. 
The term of the license shall be for one year commencing on January 1 and expiring December 31.
D. 
The farmer's market vendor license shall only be valid for a single, multidate event at the same address/location conducted by the same sponsoring organization to which a farmer's market permit has been issued.
A. 
A farmer's market permit issued under this article shall not be transferable to any other person, organization, group or corporate body and is not valid at any other address/location.
B. 
A farmer's market vendor's license issued under this article shall not be transferable to any other person, organization, group, business or corporate body and is not valid at to any other location.
C. 
The issued farmer's market permit shall be conspicuously displayed at all times on the premises of the event.
D. 
The issued farmers market vendors' licenses shall be conspicuously displayed at all times by the vendors at the vendors' assigned locations within the market.
A. 
The permitted premises shall be kept clean at all times, and the permittee shall comply with all of the laws of this state, all Township ordinances and all state and Township rules and regulations with respect to health and sanitation.
B. 
The vendor licensee shall keep their assigned location clean at all times, and the licensee shall comply with all the laws of this state, all the Township ordinances and all state and Township rules and regulations with respect to health and sanitation.
When no other penalty is prescribed by law, any person who violates any provision of this article shall, upon conviction, be liable to the penalty stated in Chapter 1, § 1-15.
