The purpose of this chapter is to provide for the public filing of notices of violations of Town ordinances, local laws, rules and regulations.
Where a violation of a Town ordinance, local law, rule or regulation is determined to exist, the individual or officer of the Town of Hillsdale charged with the enforcement of such ordinance, local law, rule or regulation shall cause a notice of said alleged violation to be mailed to the individual, firm or corporation violating the same by certified mail, return receipt requested. Said notice shall contain a description of the violation, together with the date by which the violation is required to be remedied.
In the event that the individual, firm or corporation served with the notice of violation shall fail to remedy the same within the time period set forth in said notice, the individual or officer of the Town of Hillsdale charged with the enforcement of such ordinance, local law, rule or regulation shall then be authorized to file a notice of said violation in the office of the Columbia County Clerk, where the same shall be indexed against the name of the individual, firm or corporation in the miscellaneous records of said County Clerk's office.
Any party who deems himself aggrieved by the receipt of the notice of violation may petition to the appropriate appeal board set forth in the notice of violation for a review of the same. Such petition shall be filed with the Town Clerk within five days of the receipt of the notice of violation and shall fully set forth the grounds of the grievance. The reviewing board shall hold a hearing upon said grievance and notice of such hearing shall be mailed to the party at least five days prior to the hearing. The filing of a review petition shall stay the filing of the notice provided for under § 57-3 of this chapter, pending the decision of the reviewing board which decision shall be final and conclusive.
The filing of the notice of violation provided for under this chapter shall be in addition to any other enforcement remedies existing in favor of the Town of Hillsdale with respect to its ordinances, local laws, rules and regulations.
This chapter shall take effect immediately.
