The Borough of New Milford hereby establishes Chapter BH13, Cigarette Vending Machines Prohibited, as a new chapter in the Health Code of the Borough of New Milford.

In view of the indiscriminate sales of cigarettes to minors by automatic vending machines, all cigarette vending machines are hereby prohibited in the Borough of New Milford.

Any person owning, operating, renting or permitting the use of a cigarette vending machine on premises under his or her control shall be subject to a fine as set forth in the General Penalty Section 1-5 of the Code of the Borough of New Milford. Each day on which such a machine is owned, operated, rented or permitted on the premises shall result in an additional fine.

Every store which sells cigarettes or other tobacco products shall be required at the checkout counter to place a sign reminding both the customer and the employee of the store of the law which makes it illegal to sell tobacco products to anyone under the age of 19 or such age as the state law so designates.

All self-service displays for tobacco products, including cigarettes and snuff, are prohibited. All tobacco products must be dispensed to the customer by the clerk from a rack behind the counter.

It shall be prohibited to sell single cigarettes to any persons under the age of 19 or such age as the state law so designates.
