Pursuant to N.J.S.A. 40A:9-136 et seq., there is hereby created the Office of Township Administrator to perform those duties as set forth in the statutes of the State of New Jersey and this section.

The Township Administrator shall be appointed by a majority vote of the Township Committee. Any vacancy which may occur in said position, whether the same occurs by death, resignation, or otherwise, shall be filled in the same manner.

a. 
The appointment of a Township Administrator shall be solely based on the administrative qualifications of the appointee, with special regard as to education, training and actual experience in governmental affairs.
b. 
No member of the governing body or any other federal, state, county, or municipal elected office, including boards of education, shall be eligible for appointment as Township Administrator during his/her term in said office nor within two years after separation from said office, whether the same occurs by expiration of term, resignation, or otherwise.
c. 
No person who previously occupied the position of Township Administrator shall be eligible for reappointment as Township Administrator within two years after separation from Township employment, whether the same occurs by removal, resignation, or otherwise.
d. 
No person who has been adjudged to have violated any ethics laws governing public office or public employment, including but not limited to the Local Government Ethics Law, N.J.S.A. 40A:9-22.1 et seq., and any similar statutory or regulatory scheme in any jurisdiction, by a body of competent jurisdiction over same, including but not limited to the Local Finance Board pursuant to N.J.S.A. 40A:9-22.4, a county ethics board pursuant to N.J.S.A. 40A:9-22.13 et seq., and a municipal ethics board pursuant to N.J.S.A. 40A:9-22.19 et seq., shall be eligible for appointment as Township Administrator.
e. 
The person appointed to the Office of Township Administrator need not be a resident of the Township at the time of their appointment and may reside outside of the municipality if agreed to by the Township Committee.

The Township Administrator shall serve at the pleasure of the Township Committee. During such term, the Administrator shall be subject to periodic review and evaluation of performance.

The Township Administrator may be removed by a 2/3 vote of the Governing Body. The resolution of removal shall become effective three months after its adoption by the Governing Body. However, the Governing Body may provide that the resolution have immediate effect, in which case, the Administrator shall be paid forthwith any unpaid balance of his (her) salary and his (her) salary for the next three calendar months following adoption of the resolution.

During any approved absence or disability of the Township Administrator, the Township Committee may, by resolution, appoint another individual or any employee or officer of the Township to temporarily perform the duties and responsibilities of the Township Administrator. After three months of such absence or disability, the position may be deemed vacant upon adoption of a resolution of the Township Committee. Compensation, if any, for duties performed for an appointment under this section will be determined by the Township Committee.

The Township Administrator shall receive such compensation as shall be prescribed by annual salary resolution or ordinance of the Township Committee. The Township Administrator shall be reimbursed for all reasonable expenses incurred in the performance of the office.

The Administrator shall perform the duties hereinafter enumerated and such other duties as may be assigned by the Township Committee. The Administrator's entire time and effort shall be devoted to the performance of the duties and functions of the position of Administrator and the Administrator shall not engage in any other occupation or employment while employed by the Township, except as approved by the Township Committee.

The Township Administrator shall not engage in any political activity, nor shall make any financial or other contributions to any local political campaign, nor lobby the elected officials on behalf of a political party or campaign. However, nothing contained herein shall be deemed to prohibit the Township Administrator from providing recommendations to the elected officials of the municipality on issues of concern to the municipality or from appearing before any other governmental body on behalf of the Township when authorized or directed to do so.

The Township Administrator shall act as the chief administrative officer of the Township. Duties shall include the development of rules and regulations for administrative procedures governing purchasing practices, operation of all departments, personnel management and general coordination of departments, offices, boards and agencies of the municipality, all for the purpose of increasing the effectiveness and efficiency of the municipal government and promoting its economic operation. All rules and regulations promulgated and implemented by the Township Administrator shall be filed with the Township Committee and shall become Township organizational policy unless specifically rescinded by the Township Committee.
The Township Administrator shall perform the duties hereinafter enumerated and such other duties as may be assigned by the Township Committee.
The Township Administrator shall report annually to the Township Committee on the progress of each department; shall initiate goals and objectives to be reviewed on an annual basis with special emphasis on critical problems and deterrents to the achievement thereof.
The Township Administrator shall be responsible for the organization and management of the work, personnel and programs in all departments; for the development and operation of a personnel program for all employees; and he (she) shall be accountable for the planning, organization, delegation, staffing, operation control, evaluation and correction in all departments to achieve maximum results.
The Township Administrator is given broad authority with the approval of the Township Committee to combine or eliminate functions, to redesign and reorganize work effort and to assign personnel to achieve maximum productivity.
The Township Administrator shall make assessments of municipal programs and operations reporting to the Township Committee on his (her) findings, setting forth a remediation action plan if necessary or required changes in Township ordinances and procedures.

The Township Administrator shall:
a. 
Supervise all personnel of the Township through the respective department heads unless otherwise provided for by law or this ordinance.
b. 
Advise the Township Committee on all matters of personnel administration and organization and assign personnel to the performance of all duties in all departments. Except for the purpose of inquiry, the Township Committee and its members shall deal with the administrative service solely through the Township Administrator, and neither the Township Committee nor any member shall give directives to any subordinate of the Township Administrator either publicly or privately.
c. 
Study, recommend, implement and enforce personnel organization and policy of the Township and implement personnel leave policies as established by the Township Committee for all departments, except as otherwise provided by law for the Police Department.
d. 
Maintain comprehensive personnel files and evaluation systems of job performance and duties.
e. 
Administer and negotiate on behalf of the Township all labor contracts.
f. 
Serve as the personnel officer of the Township with the authority to hire, evaluate, transfer, promote, discipline and/or discharge all employees to the extent not prohibited by law or provided for elsewhere in the ordinances of the Township. In those instances where the final authority rests with another agency, the Township Administrator shall assist that agency by recommending personnel actions which are consistent with those applied to other Township employees.
g. 
Investigate the affairs of any employee, officer, department, agency or authority of the Township when necessary or when directed by the Township Committee and submit a report relating thereto.

The Township Administrator shall:
a. 
Prepare the annual capital and operating budget to be presented to the Township Committee for adoption. In preparing these budgets, the Administrator or an officer designated by the Administrator shall obtain from the head of each department, committee, board, commission, agency, officer or authority estimates of anticipated expenditures and supporting data as requested.
b. 
Prepare and compile budget studies, analysis and schedules; assist in the conduct of public, departmental, board, committee, and commission budget hearings; and in conjunction with the Chief Financial Officer, shall assist the Township Committee in such manner as they shall require in the review of and adoption of the annual budget.
c. 
Prepare and submit to the Township Committee an explanatory budget message, including a comparison of prior years revenues, appropriations and expenditures as well as an analysis of the proposed revenues and expenditures.

The Township Administrator shall:
a. 
Administer the budget after its adoption by the Governing Body, shall maintain a continuing review and analysis of the budget operation, work progress and costs of municipal services; and shall assess the attainment of the Township's budget and service goals, reporting the same regularly to the Township Committee.
b. 
Study, recommend, implement, and enforce the financial procedures and policy of the Township and its departments, after consultation with department heads and approval of the Governing Body.

The Township Administrator shall be responsible for the negotiation of collective bargaining contracts with agencies representing Township employees, subject to the approval of the Township Committee, and for the administration and enforcement of such contracts and the Personnel Policies and Procedures of the Township.

The Township Administrator shall:
a. 
See that the provisions of all franchises, leases, permits and privileges granted by the Township are complied with and provide periodic reports of said compliance upon request.
b. 
Negotiate contracts for the Township upon request of the Governing Body and subject to the approval of the Governing Body.
c. 
Attend to the letting of contracts, in due form of law and supervise their performance and faithful execution except insofar as such duties are expressly imposed upon some other Township officer or official by statute.
d. 
See that all terms and conditions imposed in favor of the Township or its inhabitants in any statute, public utility, franchise or other contract are faithfully kept and performed, and upon knowledge of any violations, call the same to the attention of the Township Committee.
e. 
Advise the Township Committee if professional or other outside resources should be utilized.

The Township Administrator shall be responsible for researching, initiating action for, applying for and supervising the implementation of funding grants from various sources for the improvement and development of Township capital projects and needs as well as for services to the Township and its residents.

The Township Administrator shall:
a. 
Study the governmental and administrative operations and needs of the Township, and prepare and recommend to the Governing Body necessary and desirable plans and programs to meet present and foreseeable needs.
b. 
Develop, prescribe and enforce rules and regulations for the efficient management of the Township for the avoidance of any duplication or overlapping effort among the departments or among the units within a department, and for the improvement of methods and procedures of administration.
c. 
Integrate and coordinate the functions of all departments, boards, agencies, offices and officials, and also maintain liaison with the Board of Education.
d. 
The Administrator shall be responsible for continually improving communications among the various Township personnel, departments, agencies, boards and the Governing Body.
e. 
Recommend the employment of experts and consultants to perform work and render advice in connection with Township projects or services.
f. 
Make recommendations which may increase the efficiency of the operation of the Township.
g. 
Continually review and supervise the Township's insurance program.
h. 
Be responsible for the overall supervision and maintenance of real property owned by the Township, except as modified through delegation by the Governing Body or ordinance to autonomous boards or commissions.
i. 
Assign office space, furniture, telephone, computer and similar facilities, and other Township resources among and within departments.

The Township Administrator shall:
a. 
Study, recommend, implement and enforce procedures and policy of the Township and its departments for receipt, dissemination and collation of responses to communications and requests for information, after consultation with department heads and receive, distribute and follow up requests for information and complaints from citizens and keep the Township Committee informed on such matters.
b. 
The Administrator or an officer designated by the Administrator shall investigate and dispose of such complaints and the Administrator shall keep written record of such complaints and when and what action was taken in response thereto and provide the Governing Body a copy thereof when requested to do so.

The Township Administrator shall make recommendations concerning the nature and location of public improvements and coordinate and expedite the execution of public improvements authorized by the Township Committee.

The Township Administrator shall:
a. 
Represent the Township and assert its proper interests in relation to Federal, State, County and other political subdivisions, and with respect to Township contracts, franchises and interests.
b. 
Monitor and evaluate State and Federal legislation as to its impact on the Township with recommendations for actions by the Township Committee. The Administrator must be prepared to testify on behalf of the Township on issues affecting the community on behalf of the Governing Body.
c. 
Study the public utility rates and policies and evaluate same and recommend to the Township Committee an appropriate course of action.
d. 
Attend all regular and work session meetings of the Governing Body, with the right to speak but not vote on agenda items, and attend other meetings as directed by the Governing Body. The Administrator shall receive notice of and may attend and participate in all regular and special meetings of the Governing Body and all advisory committees, boards, commissions, and other agencies of the Township;
e. 
Keep the Governing Body informed as to the conduct of the Township affairs; submit periodic reports, either in writing or orally, on the condition of the Township finances; and shall submit other reports, either in writing or orally, as deemed advisable or as the Governing Body shall request; and shall make recommendations to the Governing Body necessary and advisable for the welfare of the Township.
f. 
Submit to the Governing Body as soon as possible after the close of the fiscal year, a complete written report of the administrative activities of the Township for the preceding year.
g. 
Implement all policies formulated by the Township Committee unless specifically directed otherwise by a formal action of the Governing Body.
h. 
Advise the Township Committee on all background matters as an aid to the creation of policy and recommend to the Governing Body adoption of such measures as may be deemed necessary or expedient.
i. 
Follow up acts of the Township Committee by correspondence, review of minutes and personal conferences.

The Township Administrator shall:
a. 
Serve as the purchasing officer of the Township, and/or designate an assistant purchasing officer, and shall purchase, or supervise the purchase of or delegate the purchase of, in accordance with the provisions of the governing statutes and sound purchasing practices, all materials, supplies and equipment of the various agencies, boards, departments and other offices of the Township. The Administrator shall keep or cause to be kept an account of all purchases and shall from time to time or when directed by the Governing Body make a full report thereof.
b. 
Establish rules, regulations, standards and specifications to control all purchases by the Township and recommend to the Governing Body such standards as to quality, size and variety of articles, equipment and supplies used by the offices and departments of the Township, to make possible uniform purchasing practices; and act as purchasing agent in the purchase of such materials, equipment and supplies, and to issue or supervise the issuance of the necessary purchase orders for such materials, equipment and supplies for all departments without exception; ensure that all purchases are at the most favorable price to the Township and see to it that the materials, equipment, services or supplies delivered are correct in number or amount and comply with the standards and specifications prescribed by the Governing Body as agreed to at the time of purchase.
c. 
Cause to be advertised proposals for the furnishing of work equipment and materials and receive bids therefor at the direction of the Governing Body.
d. 
Review, validate and recommend all bills and vouchers for payment prior to final approval by the Governing Body, and establish procedures associated with the voucher process.
e. 
Have no interest, directly or indirectly, in any contract job for work or materials, or the profits thereof, to be furnished to or performed for the Township.
f. 
Require the various departments, boards, commissions, agencies and programs to furnish annually a complete inventory of all fixed assets; and recommend the sale of any obsolete or surplus equipment, materials and supplies, and transfer to or between departments, offices and agencies and from or to central stores such supplies, material and equipment as need appears and arrange for the sale of surplus or obsolete items thereof.

Nothing in this section shall derogate from or authorize the Township Administrator to exercise powers of the elected officials of the municipality.

This section shall be known and may be cited as "The Township Administrator Ordinance."
[1976 Code § 14-11C]
The Township Committee shall appoint an Administrative Clerk subject to the NJ Department of Personnel rules and regulations. The Administrative Clerk shall receive such compensation as shall be prescribed by the Salary Ordinance.

The duties shall be as assigned by the Township Administrator.
[1976 Code § 14-20A]
The Township Committee shall appoint the Township Clerk for a term of three years beginning January 1 in the year in which the Clerk was appointed. The Township Clerk is subject to the provisions of law relating to tenure of office and removal from office. He/she shall receive compensation as prescribed by the Salary Ordinance and shall give bond, paid for by the Township, for the faithful performance of the duties of the office.

The Township Clerk shall:
a. 
Ensure that the minutes and records of the proceedings of the Township Committee are kept.
b. 
Preserve and compile all duly passed ordinances, recording them in a book, with a proper index to be provided for that purpose. Such book shall remain in the custody of the Township Clerk. Every ordinance shall be signed in the book by the Mayor and the Township Clerk.
c. 
Have and take custody of all the official books, papers and documents of the Township for which no other repository is provided by law, and preserve and keep them safely.
d. 
Perform all other duties required by statutory law.

No person shall be appointed as Township Clerk unless he or she shall have a Registered Municipal Clerk Certificate issued pursuant to N.J.S. 40A:9-133 et seq.
[1976 Code § 14-20C]
The Clerk shall cause the Township Seal to be affixed to instruments and writings when specifically authorized by law or when necessary to exemplify any document or record in the Clerk's office, or to certify any act or paper which, from the records in the Clerk's office, shall appear to be a true copy of any public record or proceeding.

The Clerk shall ensure the publication of all ordinances in such official newspaper or newspapers as may be required by law and authorized by the Township Committee, and shall file in the Clerk's office the affidavits of publication of such publications.

The Clerk shall issue and renew licenses regularly, pursuant to authorizations in existing ordinances and laws and with the assistance of any appropriate enforcement agencies required for such administration.

The Clerk shall be the custodian of all official surety bonds furnished by, or on account of, any Township officer, position holder or employee, except for that of the Township Clerk, which shall be placed in the custody of the Township Treasurer; all insurance policies with respect to risks insured for the benefit of the Township or to protect it against any claim, demand or liability whatsoever; and all formal contracts for work, labor, services, supplies, equipment and materials to which the Township may be a party. The Clerk shall also have custody of all leases of property owned by the Township. The Clerk shall be the depository for and have custody of all performance bonds running to the Township as obligee, and any other forms of non-cash security given by any contractor, subdivision developer or other persons on account of work done or to be done for the Township.

Correspondence and other communications received through the mails shall be delivered to the Clerk's office, where it shall be sorted and delivered immediately to the proper department. Mail addressed to a named individual shall be delivered unopened. General Township mail and mail addressed to the Township Committee, unless addressed to a named Committeeman, shall be opened in the Clerk's office, and the Clerk shall either reply to the correspondence, or refer the correspondence to the Township Administrator or department head for action and reply.

There is hereby created the office of Deputy Township Clerk in the Township of Holmdel.
[1976 Code § 5-2; New]
The Deputy Township Clerk shall assist the Township Clerk in the operation of the office by aiding the Township Clerk when requested to do so in the receipt of license applications and fees, issuance of certain licenses; registering and transferring of voters; reviewing and verifying payrolls and claims and preparing checks; making searches and issuing search certificates; at elections, preparing and distributing election equipment and supplies; swearing in of election officers and giving instructions to election officials; receiving election returns, keeping election personnel records and preparing needed checks; preparing reports dealing with licenses issued and moneys received and other pertinent matters; assisting in the preparation of resolutions, ordinances, vouchers and other municipal forms; assisting in the preparation of minutes of the meetings of the governing body; preparing suitable official reports for purposes of public record; preparing periodical reports of cash receipts and accounts for the same; answering inquiries and giving information of a public nature relating to municipal affairs; assisting in the arranging for and conducting of public elections; assisting in the establishment and maintenance of an extensive record and filing system; and supervising, when requested by the Township Clerk, of subordinates. In addition to the duties herein set forth, the Deputy Township Clerk shall perform such duties as may be assigned to him/her by the Township Clerk under the direction of the Township Committee, and further, the Deputy Township Clerk shall perform all the duties of the Township Clerk during such time and for such specific periods as the Township Clerk shall be absent or disabled.

The Deputy Township Clerk shall hold office for a term of two years and until his or her successor shall have been appointed and qualified. The term shall commence on January 1 of the year in which the appointment is made.

The Deputy Township Clerk shall receive such compensation as shall be determined by the Salary Ordinance of the Township of Holmdel.

The Township Committee shall appoint a Chief Financial Officer, who shall have the qualifications prescribed by N.J.S. 40A:9-140.1 et seq. The term of office of the person so appointed shall be four years as required by N.J.S. 40A:9-140.10. The Chief Financial Officer shall receive such compensation as shall be prescribed by the Salary Ordinance of the Township.

The Chief Financial Officer shall:
a. 
Be responsible for the effective and efficient management of the Department of Finance, including all staff.
b. 
Receive funds entrusted to or under the control of any department and deposit all funds received by him/her in depositories authorized by resolution of the Township Committee within the statutory requirements of 48 hours.
c. 
Have custody of all investments and invested funds of the Township in fiduciary capacity, except as otherwise provided by law, and keep such funds and all moneys of the Township not required for current operation invested or deposited in a prudent and reasonable manner.
d. 
Prepare required data in connection with Township debt and bond sales in conjunction with the Township bond counsel and other professionals.
e. 
Ensure that budget appropriations are not exceeded and are in conformance with statutory requirements.
f. 
Certify to all proposed contract resolutions and ordinances submitted prior to passage by the Township Committee as to available appropriations in conformity with statutory requirements.
g. 
Review, pre-audit, warrant and pay bills, claims and demands against the Township when duly authorized and approved by the Township Committee or the Township Administrator, as permitted in certain circumstances, and in compliance with all local and state purchasing requirements.
h. 
Keep a full account of all cash receipts and disbursements of the Township and, at least once a month, after the adoption of the budget, furnish the Township Committee a revenue status report for all budgetary funds and budget status reports for budgetary funds and capital funds.
i. 
For each regular meeting of the Township Committee, prepare a list of all bills, claims and vouchers to be submitted for governing body approval.
j. 
Maintain a centralized payroll system for the Township.
k. 
Ensure all statutory reporting requirements are met including but not limited to the preparation of the annual debt statement and annual financial statement.
l. 
Provide and produce all necessary documentation for the Township's annual audit including the financial statements and related notes to the financial statements.
m. 
Prepare preliminary work in connection with the Township budget and assist the Township Administrator in the preparation of the annual Administrative Budget proposal.
n. 
In conjunction with the Township Committee, Township Administrator, committees established by the Township Committee, and Township professionals, develop, implement and manage strategic financial goals, policies and procedures in alignment to the municipality's strategic financial objectives. Provide information, documentation and, when appropriate, make presentations to said officials, committees and professionals.
o. 
Establish, implement and maintain a financial management strategy and maintain a uniform system of accounts for all departments, offices, and agencies of the Township.
p. 
Ensure municipal financial viability through management and monitoring of all income and expenditures of the Township and communicate potential risks in a timely manner to the Township Committee and/or its designated representatives or subcommittee.
q. 
In conjunction with the Township Administrator, propose action plans to ensure that annual financial objectives are attained.
[1976 Code § 14-19A]
A registered municipal accountant of the State of New Jersey shall be appointed by the Township Committee for a period of one year, commencing on January 1 of the year in which he/she is appointed. The Auditor shall receive such customary fees and charges for work performed.

The Auditor shall make the annual audit and shall have the powers and perform the duties prescribed by law, or rules and regulations of the Division of Local Finance in the Department of Community Affairs of the State of New Jersey. He/she shall also perform such duties and render such services as may be prescribed by the Township Committee.

The Township Committee shall provide for the appointment of a Tax Assessor. The Tax Assessor shall hold the Tax Assessor's Certificate provided for in N.J.S. 54:1-35.25 et seq. and shall have the duty of assessing property for the purpose of general taxation. Nothing in this section shall affect adversely the salary or tenure rights acquired pursuant to N.J.S. 54:1-35.31 or any other law. In accordance with the provisions of N.J.S. 54:3-16, the Assessor, when making assessments, shall be governed by directions by the Monmouth County Tax Administrator. These directions shall be pursuant to rules adopted by the Monmouth County Tax Board.

The Tax Assessor shall have, perform and discharge all functions, powers and duties prescribed for assessors by rules and regulations prescribed by the Director of the Division of Taxation in the Department of the Treasury of the State of New Jersey and the Monmouth County Board of Taxation and shall:
a. 
Value all real and personal property in the Township for the purpose of assessments and taxation.
b. 
Prepare the tax lists, tax duplicate and maintain adequate assessment records of each and every parcel of real property assessed or exempted.
c. 
Have custody of and maintain an up-to-date Township Tax Map and provide for the recording thereon of all changes in ownership or character of property assessed.

The Tax Assessor shall hold office for a term of four years. Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term.

The Tax Assessor is subject to the provisions of law relating to tenure of office and removal from office. He/she shall receive compensation as prescribed by the Salary Ordinance.

The Township Committee shall provide for the appointment of a Tax Collector.

The Tax Collector shall hold office for a term of four years from January 1 next following his/her appointment. The Tax Collector is subject to the provisions of law relating to tenure of office and removal from office. He/she shall receive compensation as prescribed by the Salary Ordinance and shall give bond, paid for by the Township, for the faithful performance of the duties of the office.

No person shall be appointed or reappointed as Tax Collector unless he/she shall hold a Tax Collector's Certificate issued pursuant to N.J.S. 40:9-145.3. Any Tax Collector appointed pursuant to this section may obtain tenure pursuant to the provisions of N.J.S. 40A:9-144 or 40A:9-145. Any person who shall be reappointed Tax Collector subsequent to having received a Tax Collector's Certificate pursuant to N.J.S. 40A:9-145.3 and having served as Tax Collector or who has performed the duties of Tax Collector for not less than four consecutive years immediately prior to such reappointment shall have acquired tenure and shall hold his or her office during good behavior and efficiency and shall be removed only for good cause shown and after a proper hearing before the Director of the Division of Taxation or his/her designee in accordance with the provisions of N.J.S. 40A:9-145.8.

The Tax Collector shall:
a. 
Perform the functions of a collector of taxes including, without limitation thereto, the rendering of bills for property taxes and the conducting of tax sales.
b. 
Receive and collect all current and delinquent real taxes, tax sale fees and charges, and receive penalties and interest thereon.
c. 
Deposit, to the credit of the Township, all moneys received, in the depositories authorized by the Township Committee by resolution.
d. 
Maintain full and complete records and accounts of all sums collected and received under the supervision of the Township Auditor and in accordance with the standards and requirements of the Division of Local Finance in the Department of Community Affairs of the State of New Jersey.
e. 
Report to the Township Committee at least once a month all receipts and deposits made by him/her and shall, in such report, account for all moneys for which he/she is responsible.
f. 
The Tax Collector may issue and execute duplicate tax title certificates. Prior to the issuance of a duplicate tax title certificate, a letter must be received from the lienholder guaranteeing that he/she is the owner of the certificate and has not assigned it to another investor, and the governing body must adopt a resolution authorizing the Tax Collector to issue the duplicate. The fee for the duplicate tax title certificate is $50.
g. 
The Tax Collector may issue certificates of redemption. Prior to the issuance of a certificate of redemption, the former lienholder must submit a letter verifying that the lien has been paid and the certificate has been surrendered. The fee for the certificate of redemption is $25.

Vacancies other than due to the expiration of term shall be filled by appointment for the unexpired term.

There may be a Deputy Township Tax Collector appointed by the Township Committee subject to Civil Service Rules and Regulations. The Deputy Tax Collector shall assist the Tax Collector as he/she may direct and shall perform each duty of the Tax Collector as permitted by law. The Deputy Tax Collector shall receive such compensation as shall be prescribed in the Salary Ordinance.

There shall be a Township Attorney appointed by the Township Committee for a term of one year beginning on January 1 of the year in which he/she is appointed. He/she shall be an attorney-at-law of the State of New Jersey and shall receive such compensation as may be prescribed in the Salary Ordinance. In addition, the Attorney may receive the customary fees and charges for extraordinary legal services, provided when, in the judgment of the Township Committee, extraordinary legal services are required and authorized and the expenses incidental thereto are justified.

The Township Attorney shall be the legal advisor to the Township Committee and to all Departments except as may be otherwise provided by ordinance. He/she shall prosecute and defend actions and proceedings by and against the Township and every Department thereof. In furtherance of these general powers, and without limitation thereto, he shall:
a. 
Advise the Township Committee as to the form and sufficiency of all ordinances and resolutions prior to their passage.
b. 
Review and approve all contracts, deeds, documents and instruments prior to the execution thereof by or on behalf of the Township.
c. 
Conduct appeals from orders, decisions or judgments affecting any interest of the Township, as he/she may in his/her discretion determine to be necessary or desirable, or as directed by the Township Committee.
d. 
Subject to the approval of the Township Committee, have power to enter into any agreement, compromise or settlement of any litigation in which the Township is involved.
e. 
Render opinions in writing upon any question of law submitted to him/her by members of the Township Committee with respect to their respective official departmental powers and duties or the powers and duties of any officer of the Township.
f. 
Maintain a record of all actions, suits, proceedings and matters which relate to the Township's interest and report thereon from time to time as the Committee may require.
g. 
Conduct or arrange for the conduct of prosecutions for crimes and offenses cognizable by the Municipal Court of the Township of Holmdel, including violations of ordinances of the Township, complaints of any Department, under State law and violations of rules or regulations duly promulgated by any Department, except such crimes and offenses as it may be the duty of the County Prosecutor to prosecute.
h. 
Perform such other and different functions and duties as may be provided by ordinance.

Whenever he/she deems the interests of the Township so require, the Township Attorney may, with the approval of the Township Committee and within the limits of available appropriations, appoint special counsel to assist him/her in the preparation, trial or argument of legal matters or proceedings as he/she may determine. If the Township Attorney should be disqualified with respect to any matter, the Township Committee shall appoint special counsel to represent the Township for and with respect to such matters.

All papers, documents, memoranda, reports and other materials relating to the duties performed and services rendered by the Township Attorney for or in behalf of the Township shall be and remain the property of the Township. Upon the termination of his/her service with the Township, the Township Attorney shall forthwith surrender to his/her successor all such property, together with a written consent to substitution of his/her successor in all legal actions and proceedings then pending to which the Township is a party.

The Township Clerk shall be appointed Municipal Assessment Search Officer by the Township Committee for an indefinite term beginning January 1 of the year in which he/she is appointed, and shall receive such compensation as established by ordinance. The Municipal Assessment Search Officer shall be sworn in by the Township Committee and shall make examinations and issue assessment search certificates with respect to liens for municipal assessments or improvements approved but not yet certified.

The Tax Collector or the Deputy Tax Collector shall be appointed Tax Search Officer by the Township Committee for an indefinite term beginning January 1 of the year in which he/she is appointed and shall receive the customary fees as compensation. The Tax Search Officer shall make examinations of tax records about unpaid municipal liens and certify the results thereof.

The Zoning Officer shall be appointed by the Township Committee for a term of one year beginning January 1 of the year in which he/she is appointed. He/she shall receive such compensation as shall be prescribed in the Salary Ordinance.

The Zoning Officer shall:
a. 
Administer and enforce the Zoning Ordinance and such other ordinances as may be specified.
b. 
Attend meetings of the Board of Adjustment, the Township Committee and any other meetings as directed by the Township Committee.
c. 
Be under the direction of the Township Committee and make periodic reports to, and as required by the Committee.

The Zoning Board of Adjustment shall operate under the "Revised Zoning Ordinance of the Township of Holmdel" which established the Board, prescribes its membership, and assigns to it certain powers and functions.

a. 
There shall be a Municipal Court Public Defender appointed by the Township Committee. The Municipal Court Public Defender shall serve for a term of one year from the date of appointment and until the successor shall be appointed and qualifies. The Municipal Court Public Defender shall be an attorney-at-law of the State of New Jersey and shall provide all necessary and desirable legal counsel and advice required for the defense of cases in the Municipal Court of the Township on behalf of those indigent defendants who are entitled by law to appointment of counsel.
b. 
A person applying for representation by the Municipal Court Public Defender shall be required to pay an application fee of $200. The Municipal Court may waive the required application fee, in whole or in part, if the Court determines, in its discretion, upon a clear and convincing showing by the applicant, that the application fee represents an unreasonable burden on the person seeking representation.

There shall be a Construction Official appointed by the Township Committee. He/she shall receive such compensation as may be provided in the Salary Ordinance.

He/she shall, under supervision, have administrative responsibility for administering and enforcing the provisions of the New Jersey Uniform Construction Code (UCC) and other related duties as required.

Possession of a valid Construction Official's License issued by the Department of Community Affairs; possession of valid New Jersey driver's license; knowledge of basic principles of management and supervision and of the administration of a local enforcement agency; knowledge of record keeping requirements under the UCC; knowledge of legal methods of code enforcement; knowledge of building subcode provisions including structural requirements, durability and weatherability requirements, electrical subcode provisions, elevator subcode provisions, fire prevention code provisions, plumbing subcode provisions; ability to analyze and interpret the New Jersey UCC; ability to read, write, speak, understand, and communicate in English.

There shall be a Building Inspector appointed by the Township Committee. He/she shall receive such compensation as may be provided in the Salary Ordinance.

He/she shall, under supervision, inspect new and existing buildings and structures to ensure compliance with the State Uniform Construction Code and enforce same to ensure public safety, health, and welfare; and other related duties as required.

Possession of a valid Building Inspector's License issued by the Department of Community Affairs; possession of valid New Jersey driver's license; knowledge of structural design and analysis techniques necessary to check compliance with the State Uniform Construction Code with regard to wood framing, light steel, and wall bearing systems including foundation, wall, floor, and roof framing systems; knowledge of basic material standards, codes, and enforcement requirements related to weatherability and durability of installed construction materials; knowledge of basic fire protection requirements; knowledge of basic inspection tools and test methods; knowledge of organization and content of the State Uniform Construction Code; knowledge of the preparation of violation notices and prescribed inspection record keeping; knowledge of the classification of structures into class category; ability to analyze and interpret provisions of the State Uniform Construction Code; ability to prepare building construction plans and specifications, and to review for accuracy and feasibility those prepared by others; ability to make investigations and inspections; ability to prosecute violations of the Building Code by appearing in court.

There shall be a Building Subcode Official appointed by the Township Committee. He/she shall receive such compensation as may be provided in the Salary Ordinance.

He/she shall, under supervision, administer the Building Subcode of the State Uniform Construction Code and inspect and/or supervise the inspection of buildings in construction projects underway to ensure that compliance with plans and specifications approved in accord with State Uniform Construction Code is achieved; and other related duties as required.

Bachelor's degree from an accredited college or university; four years of management experience which shall have involved all of the following management functions: (1) Setting program organizational goals and objectives; (2) establishing organizational structure or determining the need for and developing plans for organizational changes; (3) setting policy for the organization or program managed by establishing program emphasis and priorities and developing operating and procedural guidelines; and (4) directing the work of the organization or program through subordinate levels of supervision. Possession of a Master's Degree from an accredited college or university with course study in human services administration, business administration, or public administration may be substituted for one year of experience.

Knowledge of all phases of municipal business operation; knowledge of management principles, practices, methods and techniques, and the administrative process; ability to work effectively and harmoniously with members of the governing body and other municipal officials; ability to make plans for the effective utilization of available funds, personnel, equipment, materials, and supplies; ability to provide heads of departments and others with advice and assistance when needed; ability to supervise business operations including financial and personnel records and paperwork; ability to supervise the purchase, receipt, storage, and issuance of equipment, materials, and supplies; ability to supervise the budgeting of funds to departments; ability to see that proper relations are established and maintained among the personnel; ability to utilize various types of electronic and/or manual recording and information systems used by the municipality; ability to read, write, speak, understand, or communicate in English sufficiently to perform the duties of this position.
