In the case of prolonged scarcity of water from any cause; or upon direction by the State of New Jersey; or in the event any local water company servicing the Township advises it that it is instituting water usage restrictions, the Mayor shall have the right to declare a water emergency. Upon issuance of a declaration, the use of water may be restricted as follows:
a. 
The filling of swimming pools and washing of cars may be prohibited;
b. 
Lawn or garden sprinkling may be prohibited or performed and accomplished on alternate days throughout the Township. All properties with odd number addresses or box numbers shall water only on the odd days of the month. All properties with even number addresses or box numbers shall water on the even days of the month. No property owners shall be permitted to water on the 31st day of any month;
c. 
Restrictions on such other water uses as shall be deemed necessary.

No person other than Township personnel, Fire Company personnel, Water Company personnel, unless authorized by the duly franchised water company for the area of the Township in which such fire hydrant is located, is permitted to operate or take water from any public or private fire hydrant for street sprinkling, flushing sewers, stormwater drains or for building construction or for any purposes other than fire protection purposes.

Unusual use of fire hydrants may be permitted for other purposes when special permission is obtained from the water company in writing. Permits to use hydrants will not be issued during cold weather, more particularly the period from December 1 to April 1, but not limited thereto. The water company will permit such special use pursuant to its own regulations.

No wrenches of any sort, other than the one supplied with the permit, shall be used for opening or closing hydrants. The water company will supply the Township Public Works Department, the Township Police Department and the Township Fire Companies with the necessary wrenches to be retained permanently for their respective use. Anyone using a hydrant shall display his or her permit forthwith if requested. No attachment of any sort shall be left connected to a hydrant except when it is in actual use. No hydrant shall be left unattended while attachments are connected during the time it is in use. The hydrant must be shut, attachments removed, caps replaced and the hydrant left in readiness for instant use when unattended.

All fire hydrants shall be maintained in accordance with N.J.A.C. 14:9-2.2 and N.J.A.C. 14:9-3.1.

Each fire hydrant located on municipal, County or State roadways or on private property shall be marked by the following described signing:
a. 
Two aluminum red reflectorized Placards being a minimum dimension of 4.0 inches by 6.0 inches bearing a white letter "H," being at least four inches in height ("Placard"); and
b. 
The Placards shall be mounted back-to-back at the top of a galvanized u-channel sign post ("post") driven a minimum of 240 inches into the ground, which post shall be located between two feet and four feet to the side or rear of the fire hydrant unless some limiting factor such as a sidewalk or driveway requires a farther offset. The post with mounted Placards shall constitute the "sign"; and
c. 
The sign shall be oriented so that the faces of the Placards each face the opposing flow of traffic on the adjacent street, road, drive or parking area; and
d. 
The sign shall be erected so that the top of the Placards are no less than four feet and no more than five feet above ground level.
e. 
Alternative Placards may be mounted on the post. The alternative Placards shall be a "GlowSmart" type Fire Hydrant Marker being a minimum dimension of 4.0 inches by 6.0 inches placard with red background on which is shown a white image of a fire hydrant at least four inches in height.

a. 
"Obstruction" is defined as that which prevents the free access and use of the hydrant, including any structure, planting, shrubbery, tree, snow, ice or any other obstruction.
b. 
If the fire hydrant is owned by or located on the private property owner's property, the property owner shall be responsible for clearing the obstruction. If the hydrant is located within the public right-of-way, the adjacent property owner shall be responsible for clearing the obstruction.
c. 
Clearing of Hydrants Obstructed by Snow and Ice. The owner of any real estate abutting a fire hydrant shall clear such fire hydrant of snow and ice within 24 hours of the end of snow or ice accumulation. If and in the event a fire hydrant has not been cleared it may be cleared by the Township. In addition to any fine, the cost of clearance up to a fee of $75 shall be assessed against the property and the property owner.

Each public or private water utility company shall be responsible for the painting, marking and clearing of their own hydrants in accordance with this section and N.J.A.C. 14:9-2.2. Fire hydrants located on private property which are not maintained by the public or private utility shall be the responsibility of the property owner for compliance.

Existing fire hydrants which are on January 15, 2013 marked by a sign which is not in strict compliance with the sign requirements of subsection 19-2.5, but approximates its characteristics, shall be considered as being in compliance for a period of three years. Thereafter, all fire hydrants must be in compliance with subsection 19-2.5. Any fire hydrants currently not marked with such signs must be brought into compliance within one year of adoption of this subsection, (February 5, 2013). All fire hydrants subsequently installed must be in compliance upon installation.

All fire hydrants shall be flushed and maintained in accordance with N.J.A.C. 14:9-2.2 and N.J.A.C. 14:9-3.1. Copies of the fire hydrant maintenance records shall be provided electronically once per year to the Township.

All fire hydrants that go out of service shall be returned to service within 72 hours. If due to extenuating circumstances the repair will take longer than 72 hours, the water utility will communicate the proposed "in service" date to the Police Department.

Failure to adhere to any of the provisions of this section shall be deemed to constitute a violation of this section. Every person violating this section shall be subject upon conviction to the penalty stated in Chapter 1, Section 1-5.
